SUMMARY:
Robert and Paige Zangrillo, Applicants, are requesting a Stream Margin Review
to remove a culvert and to plant native vegetation between the top of slope and
the Roaring Fork River's high water line on their property at 1419 Crystal Lake
Road.
Land Use Code Section 26.435.040(A), Environmentally Sensitive Area, states
that the "provisions of the Stream Margin Review shall apply to all development
within one hundred (100) feet, measured horizontally, from the high water line
of the Roaring Fork River and its tributary streams, and to all development
within the Flood Hazard Area, also known as the 100 -year flood plain."
Primier Green, LLC, of Lafayette, Colorado, graded, removed native vegetation,
and installed the culvert without approval for development in the City of Aspen's
stream margin.
This application includes a landscape plan to re- vegetate the stream margin
with native vegetation approved by City Forester Stephen Ellsperman. It also
includes a letter from Paige Zangrillo to remove the culvert.
RECOMMENDATION:
Staff has reviewed this Stream Margin Review and recommends administrative
approval by the Director, with conditions.

Insubstantial amendments to an approved Stream Margin Review may be
approved by the Community Development Director, pursuant to Section
26.435.040(B).
APPROVAL:
I hereby approve this Stream Margin Review for 1419 Crystal Lake Road with
the following conditions:
1. The City of Aspen Forester shall approve all landscaping in the Stream
Margin, as described herein, prior to the issuance of a Certificate of
Occupancy.
2. The City of Aspen Water Department shall approve the ditch dimension and

Dear Nick:
After meeting with you and Phil Overeynder this morning it appears that the culvert will
have to be removed. We are prepared to take it out starting today and Jim Baker at
Premier Green tells me that it should take one full day to completely remove. We will
also replant the area according to the plan you currently have from Premier Green. We
will add a small bridge over the ditch at a later date. The ditch removal is effective
immediately as per your verbal approval. Please let me also in writing that we are all on
the same program. I apologize for the inconvenience.

Dear Mr. Zangrillo:
In response to your request, this letter shall serve notice to you that the City of
Aspen, which holds 1 /7th interest in the ditch, will not sign off on a culvert on your
property.
It is also to notify you that a complete Stream Margin review application, without
the culvert, must be submitted to the City of Aspen's Comniunity Development
Department by November 3, 2000.
Failure to submit the complete application will result in the City's taking legal
action regarding the Land Use Code violation for development in the Stream Margin
without required approval.
The culvert shall be removed on or before November 24, 2000. In addition, a
Certificate of Occupancy will not be issued for your property until a Stream Margin
Review is approved and the landscape plan implemented.
The City of Aspen's Community Development Department has made every effort to
work with you and your representatives about repairing the severely damaged
riparian area along your property as a result of the illegal culvert installation.
Specifically, this Department has agreed to expedite the Stream Margin Review
process, waive some of the required application materials, and pent time working
with Primier Green to help them better understand the City's review processes. and
requirements for development in environmentally sensitive areas, as well as what
materials need to be included in the landscape plan. -
The City of Aspen's Water Department Director, Phil Overeynder, cited several
reasons why the City will not permit the ditch to be culverted.
1. The City holds a 1 /7th interest in the ditch. Any approval granted by the
City must be necessarily felt concurrence from the other ditch owners. There
is no formal ditch association in place although efforts are underway to set up -
a more permanent structure for such issues.
2. Riverside Ditch holders have been plagued with complaints of nuisance
flooding and operational problems over the last couple of years. In response to
these the ditch holders collectively hired Enartech Engineers in 1999 to study
what factors were contributing to these complaints. Enartech identified a
number of specific problems, most of which centered on the available

hydraulic gradient in the ditch section from the headgate to the inverted
culvert crossing at Highway 82 (Cooper Ave.). This includes the ditch section
on the Zangrillo property that was modified without permission of the ditch
right holders. Remedial action is necessary to address many of these
situations and any further reduction in the available hydraulic gradient will
further exacerbate the existing problems.
3. The culvert section will reduce the available hydraulic head in the section
that Enartech identified as grade critical and will contribute to future
flooding and maintenance problems associated with ditch operations.
4. The grates installed along with the culvert also cause head loss and are
subject to clogging, adding additional maintenance problems.
5. The section where the culvert is installed periodically floods as a result of
high water in the river. Clogged grates during flooding can cause the entire
ditch to fail when excessive flood water enters the ditch. Control would be
lost over the amount of water going into the ditch.
6. Enartech Engineers propose the installation of a overflow return device just
above the first culverted section of ditch to address problems described in
item 5 above. The culvert installation on the Zangrillo property interferes
with this design and is located at a point on the ditch above the first location
where such a device could function effectively. Modification of the culvert
installed on the Zangrilo property to accommodate this function is therefore
not an option.
These decisions may be appealed to City Council. The Community Development
Department must be notified in writing of an appeal no later than November 8,
2000.
