HomeMy WebLinkAboutLand Use Case.CU.301 E Hyman Ave.1980-CU-2 MEMORANDUM T0: Planning and Zoning Commission (Aspen) FROM: Sunny Vann, Planning Office RE: Prospector Lodge, Conditional Use Expansion and Exemption from Mandatory PUD DATE: August 13, 1980 This is a public hearing pursuant to Section 24 -3.3 of the Municipal Code to consider the applicant's request to renovate and expand the Prospector Lodge, a conditional use in the CC Zone District. The Lodge, which is located at the southeast corner of Hyman and Monarch Streets (Lots A, B, C and D, Block 82), is non - conforming with respect to its intrusion into the Wheeler Opera House view plane, the location of its open space and its roof overhangs. Under the non - conforming structure provisions of the code (Section 24- 12.3), the Lodge may be renovated, as well as expanded, provided there is no increase in non- conformity. Pursuant to our view plane regulations (Section 24 -6.4), the renovation must proceed as a PUD provided, however, that P & Z may exempt the applicant from this requirement whenever it shall determine compliance to be unnecessary. The applicant proposes to maintain the same degree of non -con- formity with respect to the Wheeler View Plane and therefore requests exemption from the above mandatory PUD requirement. The existing two -story lodge contains 19 lodge roams and one employee unit, and is situated on four lots totaling 12,000 square feet. No on -site parking is required or available. The proposed renovation will maintain the same room /unit mix with the addition of a 17 -car subgrade parking garage. To improve the quality of the accommodations, the applicant proposes to enlarge the lodge to approximately 17,400 square feet (maximum allowable FAR is 18,000 square feet). As no increase in the number of lodge rooms is requested, a GMP allotment is not required. The renovation and expansion, however, is sub- ject to HPC approval because of the lodge's location within the CC Zone District. Preliminary approval was granted by the Historic Preservation Commission in May, 1980. The applicant also proposes to deed restrict the renovated employee unit and special review approval will be required by the P & Z and Council. Conditional Use Expansion In considering a request for renovation and /or expansion of a conditional use, the Planning and Zoning Commission must determine: 1. Whether the proposed use otherwise complies with all requirements imposed by the Zoning Code. 2. Whether the proposed use is consistent with the objectives and purposes of the Zoning Code and the applicable Zoning District. 3. Whether the proposed use is designed to be compatible with surrounding land uses and uses in the area. The Planning Office has reviewed the applicant's preliminary plans and has determined that the proposed renovation and expansion is consistent with the objectives of the CC Zone District and is compatible with surrounding land uses. Based on Planning's and Engineering's review of the applicant's plans, the proposed renovation and expansion also appear to comply with all require- ments imposed by the Zoning Code. The only notable exception identified by Engineering is the apparent lack of a required trash facility. The Planning Office therefore recommends approval of the applicant's request to renovate and expand the Prospector Lodge subject to the following: 1. No increase in non - conformity without P & Z approval via PUD provided, however, existing non - conformities may be reduced or eliminated without further P & Z review. 2. The retention and deed restriction of the existing employee housing unit pursuant to Section 24- 10.2(h) of the Municipal Code prior to issuance of a building permit. 3. Receipt of HPC final approval prior to issuance of a building permit. 4. The renovation and expansion of the structure otherwise complying with all requirements imposed by the Zoning Code, a final determination of compliance to be made at such time as working drawings are submitted for a building permit. Exemption from Mandatory PUD The proposed renovation and expansion will not increase the non - conformity of the existing lodge with respect to the Wheeler View Plane. Since no further visual intrusion is requested and all remaining non - conformities will be removed or maintained, no significant benefit is to be gained by requiring the applicant to proceed according to the provisions of PUD. The Planning Office therefore recommends approval of the applicant's request for exemption from the mandatory PUD requirements of Section 24- 6.4(E). Memo: Prospector Lodge Cond. May 13, 1980 H.P.C. has given preliminary approval to exterior design, materials, massing, and landscaping. 2. P & Z PUBLIC HEARING August 19, 1980 Exemption from the P.U.D. process is requested of P & Z in accordance', with Sec 24: 6.4E, since the P.U.D. is required solely by virtue of the Wheeler View Plane. Permission for expansion of this conditional use (Lodge) is requested of P & Z ( a one -step process). The degree of non - conformity of the existing structure with respect to the view plane is to be maintained, but not increased in the new structure. Other non - conformities will be brought into conformance in the new structure, including, 1.) sidewalks provided, 2.) roofs within lot lines, 3.) fireproof structure. 3. CITY COUNCIL After P & Z approval, City Council approval of the employee unit layout is sought. 4. H.P.C. Finally, final approval by H.P.C. of the design is needed. OTHER FACTS 1. ZONING Lot Size: 12,000 square feet Fire Zone: 2 Zone: CC F.A.R.: 1.5 : 1 Wheeler Opera House View Plane covers 90% of lot. (At approximate angle of neighboring Mason and Morse Building's stepped roof.) 2. EXISTING: 20 -room log 2 -story lodge (including one employee room). Several dense spruces border north and south property lines and a large willow along the east. No sidewalks exist. The building intrudes 11 feet up into view plane along Hyman. 