MEMORANDUM TO: Aspen Planning and Zoning Commission FROM: Colette Penne, Planning Office RE: Rolles Residence - Stream Margin Review DATE: June 7, 1983 Location: Lot 14, Black Birch Estates. Zoning: R -15 PUD. Applicant's Request: Approval to build a residence within 100 feet of the high water line of the Roaring Fork River. Referral Comments: The Environmental Health Department recognizes no adverse environmental impacts as a result of approval of this submittal. The City Attorney's Office had no comment. The Engineering Department had the following comment: "As mentioned in the letter of application and shown on the site plan, the proposed structure protrudes substantially into the floodplain in addition to proposing significant amounts of fill. Under Municiple Code Section 24 -6.3, no building is to be located within a flood hazard area. Review of the Corps of Engineers' flood hazard study undertaken in 1973 indicates that the floodplain line shown on the site plan to be fairly correct. The comment in the application that 'the flow is already determined by the adjacent dwellings' is inaccurate in that the location of the adjacent structures in the floodplain will not cause the flow to circumvent the proposed house and may in fact have aggravated the flood situation on Lot 14. The strong possibility that the adjacent houses are already located within the flood hazard area is not any justification for locating the Rolles home in the same fashion and therefore we recommend denial of the application." Planning Office Review: The intention of Stream Margin Review as per Section 24 -6.3 of the Municipal Code is "to guide the develop- ment and encourage appropriate use of land in proximity to designated natural water courses, to promote safety from flooding, to prevent impediment of natural water flow, and to ensure provisions for adequate protection and preservation of the designated natural water courses as important natural features." Six criteria are outlined to be used as guidelines and standards for review of a development plan. These criteria are as follows: 1. No building shall be located so as to be within a flood hazard area designated by the U. S. Corps of Engineers Flood Plain Report for the Roaring Fork River. Memo: Rolles Page Two June 7, 1983 2. In the event there is a trail designated by an approved trail plan within the development site, such trail shall be dedicated for public use. 3. All attempts should be made to implement the recommendations of the Roaring Fork Greenway Plan. 4. Vegetation shall not be removed nor any slope grade changes made that may produce erosion of the stream bank. 5. There shall be permitted no changes to the stream channel or its capacity, and no activity shall be allowed which will increase stream sedimentation and suspension loads. 6. All efforts must be made to reduce stream pollution and interference with the natural changes of the stream, and to enhance the value of the stream as an important natural feature. Location of this structure as proposed would violate some of the review criteria. The most important inconsistency of this application with these criteria is the code provision disallowing the location of structures within a flood hazard area as designated by the U. S. Corps of Engineers Flood Plain Report for the Roaring Fork River. Even though the houses on the adjacent properties are located in the hazard area also, placement of additional building mass in a flood plain would exacerbate an already unfortunate situation. In the event of a flood that extends to the floodplain line, the effect of a structure in the way will be to alter the flood zone. Vegetation has already been removed from the site and the proposed fill for the construction of the house would be an erosion producer in the event of a flood. Basically, the building lot has more than adequate space to move this proposed structure back out of the flood plain. The fill activity proposed can still be accomplished to afford a view from the house of the river. Planning Office Recommendation: The Planning Office recommends denial of the Stream Margin Review application for the Rolles residence to be constructed in the flood plain.
