ROUTING: Attorney Building Engineering Other • MEMORANDUM TO: Aspen Planning and Zoning Commission FROM: Jolene Vrchota, Planning Office RE: Popeil 8040 Special Review DATE: August 14, 1980 Background Ron Popeil, the owner of an existing single - family residence on Lot #3, Tipplewood Subdivision (near the south end of Galena Street), applied for a building permit for expansion of the house. The applicant has been unable to show definitively that the residence lies more than 50 yards from the 8040foot elevation line; therefore, you have a greenline special review appli- cation before you. (See attached letter of application.) Intent of 8040 Greenline Review Section 24 -6.2 (a) - To provide for review of all development above the 8040 Greenline within the City of Aspen and all development fifty (50) yards below the 8040 greenline so as to aid in the transition of development from urban areas to the adjacent agricultural and forestry uses; to insure that all development is compatible with the prevailing slopes; to provide for the least disturbance to the terrain and other natural land features of the area; to guarantee availability of utilities and adequate access; to reduce the impact of development on surface runoff, the natural watershed, and air pollution; to avoid losses due to avalanches, unstable slopes, rock fall and mud slides; and to enhance the natural mountain setting." Zoning: L -2 Attorney's Comments: No comment. Aspen Water Dept. Comments: Jim Markalunas reported that water pressure at the 8040 foot elevation is 30 psi, which is adequate for single- family residential use. The applicant has not supplied the precise vertical distance below 8040 fee, but it does certainly lie lower. The residence gains 0.433 pounds per vertical foot and has, therefore, more than adequate water supply. Engineering The Engineering Department stated that criteria #1 through Comments: #8 in subsection (b) were satisfied by the proposed addi- tion. Criteria #9 (encouraging reduction of building height and bulk to maintain the open character of the mountain), however, appears to be a problem. The L -2 zone allows a maximum height of 28 feet. The addition is 31 feet, 3 feet in excess of the maximum. Not only is the height not allowed, but it adds to the bulk of an already high and visible structure. Engineering recommends denial. Utilities and water service are already established, as are access and snow removal needs. The slope on the site, although steep, would not be adversely effected by the addition and geological hazards are not significant. However, under Number 9 of the review criteria the "reduction of building height and bulk to maintain the open character of the mountain" is encouraged. The plans for the addition as submitted to this office show a height of 31 feet from the northerly grade line representing a highly visible structure some 3 feet in excess of the permitted height in the L2 Zone. The existing structure is already quite high and visible and the new addition hardly contributes to reduce its bulk.
