DATE: July 29, 1976 This is a request for stream margin review by Greg Cole for a single family house located on Lot 1, Sneaky Lane Subdivision. The application is made pursuant to Section 24 -6.3 of the City of Aspen Zoning Code which requires a Planning and Zoning Commission finding of compliance with certain Stream Margin Review criteria. The Planning Office has reviewed the application and previously visited the building site. Our comments are as follows: 1. The building site is not located in the 100 year floodplain as determined by the Corps of Engineers Floodplain Study. 2. A trail easement exists on the property. 3. The building site is 75 feet from the stream side therefore minimizing disturbance to the reparian zone of Castle Creek. 4. No stream chanelization is involved in this construction. Mr. Hal Clark Gregory Cole Land Use Administrator Box 11209 Aspen /Pitkin Planning Department Aspen, CO 81611 Aspen, CO 81611 July 27, 1976 Dear Hal, Having reviewed the stream margin review criteria for the City of Aspen I feel confident that the plans I have submitted for building permit on Lot 1 Sneaky Lane Subdivision comply fully with the review criteria. Included are notes regarding each of the criteria. 1. Flood Plane The building is located a full 50' from the highest level shown in the Corps of Engineers Flood Plane Study. 2. Trail Easements A stream front trail easement has been provided in the original subdivision of 1972. 3. Greenway Plan The house is set back a full 75' from the highwater line of Castle Creek providing adequate greenway setback. This area has been set aside by covenants so that no buildings may ever be built within the 75' setback. 4. Vegetation /Slope 1) The building is being placed in an existing meadow thereby minimizing vegetation removal. 2) The lot is virtually flat and the only excavation will be for the slab - this provides minimum disturbance to the existing grades. 5. Stream Channel The channel will not be disturbed. Mr. Hal Clark Page 2 July 27, 1976 6. Stream Pollution /Aesthetics The 75' setback provides adequate buffer for any possible stream pollution and an appropriate aesthetic barrier. I feel the above compliance to stream margin review criteria provides adequate evidence that approval should be given for building permit on this site.