3. PROPOSAL: A. Rebuild the lodge with the same nineteen rooms and the one employee unit but with a fireproof structure appropriate to this fire zone, and accomodations more suited to Aspen tourism. B. Build a one -story structure, where no building now exists, which abuts the Mason and Morse Building with an identical roof line, in a conforming manner with respect to the view plane. Build a two -story structure with approximately the same street -front envelope as the existing lodge, which maintains the existing view plane intrusion at the controlling point of the north and east sides, but does not increase it. C. All seven major spruces are to be retained and integrated into a new 8' wide sidewalk along both street fronts, which will join the site finally to the City pedestrian network. D. .A 'garden level' of lodge rooms is at 6 - 8 feet below grade; and a 17 -car parking garage, entering at the N.E. lot corner, is 16 feet below grade. The corner stair leads to roof -top hot tubs and deck (outside the view plane) which are completely screened from view by planters. Although the structure is a fire -proof concrete (with 6 inch floor thicknesses) the exterior materials are all natural: lichen rock stairs, and fire places; silver -grey cedar siding; rough sawn timber trim; and timber planters. Galena Aspen, CO 81611 Re: Prospector Lodge Dear Sunny: In accordance with your request at the meeting on June 4th with Paul Taddune, Patsy Newberry, Nasser Sadeghi, Dick Wilhelm and myself, the following is a list of the proposed changes to the plans upon which the P &Z apparently based its approval of the conditional use. As you know, it is our position that the changes do not require further review by the P &Z because, in our view, none of them can be considered a modification, structural enlargement, or expansion in ground area of the approved conditional use. Nevertheless, we are complying with your request with the understanding that the Planning Office will determine which, if any, of the items needs to go back to P &Z and will then if necessary, place this on the next available P &Z agenda. We would very much appreciate anything you could do to expedite the process. It should be noted that the request for these changes is at the behest of our prospective purchasers. We feel that all of the changes significantly improve the project and bring it much closer to the plans originally approved by the P &Z as opposed to the plan upon which a permit was issued. A. Change to Units 1. Bathrooms. The only change is in the configuration of the bathrooms. In all other respects they are virtually identical to the original plans with the same number of fixtures. 2. Wet Bar Locations. The wet bars have been moved from against the party walls between units to a location within each unit where there is a change in the floor level. The purpose of this change is to make the units more aesthetically appealing and to optimize the functional use of the space. The walls will extend less than 50% across the units in compliance with the input from the building department. 3. Location of Fireplaces. The fireplaces have been relocated from against the walls to the corners of the units. The purpose is to make the units more aesthetically appealing and to optimize the functional use of the space. It gives more width to the rooms and gives them up. The previous location effectively reduced the walls of the rooms by three feet. 4. Indoor - outdoor Jacuzzi -Hot Tub. These have been eliminated and replaced by outdoor hot tub -sauna combinations. This is much more practical and eliminates the safety and security problems associated with the previous proposal. B. Changes to Project 1. Pool -Hot Tub. The proposed change is to relocate the pool and hot tub from the third level roof to the second level roof. The purpose is to make them more accessible and less obtrusive. The new location would be well within the view plane and would significantly reduce or eliminate the visual impact. 2. Employee Unit. The location of the employee unit is being moved from the westerly part of the second level to the easterly part of the first level. The configuration of the unit has also been changed somewhat but the overall size is approximately the same or larger. The purpose is to place the unit in a more appropriate location so as to enable the utilization of a more valuable free market space. 3. Lounge. The lounge -lobby has been relocated in conjunction with the employee unit to the easterly side of the building. It has been expanded to include a continental breakfast area, information desk, large registration desk, ski racks, restroom and a game room. We think this is a substantial improvement and much more functional than the previous proposal. 4. Ramp. Creation of a ramp next to stairway #1 from the sidewalk to lower level for the handicapped. 5. Stair Landing Enclosures. Creation of stair landing enclosures on the west side of the building. The reason is that those landings are in shaded areas and the snow buildup would otherwise result in hazardous conditions. C J GARFIELD & HECHT Mr. Sunny Vann June 4, 1982 Page 3 6. Change in Windows. The above changes would require the following changes in windows: a) The window on the west side of the building has been removed due to relocation of the employee unit. b) Clerestory windows have been removed due to relocation of pool and possible icing problems on the north (shady) side of the building. c) Sliding glass doors to balconies are now 9'0" x 8'0" as a result of new configurations. We are also submitting herewith a revised set of plans showing the above changes. Please note, however, that one fireplace as well as the hot tub and sauna are still depicted but will not be constructed in the employee unit. DATE: August 13, 1980 Having reviewed the plans for the Prospector Lodge Remodeling and Expansion and having made a site inspection, the Engineering Department has compiled the following data with respect to the area and bulk requirements for a Commercial Code Zone: 1. The minimum lot area of 3000 square feet is met by having 12,000 + square feet. 2. There is no requirement for minimum lot area per dwelling unit. 3. There is no requirement for minimum lot width. 4. There is no requirement for minimum front yard. 5. There is no minimum rear yard requirement except that a utility -trash service area shall be required abutting an alley with a minimum length measured parallel to the alley of 25 feet and a minimum vertical clearance of 10 feet and depth of 10 feet. This provision may be varied from by special review of the Planning and Zoning Commission pursuant to the provisions of Section 24- 3.5(b). 6. The structure height is 24 feet which is below the maximum height requirement of 40 feet. 7. There is a required 25% of the building site for open space which for a 12,000 square foot lot is 3000 square feet. The existing structure allows for 54% open space or 6500 square feet. The proposed building, depending on the Building Department's determination of what can be classified as open space for this aructure, (i.e. can the rear balconies be calculated as open space) has either 23 %, 2764 square feet, open space which does not include the balconies or 34 %, 4096 square feet, open space which does include the bal- conies. 8. The external floor area ratio meets the 1.5:1 requirement. 9. The proposed structure does not exceed the existing 1 2 visual intrusion of the Prospector Lodge into the Wheeler Opera House view plane. However, a structure may be constructed so as to increase the actual physical intrusion into said view plane.
