MEMORANDUM TO: Aspen Planning and Zoning Commission FROM: Colette Penne, Planning Office RE: Howard Stream Margin Review DATE: June 21, 1983 Location: Lot 7, Block 1, Red Butte Subdivision. Zoning: R -30. Applicant's Request: Approval to construct a house within 100 feet of the high water line of the Roaring Fork River. Referral Comments: The Environmental Health Department could recognize no adverse environmental impacts as a result of approval of this submittal. The Engineering Department made a site inspection with the architect and determined that they have no problems with this stream margin application. "While the application fails to show the 100 year floodplain, it would appear from the Corps of Engineers mapping that the flood hazard zone does not reach over the high bank adjacent to the river at this location." No comments were received from the Building Department or the City Attorney. Planning Office Review: The Planning Office also made a site inspection and the 8 to 10 foot drop at the edge of the property to the river appears to negate any flood danger. As the Engineering Department stated, the Corps of Engineers mapping indicated that the flood hazard zone did not reach over this bank. In terms of the review criteria in Section 24 -6.3 of the Municipal Code for Stream Margin Review, the following observations are made: "(1) No building shall be located so as to be within a flood hazard area designated by the U.S. Corps of Engineers Flood Plain Report for the Roaring Fork River." As discussed above, this building site is outside the flood hazard area. "(2) In the event there is a trail designated by an approved trail plan within the development site, such trail shall be dedicated for public use." In this case, the trail in this location is the Rio Grande trail on the opposite side of the river. "(3) All attempts should be made to implement the recommendations of the Roaring Fork Greenway Plan prepared by the Roaring Fork Greenway Committee." This property is not affected by the Greenway Plan. Memo: Howard Stream Margin Review Page Two June 21, 1983 "(4) Vegetation shall not be removed nor any slope grade changes made that may produce erosion of the stream bank." The lot is large, very flat, and no slope grade changes will be necessary to allow construction. Existing vegetation will not be removed. "(5) There shall be permitted no changes to the stream channel or its capacity, and no activity shall be allowed which will increase stream sedimentation and suspension loads." Again, the building site is flat, set back from the stream bank approximately 20 feet and the bank itself is a 10 foot drop from the edge of the lot. No grading will be required, therefore, no sedimentation or channel effects will result from this construction. "(6) All efforts must be made to reduce stream pollution and interference with the natural changes of the stream, and to enhance the value of the stream as an important natural feature." There should be no negative effects on the Roaring Fork as a result of this project. Planning Office Recommendation: The Planning Office recommends approval of this stream margin review for the Howard residence on Lot 7, Block 1, Red Butte Subdivision. While the application fails to show the 100 year floodplain, it would appear from the Corps of Engineers mapping that the flood hazard zone does not reach over the high bank adjacent to the river at this location.
