Spring Street to permit the reconstruction of an existing development as allowed per Section 26.435.040 (B) Exemptions. The applicant is requesting an exemption from Stream Margin Review to reconstruct an existing landscape terrace and pathway. A property may be available for a Stream Margin Review Exemption if the proposed development: 1) does not add more than ten percent (10 %) to the floor area of the existing structure or increase the amount of building area exempt from floor area calculations by more than twenty -five percent (cumulatively over time); and, 2) the development does not require the removal of any tree for which a permit would be required; and, 3) the development is located such that no portion of the expansion, remodeling, or reconstruction will be any closer to the high water line than the existing development; and 4) the development does not fall outside of an approved building envelope if one has been designated through a prior review; and 5) the expansion, remodeling or reconstruction will cause no increase to the amount of ground coverage of structures within the 100 -year flood plain. SUMMARY: Per the application, the request is to receive Stream Margin Exemption for the reconstruction of a walkway and patio (Exhibit A). This request is the result of a correction notice dated September 2, 2011. The Applicant has provided photographic evidence that the improvements have been in existence, either as flagstone or wood, since the 1980s (Exhibit D). The current improvements appear to be in the same footprint of the existing improvements and are constructed of cement and flagstone (Exhibit B). STAFF EVALUATION: Pursuant to Chapter 26.435.040 (B)(3), Exemptions, of the City of Aspen Land Use Code, Staff finds the request meets the standards of a Stream Margin Exemption as noted previously. The reconstruction of the walkway and patio do not appear to increase the previously existing footprint of said improvements and does not require the removal of a tree. Due to the age of the residence, there is no record that the property has ever gone through Stream Margin Review, other than for an exemption to replace an accessory structure; however, based on the age of the photographic evidence, staff has determined that these improvement were legally established. All stream margin exemptions are cumulative. Once a development reaches these totals, a stream margin review by the Planning and Zoning Commission is required; and Staff Response: The proposed improvements will not add to the floor area or areas exempt from floor area as the existing improvements are being refurbished and not expanded. Staff finds this criterion met. b. The development does not require the removal of any tree for which a permit would be required pursuant to Chapter 13.20 of this Code.
