This egress well is intended to serve an existing bedroom within an existing building in order to bring its egress standards up to Code. Cooper Avenue, involving the expansion of a street- facing window well. SUMMARY: The Applicant has requested a Residential Design Standard Variance related to the window well located along the east fagade wall. The request is to allow for an expansion of the existing window well from a depth of 1' 2" to 3'5." This expansion would bring the window well up to the egress standards provided in the building code. The reason that demands this Variance is due to the language in City of Aspen Land Use Code, Section 26.410.030.D.4, Residential Design Standards, Lightwells: "All areaways, lightwells and/or stairwells on the street facing facade(s) of a building shall be entirely recessed behind the frontmost wall of the building. " Being that Unit IA of the Aspen West Condominiums is on a corner lot, this standard applies to all street - facing facades of the structure and the expansion stated above would increase the amount that the window well currently extends into the front yard. STAFF EVALUATION: Staff supports the proposed variance to the Aspen West Condominiums, Unit 1 -A. Currently, the window well does not meet the standards for egress in the building code and could create a potential hazard in the event of a fire or other disaster. Expanding the horizontal depth of the window creates compliance with the building code and would increase the general public safety and welfare of the unit. Also, it has been brought to the Applicants attention that this expansion shall strictly be horizontal in nature. If the window well was to expand further down vertically, this would create additional exposed wall on a sub -grade area and adjust the FAR calculations for the condominiums. Page I of 3 Finally, this variance will not exceed the provisions for Projections into Yards established in Section 26.575.040.A.4. Specifically: "Fare escapes required by the International Building Code — (shall not exceed) Four feet. " The proposed window well only extends into the yard 3' S." DECISION: The Community Development Director finds the Residential Design Standard Variance to expand the east fagade window well as noted above and on Exhibit `A' to be consistent with the review criteria (Exhibit B) and thereby, APPROVES the variance as specified below.
