Hyman Ave. This qualifies as a subdivision exemption to be approved by the Planning Director pursuant to Ordinance 53, 1993. BACKGROUND: Each half of the duplex is 3,633 s.f. and contains three bedrooms plus a basement level deed restricted accessory dwelling unit. Four parking spaces are provided per duplex half. The building was completed in early 1994. The condominium regulations were amended by final adoption of Ordinance 53, 1993 on November 8, 1993. This code allows the City Planning Director to review and approve condominium applications. The code revisions also remove the requirements for long term residential leases and payment of affordable housing mitigation. However, long term residential use is included in the purpose statement of the R /MF zone district. REFERRALS: Engineering: The plat must contain the following: 1) vicinity map at 1" =400' 2) zoning designations of the subject parcel and surrounding properties 3) location and description of drywells on the site 4) the parcel area described to the nearest .001 acre 5) show actual parking spaces inside and outside of structure 6) show the division line between the two units on sheet 1 7) identify the condominium project west of subject parcel 8) in the legend, the symbols for found and set markers must be different 9) delete signature block for City Council 10) return two sets of mylars to Engineering fully signed by private parties prior to sign -off by Engineering and Planning 11) All material representations made by the applicant in the application shall be adhered to and considered conditions of approval, unless otherwise amended by other conditions. 12) The condominium plat shall be recorded in the office of the Pitkin County Clerk and Recorder within 180 days of its approval by the Planning Director. Failure to do so shall render the plat invalid and a new application and approval will be required. I RECOMMENDATION: Staff recommends approval of the condominiumization of 1031/1033 E. In response to the development application package's Submission Contents for All Development Applications, the information requested for items 1 and 2 in Attachment 1 is provided in the application form herein attached. Item 3, ownership disclosure, and Item 4, a vicinity map, are also attached. Item 5, a written description of the proposal and an explanation of compliance with the relevant review standards described in Attachment 4, is discussed below. The attached planset describes the townhome duplex being constructed. Each unit has three bedrooms plus a deed - restricted, 562 sq. ft. Accessory Dwelling Unit (ADU). The ADU's are required by the RMF zoning code. The ADU's also fulfill the affordable housing impact fee requirement. Each unit has four parking places, one each for each of the three bedrooms and one for the ADU (not required). As there are no existing tenants, the ninety (90) day tenant purchase option requirement does not apply. In response to Attachment 3, Item 1, an improvement survey of the property is attached. Letters (a) and(b) of item 2 are addressed in my response to attachment 2. Regarding Letter (c) of Item 2, the two ADU's provide an opportunity for additional employee housing. I do not perceive the project as impacting the Affordable Housing Program at all. Therefore, APPLICANT agrees that in consideration of the CITY's waiver of its right to collect full fees prior to a determination of application completeness, APPLICANT shall pay an initial deposit in the amount of $1/-3 which is for hours of Planning Office time, and if actual recorded costs exceed the initial deposit, APPLICANT shall pay additional monthly billings to CITY to reimburse the CITY for the processing of the application mentioned above, including post approval review.
