Health Housing Open Space Other: FILE STATUS AND LOCATION: k RESOLUTION OF THE ASPEN PLANNING AND ZONING COMMISSION GRANTING A CONDITIONAL USE APPROVAL FOR KJAX SATELLITE DISH, RED BRICK ARTS CENTER, ASPEN, COLORADO Resolution No. 94 - ;26 WHEREAS, the applicant, Sy Coleman, submitted an application for a conditional use review for the installation of a satellite dish; and WHEREAS, pursuant to Section 24 -7 -304 of the Municipal Code, a satellite dish is a conditional use review requiring a public hearing by the Planning and Zoning Commission; and WHEREAS, the Aspen Planning and Zoning Commission held a public hearing July 5, 1994 and continued the hearing to July 19, 1994; and WHEREAS, the Commission reviewed the application for a satellite dish with a diameter of approximately 12 feet and recommended screening the dish and exploring a darker color to help the dish blend in with the surroundings. NOW, THEREFORE, BE IT RESOLVED by the Commission that it does hereby grant a conditional use approval with the following conditions: 1. The dish shall be located on the southwest side of the public trail behind the gymnasium of the Red Brick Community Arts and Recreation Center as close to the building as possible. 2. Prior to the City's permission to install the dish, a screening plan shall be submitted to the Planning Department for review and approval. 3. The applicant shall explore using a darker color on the dish to blend the dish with the background of the Red Brick building. 4. The Commission specifically asked the applicant to address the size of the dish, landscaped screening, the mesh cover of the dish, potential painting of the dish and to set up story poles. Staff received the information from the application very near the deadline for this memo. Therefore staff has attached the July 5 memo with the initial land use analysis of the proposed dish. Please find attached the updated information that the applicant has provided. ATTACHMENTS: New Information July 5, 1994 Staff Memo MEMORANDUM TO: Aspen Planning and Zoning Commission FROM: Leslie Lamont, Senior Planner RE: KJAX Satellite Dish - Conditional Use Review Public Hearing DATE: July 5, 1994 SUMMARY: The applicants have requested a conditional use review to install a satellite dish at the Red Brick School for receiving and broadcasting purposes. A satellite dish is a conditional use in the Public zone district. Staff recommends approval of the conditional use with conditions. APPLICANT: KJAX public radio station as represented by Sy Coleman LOCATION: 110 East Hallam, Red Brick Community Arts and Recreation Center ZONING: Public APPLICANT'S REQUEST: Conditional use approval for a satellite dish. REFERRAL COMMENTS: Engineering: 1. A specific screening plan must be submitted. 2. The proposed location of the dish in on the public trail. STAFF COMMENTS: Proposal - KJAX, Aspen's public radio station, is a tenant of the Red Brick Community Arts and Recreation Center. During the discussions for rezoning the school property and identification of the use of the building, KJAX was a strong participant in those deliberations. KJAX must use a satellite dish to receive transmission by National Public Radio, the "backbone of most public radio stations." This type of dish is the only one that will serve the purposes of the radio station. The dish will stand approximately 12' - 3 7/8" with a diameter of 12'. The applicant proposes to place the dish behind the gymnasium of the building, next to the public trail that goes behind the gym, and connects to the public trail coming up from the Post Office. Two locations have been identified on the applicant's map: 1 - to the west of trail closer to the building; and 2 - on the other side of the trail which appears to be on the edge of the hillside above v the Post Office trail. Conditional Use Review - Pursuant to Section 24 -7 -304 the criteria for a conditional use review are as follows: A. The conditional use is consistent with the purposes, goals, objectives and standards of the Aspen Area Comprehensive Plan, and with the intent of the Zone District in which it is proposed to be located; and RESPONSE: The property was rezoned to Public in 1993. The public radio station was considered an occupant at the time of the rezoning. The satellite dish is necessary for operations of the station. B. The conditional use is consistent and compatible with the character of the immediate vicinity of the parcel proposed for development and surrounding land uses, or enhances the mixture of complimentary uses and activities in the immediate vicinity of the parcel proposed for development; and RESPONSE: The building is surrounded by residential land uses. The Givens Institute is across the Post Office public trail to the north. If the dish is located on the edge of the hill behind the Red Brick it will not enhance the uses and activities of the surrounding area. C. The location, size, design and operating characteristics of the proposed conditional use minimizes adverse effects, including visual impacts, impacts on pedestrian and vehicular circulation, parking, trash, service delivery, noise, vibrations and odor on surrounding properties; and • • RESPONSE: If the dish is located on the northeast side of the public trail, perched on the side of the hill, the dish will visually impact trail users on the Post Office trail and will be very visible the Post Office area and from the residential homes along Garmisch Street. Staff recommends the applicant tuck the dish as close to the building as possible. The dish it cannot block the public trail. In addition, the dish shall be screened from view as much as possible. Before the applicant may install the dish a screening plan must be submitted to the Planning Department for review. Because the City of Aspen owns the property, the City will not provide permission to install the dish until a screening plan is approved. D. There are adequate