At that time, you indicated that a different plan was being contemplated and thus, we agreed to withdraw this item from pending Planning Commission agendas. Included are an application fee check for $1,035.00, a Land Use Application Form, plans for the work including material specifications and exhibits relevant to the various submission contents requirements of the Stream Margin process. I would stress our intention not to disturb the larger vegetation and existing boulders along the embankment at the Chateau Eau Claire but only to "fill in the gaps" with stable material where erosion has occurred. This work will not alter the river channel configuration nor will it alter the floodplain conditions in the area which, theoretically, impact the Chateau Eau Claire condominium building at this time. Our goal, at the direction of the condominium owners association, It to stabilize the embankment from further erosion, particularly along the north end of the building frontage where the smaller gravels have eroded most consistently. Title to said parcels is subject to the easements, restrictions, patents, ditches, rights of way of record and subject to the reser- vations and other provisions of this Declaration. • ` 1 CHATEAU EAU CLAIRE Stream Margin Application Submission Contents Requirements Exhibit E Project Description This description is structured in response to the Review Standards of Attachment 4 of the City of Aspen Stream Margin Development Application Package. The Chateau Eau Claire is an existing 29 unit condominium structure located at 1034 East Cooper Avenue in Aspen. The building was constructed in the 1960's and is located very close to the Roaring Fork River embankment. The condominium owners association has retained Schmueser Gordon Meyer Engineers to provide a bank stabilization plan to prevent further erosion of the existing embankment. It is not the intention of this design or project to alter the river channel or floodway from its existing configuration, it is our intention to prevent further erosion and degradation of the river embankment. 1. The project plans, Exhibit "D ", reflect the 100 -year flood hazard boundary based on site - specific river corridor cross - sections and flows taken from the Federal Emergency Management Agency's (FEMA) flood hazard study of June 4, 1987. As shown in the 'Typical Bank Section ", the bank stabilization project will entail excavating the embankment in areas where rip -rap is to be placed such that the final grade of the rip -rap will match the existing embankment surface grade. There will therefore be no change to the base flood elevation as a result of this work. 2. The Pedestrian Walkway and Bikeway System Plan for the City of Aspen dated September 24, 1990, does show a pedestrian trail along the river corridor in the area of the Chateau Eau Claire, although specific routing is unclear. The proximity of the Chateau Eau Claire building to the top of the existing embankment as well as the steep and narrow nature of the embankment itself render trail placement along the westerly river bank infeasible in our opinion. There is, however, space available along the east embankment in Freddie Fisher Park that was dedicated to the City by the Chateau Eau Claire some time ago. The City, therefore, already controls the logical alignment of a river trail in this vicinity at this time. 3. The Roaring Fork Greenway Plan will be accommodated by the project construction in several ways; The contractor will be required to avoid all of the larger existing trees and vegetation, as well as the existing river boulders which meet or exceed the size requirements of the rip -rap material, thus minimizing the visual disturbance of the river embankment. Rock for use in the rip -rap areas will be selected in matching and compatible colors to the existing embankment materials. Revegetation of the embankment areas of the work will be undertaken by the owners association subsequent to the stabilization work utilizing riparian plants as recommended by the Greenway plan (this work will not be the responsibility of the stabilization contractor). SCHMUESER GORDON MEYER, INC teak t t August 20, 1993 Chateau Eau Claire Page 2 The stabilization work is intended to proceed this Fall when river flows are at a minimum and siltation impacts are minimized. Excavated material will be removed in a manner that keeps impacts low. Placement of the rock will serve to reduce the potential for further erosion to impact downstream water quality. 4. As noted above, all larger vegetation (trees and brush) will be maintained to help stabilize the embankment. Some minor (and in many cases non - native) grasses may be removed to accommodate rock placement but revegetation will be done in keeping with the Greenway recommendations. The stabilized embankment will produce less erosion and sedimentation of the river than has been the case historically. 5. This project will result in minimal sediment during construction and should result in less sedimentation pollution to the river once completed. 6. No alteration of the water course will be caused by this work. 7. No alteration of the water course will be caused by this work. 8. This project is proceeding under the conditions of the U.S. Army Corps of Engineers Regional General Permit Number GP 037 which allows bank stabilization work without 404 permitting when projects entail less than 1,000 linear feet of embankment and less than 2 cubic yards of material below the high water line per running foot of the embankment. This project meets the Regional General Permit criteria and we will therefore be notifying the Army Corps but will not require a permit from them. Prior to construction, the applicant shall submit a revised stream margin development plan for City approval showing the tollowing: a. The mean high water, floodway and 100 -year floodplain lines (These must he shown for both sides of the river if the construction access is intended to he from across the river.); h. The construction access plan since this access is a stream margin issue (Access easements must he provided to the Engineering Department prior to construction.); c. Right -of -way boundary of Riverside Avenue and other boundary and ownership information as necessary to document the construction access; d. The existing vegetation by size and species in the work area, the vegetation intended to he removed, and the replacement vegetation; e. The location and labelling of Freddy Fisher Park, if it is located within the drawing coverage, and the location of the proposed river trail discussed in the application; f. Relabelled topographic lines with USGS mean sea level elevations; and g. Documentation of the flow velocities for which Type 1-1 rip rap is intended and the tlow velocities of the Roaring Fork River in 100 year flood conditions. 2. Prior to construction, the applicant shall submit the construction hid package, which .- shall include construction techniques and methods, construction specifications, signed and stamped by an engineer registered to practice in the State of Colorado, to the City for approval, together with cost estimates for all phases of the work including vegetation restoration together with the proposed construction schedule, including vegetation restoration. Financial assurances shall he provided to the City for the estimated cost of the work including cost of vegetation restoration. 3. Also prior to construction, the development plan, construction techniques and methods, construction specifications, and cost estimates shall he submitted to the Army Corps of Engineers for written approval, a copy of which approval shall he provided to the City prior to construction. There may be wetlands and Division of Wildlife concerns not addressed in the Regional General Permit. 4. The applicant shall provide construction management of the project by a registered engineer in order to ensure compliance with the development plan, and at the completion of construction, shall provide written certification by construction manager that the project was constructed as designed, including but not limited to certification of the sizing of the Type 1 rip rap and certification of amount of material removed and amount of material placed, including calculations for the void spaces in the rip rap. 5. The applicant is requested to grant a fisherman's easement. 6. Note that the 6" tree removal permit basically pertains to vegetation on private property and that an "excavation permit" must he obtained for any work in the public right -of -way.
