HomeMy WebLinkAboutLand Use Case.CU.412 N Mill St.1983-CU-3em 4, ra' CONDITIONAL USE PERMIT FOR UNITS B -11 AND THE SOUTHERN HALF OF B -9, BUILDING B, ANDREWS /McFARLIN CONDOMINIUM, AS DESCRIBED IN THE CONDOMINIUM MAP THEREOF RECORDED IN PLAT BOOK 14 AT PAGES 82 -83 AND AS DEFINED AND DESCRIBED IN THE CONDOMINIUM DECLARATION FOR ANDREWS /McFARLIN CONDOMINIUM RECORDED IN BOOK 443 AT PAGE 517, ALL OF THE RECORDS OF PITKIN COUNTY, COLORADO The Aspen Planning and Zoning Commission, pursuant to Section 2.4 -3.3 of the Aspen Municipal Code and after consideration at a duly- noticed public hearing held on October 4, 1983, and at its meeting of October 18, 1983, does grant to Sarah A. Pletts and Janet Garwood a conditional use permit to occupy B -11 and the southern half of B -9, Building B,of the Andrews/ McFarlin Condominium (as described above) as an accessory dwelling unit, a catalogue sales office and a dance studio, according to the following conditions: 1. The permitted use shall be a bo fide for - profit craftshop industry for the creation of art items such business to be operated solely by Sarah A. Pletts and Janet Garwood and their employees. 2. The accessory dwelling unit shall be occuoie d only by Sarah A. Pletts and Janet Garwood and their guests. This conditional use permit shall expressly not be assignable or transferrable and shall be personal to Sarah A. Pletts and Janet Garwood. 3. The permitted use and accessory dwelling unit shall be in one unified space (being the whole of Units B -11 and the southern half of B -9, Building 8 )and shall not be separated by a lockable door. 4. Prior to any future occupancy of Building B by any S /C /I use requiring it, Units B -11 and the southern half of B -9, Building B, will be separated from the remainder of Building B by a three -hour fire separation wall (according to the Uniform Building Code), with costs thereof to be paid by Robert W. and Jane Andrews, owners of the Building (and guaranteed by Pletts and Garwood) to ensure that the residential occupancy of Units B -11 and the southern half of B -9, Building R, will not put potential additional financial burdens on future S /C /I tenants in Building B. Failure to provide such separation (by primary responsibility or guarantee) shall result in an automatic termination of this residential conditional use. 5. Pletts and Garwood shall provide o for the residential use on the condominium spaces as needed (to prevent neighborhood visitors and customers, by agreement with ne designated parking space grounds and provide off -site parking traffic congestion) for use by neighboring property owners. 0 �o N y to m L C: PO w z BOGA 455 FA,_941 6. The permitted and conditional uses subject to this permit shall not be modified, enlarged or changed in any way without prior approval of the Planning and Zoning Commission pursuant to Section 24- 3.3(c) of the Municipal Code. 7. In the event that the subject property is sold to Pletts and Garwood, the condominium map on record shall be amended, through the City's subdivision exception process, if applicable, to reflect any change to the recorded plat, including the designation of parking space as required in Paragraph 5, above. 8. By signature below, Sarah A. Pletts and Janet Garwood, as lessees of of Units B -11 and the southern half of B -9, Building B, of the Andrews/ McFarlin Condominium (and Robert W. and Jane Andrews, as owners) accept the foregoing conditions of this permit and stipulate that this document shall be placed of record in the office of the Clerk and Recorder of Pitkin County, Colorado.
