Re: Encroachment on Little Nell
Pump Station
Dear Michael:
The council considered at the December 17th meeting the
request for permission to encroach with all electrical equip-
ment belonging to you and attached to the city owned ]Little Nell
Pump Station. The encroachment was granted conditioned on your
repairing any damage to foliage caused by installation and subject
to the following, which are commonly imposed on granting of
encroachments:
1. That you agree that the license is solely at the dis-
cretion of the city council and permission may be withdrawn for
any reason at any time. Further, you agree that you will, on
request, remove the apparatus and all costs of removal will be
assumed by you.
2. You agree that you will be responsible for any main-
tenance and repair necessary to keep the apparatus safe as
determined by the City of Aspen.
3. Finally, you agree to indemnify and hold the city
harmless from any and all damages or liability by reason of
death, injury or property damage suffered by any person as a
result of the placement of the electrical apparatus on city
property.
In addition, in the event the city should so require, you
agree to obtain comprehensive public liability insurance covering
bodily injury or death in the amount of at least $300,000 for
each person in any one accident, $300,000 for each accident,
and property damage in the amount of $100,000 for each occurrence.

SUBJECT: ` CROACHMENT oN LITTLE NELL PUMPING STATION
At the December 10th meet's* T. -- -sted information
about the encroachment on the Little Nell Pumping Statioj
It appears that the electrical equipment (except for
the meters which are ours) belongs to the owner of the building.
Conbined recommendations of Marky and Dave are:
1. ask for $25.00 in compensation for damage done
while installed
2. request an indemnification agreement similar to those
given for encroachments on rights -of -way (however,
this is private property, not a public right of way).
