(million gallons) clear well (reservoir). The configuration of the proposed solar array would be rectangular, as displayed in Exhibit E. This configuration includes an area of approximately 190 feet by 108 feet (20,520 square feet) which is consistent with the shape of the existing cover on the clear well. The proposed height would be twelve feet on top of the cover of the clear well which is approximately two feet five inches above existing grade for a total of 14.5 feet above grade. History: Ordinance No. 7, series of 1980 created the SPA designation for the Water Plant Site. Ordinance No. 18, Series of 1983 rezoned the underlying zone district of the Castle Creek Water Treatment Plant from R -15 /SPA to Public (PUB) /SPA. Ordinance No. 18 (Exhibit "A ") included a plan which approved upgrading utilities, new structures (clarifier and treatment plant), a storage building, a parking area and other improvements to Site. Subsequently, through Ordinance No. 23. Series of 1996 the City granted final SPA approval, Subdivision, Conditional Use Approval and dimensional requirements for affordable housing in the PUB Zone district, and Special Review for Parking for the City of Aspen Water Treatment Plant and Affordable housing project situated on Lot 2 and 4 of the Thomas Property. STAFF EVALUATION: Per the Application, the request is to add 190'x108' (20,520 square feet) of solar array to the cover on an existing reservoir structure. The total height (14.5') of the reservoir and the proposed solar structure on top would be within maximum height limitations (25') of the SPA. The location of the reservoir does not encroach upon the required 100 foot development setback. The Applicant's proposed solar array is consistent with current and historic uses of the property. The proposed structure is acceptable given the purpose and permitted uses of the underlying zone district (see Exhibit D). Additionally, the proposed solar array meets the requirements for an insubstantial amendment to an SPA (see Exhibit C, Review Criteria). DECISION: The Community Development Director finds the administrative application for an Insubstantial SPA Amendment to the Water Plant SPA as noted above to be consistent with the review criteria Ceeexhibit C). The Applicant shall be,,,,ble to complete normal maintenance and upkeep to the facility when needed, but shall seek an amendment to this approval if the photovoltaic equipment is to be alteried in height or size. The Community Development Director hereby APPROVES the request: APPR ED BY: A l 1060 ?ObD Chris Bend end.on Date Community Development Director ACCEPTED BY: It /o /tD a - D =., • ent Date Attachments: Exhibit A: Ordinance No. 18, Series of 1983 Exhibit B: The City Thomas Property Subdivision Exception Lot 4, Specially Planned Area Map Amendment No. 1 Exhibit C: Review Criteria Exhibit D: Permitted uses in the Public (PUB) zone district Exhibit E: Photographs and location map of the solar /photovoltaic equipment Exhibit F: Application eilli".111 A. An insubstantial amendment to an approved development order for a final development plan may be authorized by the Community Development Director. The following shall not be considered an insubstantial amendment: 1. A change in the use or character of the development. Staff response: This proposal is in line with the City's long term goal to increase its renewable energy resources. The Water Plant Site an existing treatment plant and location of solar panels to convert sunlight to energy is consistent with the use and character of the site. Staff finds this criterion met. 2. An increase by greater than three percent (3 %) in the overall coverage of structures on the land. Staff response: Not applicable; the structure exists and the solar panels would be mounted to the existing cover of the Clear Well. Staff finds this criterion met. 3. Any amendment that substantially increases trip generation rates of the proposed development or the demand for public facilities. Staff response: Trip generation rates will remain similar to existing as the solar photovoltaic energy system does not require high maintenance. Staff finds this criterion met. 4. A reduction by greater than three percent (3 %) of the approved open space. Staff response: Not applicable; open space will not be changed with this instillation. 5. A reduction by greater than one percent (1%) of the off - street parking and loading space. Staff response: Parking will remain the same other than during construction. Staff finds this criterion met. 6. A reduction in required pavement widths or rights -of -way for streets and easements. Staff response: Not applicable. 7. An increase of greater than two percent (2 %) in the approved gross leasable floor area of commercial buildings. Staff response: Not applicable; not an enclosed structure. 8. An increase by greater than one percent (1%) in the approved residential density of the development. ; Staff response: Not applicable; this is not a residence. 9. Any change which is inconsistent with a condition or representation of the project's original approval or which requires granting of a further variation from the project's approved use or dimensional requirements. Staff response: The photovoltaic energy system is consistent with the SPA original approval and does not require variation for use or dimensional requirements. Staff finds this criterion met. 0 7 EXHIBIT `D' 26.710.250. Public (PUB). A. Purpose. CITY OF ASPEN PRE- APPLICATION CONFERENCE SUMMARY PLANNER: Drew Alexander, 970.429.2739 DATE: 11/04/2010 PROJECT: 500 Doolittle Drive, City Water Plant REPRESENTATIVE: Sam Irmen, 970.429.1974 OWNER: City of Aspen TYPE OF APPLICATION: Insubstantial SPA Amendment DESCRIPTION: The City of Aspen Water Department has proposed the placement of photovoltaic (PV) solar modules at Lot 25 of the Water Plant Specially Planned Area (SPA). The Water Plant SPA was created in 1984, and has undergone several development projects since, such as the Water Plant Affordable Housing and expansions to the office and work areas near the water plant. Upon receiving an electrical permit through the Building Department, Planning Staff became aware of the proposed PV equipment. This permit, 0237.2010.AELE, was intended to complete PV installation work that had begun in 2008 (0193.2008.AELE). After reviewing the permit, and the previously completed work, it was Staff's determination that the project should have received a review by Com Dev for an SPA amendment. Before zoning can approve the current electrical permit, Staff is requiring a land use application be filed to satisfy the SPA amendment. This review will be handled administratively. The purpose of this is to ensure the correct land use process is handled before work is completed, and also establish parameters around future work regarding the PV area. The review will not include the Planning and Zoning Commission, therefore no public noticing is required. Below is a link to the Land Use application form and the Land Use Code for your convenience.
