North Street for the place- ment of eight lighting fixtures. As stated in his letter request of November 24 the engineering depart- ment has been working closely with him and approval was given to erect the light fixtures. In an instance such as this when a previously unim- proved public right -of -way is improved by a developer we use the normal subdivision design standards where applicable. One such standard is that suitable street lights be provided, ornamental lights being desirable (Section 20- 17(a)(23)). The lighting plan submitted by Mr. Erdman was reviewed with this criteria in mind and would probably not have been approved had the street not been a dead -end limited to a potential five residences. In other words it was felt this type of low level lighting was desirable and justified. Within the last two weeks considerable controversy has arisen over the street improvements including the lights and landscaping and we feel that a determination by Council is appropriate. The engineering department's approval presumed that the lighting was a beneficial improvement to the public right -of -way as required by code, and as such did not require Council approval. If you feel they constitute an encroachment, we would recommend approval of the request. As is the custom in Aspen, these improvements to the right -of -way are made for the City but paid for entirely by the residents involved. On November 10th, 1976, the Engineering Department granted Final Appro- val to my plans, which include the installation of mature shade trees, grass, low -level street lighting and asphalt paving of the drives and roadway. The cost to me of these improvements runs close to $20,000; which, while considerable for less than 100 yards of frontage, I am happy to pay in the interest of safety and good looks. On November 16th, your office informed me, for the first time, that since the lights are technically "structures" in the right -of -way, I should apply to the City Council for formal approval of what I am told is an encroachment. I hereby request that approval. Seven copies of the plans and details are submitted herewith, and I can hardly imagine that the principle of street lighting is open to much argument. We are residents on a dead -end street at the edge of the City, with a number of young children, and surely lighting is desireable for safety alone, if not to facilitate the City's snow removal, emergency vehicles, and so on. For your information, I have invested some $3000 in the lights since being granted Final Approval, and I have designed them to be as unobtrusive as a street light can possibly be. Total overall height is 3' -8" -- the minimum to keep them above the snow- - and the total wattage of each standard will be but 50. I would anticipate no problems, and•the above would be the end of this letter, were it not for one thing: you and I are both aware that a certain neighbor, a Mr. Menscher, is prepared to oppose our street - lighting; not • Dave Ellis Page 2 because of any particular interest in the lighting per se, but simply as his latest move in obstructing every aspect of my project, a pursuit which seems to have become that person's avocation, if not his full -time occupation. In the event that the City Council wishes to become involved further in that depressing aspect, I have prepared a brief history which is available to them, however I am reluctant to make a person's malicious activities a matter of public record. Very truly yours, Donnelley Erdman PETITION The undersigned residents of Aspen desire to strenuously express their objection to the nature of the development that has taken place on the Erdman Subdivision and request that the City Council refrain from granting Donelly Erdman any further concessions until such time as Mr. Erdman will agree to conditions which will better accomodate the impact that the development creates in the neighborhood. Further, in light of the problems raised by the Erdman Subdivision, the undersigned request that City Council restrict use of all existing R -6 Lots to single family detached dwellings and that City Council create no new R -6 zones in the old West End. Finally, any proposed development of R -6 Lots in this area should require maximum neighborhood input.
