Planner Glenn Horn The Planning Commission granted the applicant a Stream Margin Review to construct a deck near the Roaring Fork River condition- ed upon the applicant agreeing that excavation material will not be deposited in the river. The City council granted the applicant a Plat amendment for the deck construction. MEMORANDUM TO: Aspen City Council /n� �nn FROM: Glenn Horn, Assistant Planning Director P " THRU: Robert Anderson, City Manager RE: Farver Plat Amendment DATE: October 7, 1987 SUMMARY & RECOMMENDATION Joan Farver is requesting permission to amend the Callahan Subdivision Condominium Plat for the purposes of expanding the deck on her condominium. The Planning Office and the Planning and Zoning Commission recommend approval. BACKGROUND Applicant - Joan Farver Applicants Representative - Bruce Sutherland Location - 1425 Crystal Lake Road Applicant's Request - The applicant is requesting a subdivision exception for a plat amendment for the purposes of expanding a deck on her Aspen Club condominium unit. REFERRAL COMMENTS Engineering Department - Prior to recording, the applicant must submit an amended plat for the Callahan Subdivision pursuant to section 20 -21 of the Municipal Code. PLANNING OFFICE REVIEW Section 20 -19 establishes criteria for a subdivision exception for minor amendments to a plat such as the one proposed by the applicant. The Planning and Zoning Commission granted the applicant stream margin review approval in August and recommended that you approve the plat amendment associated with the stream margin review approval. Section 20 -19 of the code states that the City Council may grant a subdivision exception when it is determined by the City Council that it does not make sense for an applicant to be required to be subject to the entire subdivision process. We consider the deck expansion requested by the applicant to be very minor and do not believe that it would serve the public purpose to require the strict adherence to the entire subdivision process. ADVISORY RECOMMENDATION The Planning and Zoning Commission recommends approval of the requested plat amendment. PLANNING OFFICE RECOMMENDATION The Planning Office recommends approval of a subdivision exce- ption for the purposes of a plat amendment to the Callahan subdivision Plat subject to the condition that the applicant prepare an amended plat which meets the satisfaction of the City Engineer. If you concur with the Staff recommendation the appropriate motion is: "I move to approve the Farver plat amendment to the Callahan Subdivision plat subject to the condition recommended by the Staff." Farver /gh 1 MEMORANDUM TO: Aspen Planning and Zoning Commission FROM: Glenn Horn, Assistant Planning Director RE: Farver Stream Margin Review/ Plat Amendment DATE: August 12, 1987 BACKGROUND Applicant - Joan Farver Applicants Representative - Bruce Sutherland Location - 1425 Crystal Lake Road Applicant's Request - The applicant is requesting stream margin review approval and subdivision exception for a plat amendment for the purposes of expanding the balcony /deck on her Aspen Club Condominium unit. REFERRAL COMMENTS Engineering Department - The proposed deck expansion is within 100 feet of the high water line, but it is not within the special flood hazard area. Therefore, review criteria pertaining to development within the special flood hazard area does not apply in this situation. It is recommended that special care be taken during construction not to deposit any excavated material in the river. PLANNING OFFICE REVIEW Section 24 -6.3 of the Municipal Code establishes review criteria for stream margin reviews. Each of the criteria are listed below and used to evaluate the application. 1. Criteria - No development shall occur within a special flood hazard area unless it can be demonstrated that there will be no increase in base flood elevation as a result of the development, as shown by an elevation certificate prepared by a professional engineer registered to practice in the State of Colorado. Review - As noted by the City Engineer above, the proposed development is not within a special flood hazard area. 2. Criteria - In the event there is a trail designated by an approved trail plan within the development site, such trail shall be dedicated for public use. Review - A trail contiguous to this property has already been dedicated for public use. 3. Criteria - All attempts should be made to implement the recommendations of the Roaring Fork Greenway Plan prepared by the Roaring Fork Greenway Committee. Review - This application does not affect the Roaring Fork Greenway Plan. 4. Criteria - Vegetation shall not be removed nor any slope grade changes made that may produce erosion of the stream bank. Review - Vegetation shall not be removed from the stream bank. 5. Criteria - All efforts shall be made to reduce pollu- tion and interference with the natural changes of the river, stream or other water course, and to enhance the value thereof as an important natural feature. Review - As noted by the City Engineer the applicant should commit not to allow dirt form the construction to go in the river. 6. Criteria - Written notice shall be given to the Colorado Water Conservation Board prior to any altera- tion or relocation of the water course, and a copy of said notice shall be submitted to the Federal Emergency Management Agency. Review - The water course of the river will not be altered. 7. Criteria - In the event a water course shall be altered or relocated, the applicant and applicant's heirs, successors and assigns shall provide maintenance to assure that the flood carrying capacity is not dimi- nished. Review - The water course shall not be altered. 8. Criteria - Copies shall be submitted of all necessary federal and state permits relating to work within the one hundred year floodplain 2 Review - According to the City Engineer permits for work in the floodplain are not required. Section 20 -19 establishes criteria for minor plat amendments. The Farver application for a minor plat amendment is consistent with the criteria in this section because the granting of the exception will not be detrimental to the public welfare or injurious to property in the area in which the property is situated. RECOMMENDATION The Planning Office recommends approval of the Farver Stream Margin Review and recommends that the Planning and Zoning Commission recommend to City Council approval of the subdivision exception request for the minor plat amendment. It is recommended that the Stream Margin approval be conditioned upon the applicants commitment that excavation material will not be deposited in the river. The submitted site plan has all of the required information. 2. The submitted site plan indicates that while the development is within 100 feet of the high water line, it is not within the special flood hazard area. Therefore review criteria pertaining to development within the special flood hazard area does not apply in this situation. 3. The proposed balcony deck expansion is not in the flood plain and it is 18.59 feet above the 100 year flood plain high water line. As shown on the site plan, the deck will be 46.5 feet horizontally from the 100 year flood plain and the lower deck will be at elevation 7996.09 feet. The elevation of the 100 year flood plain water level at right angles to the deck is 7979.5. The deck will be constructed on piers and will not alter any existing vegetation. I talked to Jim Gibbard in the City Engineering Department and he agreed this is the proper procedure. Regarding the application for an exemption from mandatory PUD, I talked to Steve Burstein and he stated there is not a formal procedure to follow; that we need only to request in writing an exemption. Please consider this letter a formal request for an exemption from a mandatory PUD. We reviewed the criteria in Section 24 -6.3 of the City Code with Jay Hammond for a similar deck expansion at the Aspen Club Condominiums and the items we included in our letter of June 5, 1987 satisfied his requirements.