public facilities and services to serve the conditional use including but not limited to roads, potable water, sewer, solid waste, parks, police, fire protection, emergency medical services, hospital and medical services, drainage systems, and schools; and RESPONSE: The public facilities are adequate to serve the dish. E. The applicant commits to supply affordable housing to meet the incremental need for increased employees generated by the conditional use; and RESPONSE: This conditional use review does not generate new employees. F. The proposed conditional use complies with all additional standards imposed on it by the Aspen Area Comprehensive Plan and by all other applicable requirements of this chapter. RESPONSE: The proposed conditional use will comply with the other regulations of this chapter. RECOMMENDATION: Staff recommends approval of the conditional use for one, 12'- 3 7/8" high and 12' diameter, satellite dish for KJAX public radio station behind the Red Brick Community Arts and Recreation Center with the following conditions: l 1. The dish shall be located on the southwest side of the public trail behind the gymnasium of the Red Brick Community Arts and Recreation Center as close to the building as possible. 2. Aspen Community Arts and Recreation Center). This Conditional Use involves the location of a satellite dish for use by KAJX in the north east corner of the property owned by the City of Aspen. Description of the Project: This submittal is requesting the approval of a 7 -304 conditional use review for the site of the Red Brick Community Arts and Recreation Center, in the form of a satellite dish for use by KAJX, who will be one of the tenants in the completed project. The building is located at 110 E Hallam Street, Aspen. Please refer to the next page for the Legal Description of the site. The dish is the sole reception device for transmissions by National Public Radio, a mainstay of local programming, and the backbone of most public radio stations. The area in question has recently (early 1993) been rezoned from the R -6 zone to the Public zone. A text amendment to the municipal code was also made so that "arts, cultural, and recreational activities" are an accepted use in that area. Please refer to Ordinance #22 and #21, series of 1993. The radio station use has always been a part of the discussion of the rezoning of the red brick building. The initial application for rezoning lists KAJX as an anticipated tenant, and they have been active in the process to purchase the building and promote its use as an arts and recreation center. Since KAJX is a non - profit, and public radio station, it is an appropriate addition to the group of tenants assembled in this building, unlike a commercial radio station. This dish is required for the operation of KAJX, and this particular type of dish is the only one that will serve the purpose. Please refer to the enclosed drawings and diagrams for further information on the dish and its location. The dish will be located so as to avoid all existing and recorded easements, mitigate impact to the residential areas surrounding the building, and provide the best aspect for the function of the dish. The precise location of the dish will be located in the area described, prior to the hearing and will be presented to the board and the public. KAJX is committed to provide any screening required for mitigation of the impact on the neighborhood. The conditional use in this case involves locating a satellite dish on the north east corner of the property upon which the Red Brick Community Arts and Recreation Center is located. ( see exhibit A) The dish is for the use of KAJX, our local public radio station. The parcel went through a change of zoning in early 1993 from the R -6 zone to the Public Zone, please refer to Ordinance #22, series of 1993, for this change in use. The Satellite dish is a permitted conditional use under municipal code, Sec. 5 -220 PUB, in the public zone district.. During that same process, a text amendment was made to the municipal code, and is noted under Ordinance #21, series of 1993, amending the allowed uses to provide for "arts, cultural and recreation activities ". A discussion of the proposed uses for the Red Brick, during the rezoning process, can be found in the text of the documentation of the rezoning process. B. "The Conditional use is consistent and compatible with..." This Satellite dish is required for the function of the radio station. There are no other alternatives in terms of configuration or alternate methods of reception. The discussion of the council and the original change in use submission, all discuss the compatibility of the arts and recreation center use in this area. C. "The location, size, design and operating characteristics of the proposed conditional use minimizes adverse effects..." We have located the dish on the north east corner of the site for the purposes of providing the most concealed location and minimizing the impact on the adjacent residential areas. This location also serves as the best site for the aspect of the dish and proximity to the KAJX studio. This are also has the potential for landscape screening without impacting the required parking on the site. We are committed to providing as much screening as possible without interfering with the function of the dish itself. D. "There are adequate public facilities" This conditional use does not increase the need for facilities or services. E. "The applicant commits to supply affordable housing..." This conditional use does not increase the need for employee housing. F. "The proposed conditional use complies with all additional standards..." Please refer to the discussion of the rezoning of this parcel for compliance with the Aspen Area Comprehensive Plan. This conditional use is an aspect of the use of the building by KAJX, which has already been discussed under the rezoning ordinance.
