Councilwoman Fallin said no one has ever called her as a Councilmember about not being able to get a cab. Councilman Gassman agreed. Sullivan said the issue is whether the Council wants service or not. Sullivan said endorsement is a function of the Council to determine if this service is needed by the ski season. Mayor Stirling said he feels it would be a good action of Council to support another company because it is important to have much selection as one can have. Mayor Stirling moved that Council write a letter in favor of the application for a temporary license by Aspen Limo; seconded by Councilman Tuite. Councilman Tuite and Mayor Stirling in favor; everyone else opposed. Motion NOT carried. ENCROACHMENT REQUEST - Peters /Chaikovska Councilwoman Fallin moved to approve the encroachment request for Frank Peters and Marta Chaikovska residence subject to condi- tions; seconded by Councilman Tuite. All in favor, motion carried. Marta Chaikovska pointed out one of the conditions is that they construct a sidewalk as part of the encroachment request. Ms. Chaikovska said there are no existing sidewalks in the west end. Ms. Chaikovska said there is not enough room for a sidewalk. Councilman Gassman moved to reconsider the previous motion; seconded by Mayor Stirling. All in favor, with the exception of Councilman Isaac and Councilwoman Fallin. Motion carried. Councilman Gassman moved to approve the encroachment request without the sidewalk as a condition; seconded by Mayor Stirling. Chuck Roth, engineering department, said the code requires sidewalks. This has not been requested in the past. Roth said this should not stop the city from enforcing the code and obtaining sidewalks. Mayor Stirling said there is a general feeling in the west end that the residents do not want sidewalks. Mayor Stirling said the code should be re- addressed. Augie Reno, HPC member, said it is a consensus that there should not be sidewalks in the west end. There are irrigation ditches in that part of the community. Roth said the lack of sidewalks causes hazardous conditions, especially in the winter with people walking on the streets. All in favor, with the exception of Councilwoman Fallin. Motion carried. I ---) MEMORANDUM TO: Mayor and Council THRU: Bob Anderson, City Manager FROM: Jim Gibbard, Engineering Department DATE: September 7, 1988 RE: Frank Peters and Marta Chaikovska Residence Encroachment Application Summary: The Engineering Department recommends that Council approve an Encroachment Licence for part of a parking space in the public right of way on the east side of the 300 block of N. Third Street. Previous Council Action: None Background: Pursuant to Section 5 -301 C. of the Aspen Municipal Code Aspen Land Use Regulations, the applicant is required to create an additional parking space. Most of this required parking space will be located on the applicant's property, but a portion that is 4 feet long and 9 feet wide will overhang into the right of way. Discussion: The location of the proposed parking space is in the applicant's driveway. There is no sidewalk in the public right of way at this location at the present time. According to Section 19 -98 of Municipal Code, for any new construction done in this district, a sidewalk needs to be constructed. When this sidewalk is constructed, the 4 foot overhang into the driveway would not be a significant impact because there is 15 feet of right of way from property line to curb. Recommendation: Since this 4 foot overhang will not be a signif- icant impact to the use of the public right of way, the Engineer- ing Department recommends that the applicant be granted an Encroachment Licence with the condition that a sidewalk be constructed along the Third Street right of way adjacent to this property. The encroachment would be onto North Third Street for the additional parking space required with the restoration of the existing carriage house. The parking space irvolved is, for the most part, contained within the property line, but it does overhang onto the City Right -of -Way, We believe that this has already been set as an historical precedent in this West End neighborhood, arid would like for you to consider that when reviewing our request. .
