Judge Petersen, on December 14, 2011, provided you two options to resolve the issue by January 16, 2012, and removal of the pergola was one option. If, in the future, you decide to construct a similar structure a land use approval will be required prior to installation. If a structure is again installed without a land use approval, any and all issues that have come to light via the recent court proceedings will be enforced. As I also mentioned in both communications, "failure to do one or the other within the noted timeframe will result in a summons into municipal court." As of the date of this letter the trellis structure has not been removed and no land use application has been submitted. As a result, included with this correspondence is a summons into municipal court, requiring a court appearance by you on Wednesday, October 19, 2011. The porch structure that you built is required to receive Stream Margin Exemption approval prior to installation. This is a land use approval that has nothing to do with the building code. I went to Loews in search of the proper furniture and found a 10x12, four post shade cover that fit the bill. Instead of purchasing this, I decided to replicate it by re -using my old materials. There is nothing in the municipal code that says anything about disallowing patio furniture. Thanks for your concern! This trellis was one of three that were constructed without required land use reviews and approvals. It is my understanding that you chose to remove all three trellises rather than proceed through an approval process. Visual confirmation of the removal of the three trellises was conducted by the City on June 6, 2011. This letter is submitted to reiterate t the alternatives that would allow you to become compliant with the city's adopted rules and regulations. As noted in my letter to you dated April 26, 2011, a copy of which is attached, to potentially retain the original three trellis structures, or the one that has been rebuilt, additional materials must be submitted with a Stream Margin Exemption application or the presently existing trellis must be removed. This existing structure has not been granted Stream Margin Review Exemption and cannot be maintained on site without proper approval. , Thus, please submit an application for a Stream Margin Exemption and the appropriate fee or remove the trellis structure within 15 days of receipt of this letter. Failure to do one or the other within the noted timeframe will result in a summons into municipal court, with potential fines and/or jail time. As the complaint submitted was with regard to the trellis structures, removal of the three structures will remedy the code violation; however, the removal of the trellises may not preclude the need for a survey in the future if additional complaints are received - I'd again encourage you to consider providing a survey of your property, if you would prefer to retain the trellises. If removing the three trellis structures is your preferred course of action please have them removed within 60 days of the date of this -letter. Exemption, #3 (a. — e.) for our proposed Pergolas (patio shade coverings /awnings). All standards have been met and we have included additional detailed information for your review. Exemption #3. The following standards and documents (Exhibits A — F, and Enclosures 1 -5) show compliance to your requirements: a. The development does not add more than ten percent (10 %) to the floor area of the existing structure or increase the amount of building area exempt from floor area calculations by more than twenty-five (25 %). The existing house and decks were given final approved on 10/31/1996 (Stephen Kanipe) - Exhibit A The proposed covered area of the Pergolas equals a total of 497.24 square feet which is less than the allowable area of 650.14 square feet (calculations from Claude Salter — office visit with Gary Moore early August 2010) - Exhibit B b. The development does not require the removal of any tree for which a permit would be required pursuant to chapter 13.20 of this Code. The Pergolas are on top of and within the approved existing decks, hence there are no trees involved whatsoever — Exhibit C c. The development is located such that no portion of the expansion, remodeling or reconstruction will be any closer to the high water line than is the existing development. The Pergolas are located behind the line of the existing approved decks Exhibit D (decks were approved in August 1996 — Zoning Official) d. The development does not fall outside of an approved building envelope if one has been designated through a prior review. The Pergolas rest on top of and 4 within the existing approved decks which are within the approved building envelope — Exhibit E, also refer to Exhibits A & C e. The expansion, remodeling or reconstruction will cause no increase to the amount of ground coverage of structures within the 100 -year flood plan. There is no increase to the amount of ground coverage. Basically, if they determine that a Floodplain Development Permit is required, the permit application "..must include detailed results from a hydraulic analysis in accordance with FEMA guidelines..." As I mentioned over the phone, a full floodplain analysis requires extensive survey of river and floodplain cross - sections both upstream and downstream of the property frontage for enough distance to allow the computer model to work properly (generally several hundred feet). Between the survey in the river and the generation of cross sections and construction of the computer model, that effort is typically in the range of $15,000 to $20,000. There is some potential that we would prove the floodplain is less of an issue than the old FEMA maps show but there is also a danger that we'd prove the floodplain and floodways are-worse than we thought. I also looked at the City's Stream Margin review criteria in the Land Use Code. See attached link; http: /lwww. a soenpitkin. co m /Portals /0 /does /City /clerk/m unicode /coasoent26 -400. pdf Section 26.435.040, B. Exemptions, Subsection 3. (pages 74 & 75) lists criteria for a minimal project whereby Stream Margin review and related floodplain permitting might be waived. My understanding is that you need to demonstrate that you meet of of the standards a. through e. to be granted an exemption but I would think, based on what you told me about the work that was done, that you would meet those standards. My recommendation would be to take some good photos of exactly what you did on the deck and set up a meeting with Chris Bendon, the City Comm. Dev. Director and see if he would agree that you would qualify for the exemption standard. Chris is a good and very reasonable guy so I think that would be a good approach. If that doesn't fly, give me a call and we can see if we have any other options short of a full -blown floodplain analysis. Good luck.
