The first condition is that the application for the original dwelling unit was made in September 1971 prior to the adoption of the Corp. of Engineers Flood Plain Study and the inclusion of the City of Aspen within the flood hazard insurance program. The second item is that the project was considered for stream margin review in July 1971 by the Planning and Zoning Commission and received approval subject to certain conditions which appear to have been met. Finally, as one of the conditions of approval the owner submitted a letter to the City of Aspen holding the City harmless for any damage resulting from natural flooding. Copies of the original building permit, the Planning and Zoning Commission minutes of approval, and the letter are attached. Considering these prior approvals and the fact that the proposed addition would be roughly only 15% of the existing structure, the engineering department does not feel further review is warranted. The original structure, as well as the modified structure, would qualify under the grandfather clause of the flood hazard insurance program. We would recommend that all of the attached documentation be made a part of any approval for the proposed additions and that the owner, not the builder, be required to acknowledge the letter regarding liability. jk enc. M. with James • Adams, James Breasted, Vic Goodhard and Anthos Jordan. Also present City/ County Planner Herb Bartel. Minutes Breasted moved to approve the minutes of July 6th with the correction of Rubey Park in the index column be changed to parking. Seconded by Jordan. All in favor, motion carried. Charles Collins a teed 1 Charles Worth, Charles Worth, Stream Margin - Request for Lot 16, Black Stream Margin Birch Estates - Chairman Molny read the motion made on the Reguest - Lot 16 last request for Lot 12. Mr. Bartel explained he and Black Birch Clayton Meyring, Building Inspector, had reviewed the siL Estates this date and lot is situated similarly to the one prev- ' iously approved with an increase in elevation of about 8' } and across from Lot 12. Mr. Bartel further reported the Corp of Engineers will be in Aspen shortly to establish th program for the flood plain study. Suggest the Board set a tine limit on approval as by the next building season, the • flood plain study may have been completed. Adams moved that the Commission approve this site as a buildable site, however, approval runs through only the current building season and recommend to the Building In- spector to seriously consider requiring that the building on Lot 16 be set back sufficiently from the edge of the present course of the stream and that the buildings on thi lot be built in such a way to protect from flooding, i. e. • no basements, lower floors be elevated etc., set on piling of some sort and that there be an agreement in writing promoted by Mr. Worth with the owner of this lot and futur • owners that the City will not be held responsible for flooding. Seconded by Collins. All in favor, motion carrie Red Butte East Red Butte East Subdivision - Final Plat was submitted. Mr. Subdivision Bartel informed the Commission the City Engineer has commented the final plat is okay; checked on the deed as to restrictions which does not allow for cluster develop- , ment (one acre sites). Hutchison Estate, owner MEMORANDUM TO: Aspen Planning and Zoning Commission FROM: Planning Office, Richard Grice RE: Hamwi Stream Margin Review DATE: February 14, 1979 We have a request for a stream margin review for an addition to be added to the house located on Lot 16, Black Birch Estates. Dave Ellis, City Engineer, has reviewed this application and his extensive comments are attached. He recommends that you approve the stream margin review with the condition that his memorandum to myself of February 9, 1979, the original building permit issued to Burton Eggan, the minutes to the Planning and Zoning Commission meeting of July 20, 1971 and the letter written by Burton Eggan on August 24, 1971 which releases the City of Aspen from all responsibility for future flooding, be made a part of the record of this stream margin review. In addition, Dave suggests that the owner of this property be required to acknowledge the letter regarding liability.
