SUBJECT: BENNET HALL FENCE ENCROACHMENT

It is recommended that the City grant the license to encroach.
Bennet Hall has made application for license to encroach as
shown on the attached map. The fence replaces a split rail
fence. The application was referred to the following City
Departments and utility companies:
Streets Dept. Fire Dept. Mtn. Bell
* Parks Dept. *Sanitation Dept. *Rocky Mtn. Gas
Water Dept. Canyon Cable *Holy Cross Elect.
Those listed with asterisks responded saying that the fence
posed no problems for them. The fence comes close to the road
and would need to be moved if a sidewalk or curb and gutter were
put in. The new fence could also hinder snow removal.
RECOMMENDATION
It is my recommendation that the license to encroach be
granted. Although there are possible problems with the fences,
until they manifest themselves I don't think they need to move
the fence.
PROPOSED MOTION
If council concurs, the motion should read as follows:
I move that the City grant a license to encroach to Bennett
Hall for a Lfencef in the public right of way subject to the
following conditions.
1. Provision of an updated map to serve as an exhibit to license.
2. Naming of the City of Aspen as co- insured on the applicants
insurance.
3. Execution of a standard encroachment license agreement
satisfactory to the City Attorney's office.
