HomeMy WebLinkAboutminutes.council.20110418 Special Meeting Aspen City Council April 18, 2011 Mayor Ireland called the special meeting to order at 5:05 PM with Councilmembers Torre and Kruger present. RESOLUTION #26, SERIES OF 2010 — Contract Rubito Golf School Steve Aitken, golf course, reminded Council this item was continued from the previous Council meeting. One of the questions was possible competition with Aspen Junior Golf. Councilwoman Kruger told Council she has met with staff and with Chuck Torinus and feels comfortable staff put together a great RFP. Councilwoman Kruger said she is concerned the golf course may not have enough facilities and that the school may displace local players. Aitken told Council there are two advisory boards for the golf course; the Aspen Golf Advisory Board, who has given this total support and the Aspen Junior Golf Board who had questions resulting from the last Council meeting. After meeting with staff, they had some proposed language change for the contract. Mayor Ireland asked if there is capacity or will other users be cut out. Aitken said there is area dedicated for teaching and lessons that does not encroach on regular golf play. There have been other improvements that make the driving range much better. Staff intends to keep improving the facility. Councilman Torre said he has met with staff and has been assured this will be appropriate and will not take away from the driving range. Councilwoman Kruger asked about the use of video. Aitken said there is indoor video screening. Councilwoman Kruger said she is concerned whether this meets the independent contractor status and would like to make sure that Rubito is correctly classified. Jeff Woods, parks and recreation, said he will look at it to make sure the lines are not crossed. Mayor Ireland noted the city attorney reviews all contracts before they are presented to Council. Councilwoman Kruger said the there is list of 20 rules about independent contractor status from the IRS. Councilman Torre said these 20 rules can be brought to the city attorney's attention to make sure the city is protected. Councilwoman Kruger said she cannot support this contract as she has heard from people in the community who do not support it. Rick Head, Junior Golf told Council said they are in support of this as it is very symbiotic with the Aspen Junior Golf Program. Councilwoman Kruger said she would prefer the contract be reviewed by the city attorney's office and also to make sure there is a cohesive group of people behind the concept. Councilwoman Kruger said she would like this to be successful. Councilman Torre said he feels this contract is worth moving forward and the city can risk one summer for something that may add to the experience at the golf course. Mayor Ireland moved to approve Resolution #26, Series of 2011 with the stipulation that the city attorney review the role of independent contractor status and only upon the signature of the City Attorney that the city is protected as best as possible; seconded by Councilman Torre. Councilmembers Torre and Mayor Ireland in favor; Councilwoman Kruger opposed. Motion carried. Councilman Torre moved to adjourn at 5:40 PM; seconded by Councilwoman Kryiger.
