Very minimal obnoxious noise, vibration or odor will be generated which adversely affect surrounding properties. The space in question is currently used for parking with respect to the Ritz Hotel. 4. "There are adequate public facilities and services to serve the conditional use including but not limited to roads, potable water, sewer, solid waste, parks, police, fire protection, emergency medical services, hospital and medical services, drainage systems, and schools." The proposed conditional use will have no adverse impact upon the above public facilities and services. 5. Parking is already provided on the site and the management of the Ritz Hotel feel that no additional employees will be needed. 6. The proposed conditional use will comply with all applicable requirements of the Aspen Land Use Regulations. M E M O R A N D U M TO: Bill Efting Stan Clauson Kim Johnson FROM: Lee Cassin DATE: November 10, 1994 RE: Ritz Parking Proposal There are several options which the city can pursue with regard to this application. 1) Charge $1 /hour for these spaces. While this suggestion was dismissed out of hand, it might make sense to pursue it further. It would not impede our ability to build the "entrance to Aspen" transit system, would not require an analysis of our SIP attainment demonstration, would not require using up any of our SIP buffer, and last, but hopefully not least, would not increase PM levels. 2) Approve the conditional use in conjunction with removal of 100 parking spaces elsewhere as part of the city's plans to make certain downtown streets more pedestrian - friendly. These plans have been widely discussed but not implemented and conceptually would be something like the plans to convert parking on one side of a street to wider sidewalks and bikeways, making parts of Galena or Cooper into pedestrian /busways, etc. This again would not impede our ability to build the "entrance to Aspen" transit system, would not require an analysis of our SIP attainment demonstration, would not require using up any of our SIP buffer, and again, would not increase PM levels. 3) Approve the conditional use and approve additional measures to offset the increase in PM caused by adding public parking spaces. In order to not interfere with the entrance to Aspen, these measures would have to address traffic and sanding (not woodburning or restaurant grills). This would maintain air quality and preserve our SIP buffer but WOULD require the city to hire a consultant to analyze how much traffic and PM would increase as a result of this action, and then how much traffic and PM would decrease as a result of the new strategies. My gut feeling is that a relatively small increase in sweeping would be sufficient. 4) Approve the conditional use without offsetting PM reduction measures. This is possible but has a few negative effects. a) It will worsen PM which is contrary to council goals. b) It will interfere with a conformity finding for the entrance to Aspen. Offsetting measures will have to be found to get a positive conformity determination and build the entrance to Aspen. c) It will cause a delay in approval and implementation of the ■••, public use of these spaces until a consultant has been hired and analyzes the traffic and PM impacts of the proposal. This is a negative factor only if the intention is to provide these spaces close to the time of the beginning of paid parking. d) It makes it more difficult for the city & our department to send a convincing message to citizens that our goal is to encourage people to use alternatives to driving, to reduce air pollution, and to reduce traffic. 5) Approve the conditional use with the modification that these would be 100 free carpool spaces instead of cheaper monthly spaces. The impact of this proposal on PM and traffic would be greatly lessened if the 100 spaces were paid for on a daily basis instead of by a monthly pass. Obviously, if someone has bought a monthly pass they have no incentive not to drive on days when it would be possible not to: they instead are encouraged to "get their money's worth ". If this proposal is approved, we would recommend the spaces be sold daily and not monthly. By way of background, here is a brief explanation of the SIP and how the calculations were done. Since 83% of Aspen's PM comes from traffic on sanded roads, this source is the one most of the SIP control measures address. When faced with the EPA's suggested control measures targeting restaurants, the City Council decided to insist on a SIP that would really work, addressing the fundamental problem of traffic. For that reason, paid parking was included in the SIP. Paid parking reduces traffic to the extent that some drivers will reduce their driving if the commercial core costs $1 /hr and residential areas cost about half that. In the SIP's technical support documents, it was assumed that commuting employees are most affected by paid parking. The total number of spaces effectively available is thus reduced by an amount that depends on the cost of the parking, and thus the number of commuter trips is reduced by an amount depending on the effective number of spaces available at each cost. This proposal is inconsistent with the SIP because it adds back 100 cheaper spaces. This conclusion does not mean that the conditional use cannot be granted, as discussed above. The City of Aspen proposes to allow the use of one hundred (100) parking spaces in the Ritz Parking Garage for monthly use by the general public at the "same rate charged by the City of Aspen Parking Garage. The application is submitted pursuant to Section 5 -214.0 of the Aspen Land use Regulations by the City of Aspen. Permission for the City of Aspen by the management and owner of the Ritz Hotel is attached. PROJECT SITE The Ritz Carlton property which includes the parking garage is located at 315 East Dean Street. The legal description is Lot 1, of the Aspen Mountain Subdivision. Existing man -made improvements to the property include the hotel, restaurant, parking garage and retail stores. BACKGROUND The City of Aspen paid parking program will begin on November 28, 1994 and we anticipate that the City of Aspen parking garage will be utilized to maximum capacity. Currently the Ritz Parking Garage is not utilized anywhere near. capacity. . Many workers in the . downtown core still need to use the automobile on a daily basis and cannot use mass transit, this additional 100 spaces will fill that void. Even during peak season the garage averages less than 50% capacity. The current monthly parking fee at the City of Aspen Parking Garage is $100.00 per month for unlimited parking. The fee to the public using the Ritz garage will always remain the same as charged by the City of Aspen garage and be limited to 100 passes a month. Parking will remain valet parking and will be open to the public on a 24 hour a day basis. The hotel currently employs a staff of three employees on each shift for parking and will adjust for peak times if necessary to remain proper traffic control. REVIEW REQUIREMENTS Pursuant to section 5- 214.C. of the Regulations, a parking garage is a conditional use in the LTR /PUD zone district. As a result, usage by the City of Aspen is subject to review approval by the Planning and Zoning Commission. The specific review criteria for conditional uses, and the proposed parking garage's compliance therewith, are summarized below. 1. "The conditional use is consistent with the purposes, goals, objectives and standards of the Aspen Area Comprehensive Plan, and with the intent of the Zone District in which it is proposed to be located." Under the Transportation Action Plan section in the Community Plan is specifically sites the need to determine the number of underutilized private parking spaces within the commercial core and create a plan for more efficient utilization of these spaces for public use. 2. "The conditional use is consistent and compatible with the character of the immediate vicinity of the parcel propose for development and surrounding land uses, or enhances the mixture of complimentary uses and activities in the vicinity of the parcel proposed for development." The proposed use the Ritz Parking Garage is consistent and compatible with existing land uses in the immediate site area. The area is predominantly commercial in character, and includes restaurants and a variety of retail commercial uses. The proposed parking will compliment the existing uses in the area and will provide an attractive parking alternative for the local population. 3.
