Section 7 -504, Stream Margin Review, of the Aspen Municipal Code requires development review of proposals within the Special Flood Hazard Area. The closet and shower addition is within the Special Flood Hazard Area thus requiring Stream Margin Review. The proposed deck is outside of the Special Flood Hazard Area and more than 100 feet from the high water line of the Roaring Fork River. APPLICANT: Kathleen D. Smith, represented by Michael Gassman. LOCATION: Lot 15 Black Birch Estates, 1150 River Drive, City of Aspen ZONING: R -30 APPLICANT'S REQUEST: Stream Margin Review approval for the construction of a closet and shower addition onto an existing single family home. REFERRAL COMMENTS: Engineering: In a memo dated April 20, 1989 Jim Gibbard of the Engineering Department had the following comments: 1. The high water line needs to be drawn and labeled on the submitted plan. 2. We recommend that the 5" birch tree on the north side of the development be relocated rather than replaced. 3. We recommend that the applicant grant a fisherman's easement in the Roaring Fork River and for a width of 5 feet along the west side of the river. No other referral comments have been received by the Planning Office. STAFF COMMENTS: Section 7 -50 outlines the criteria for Stream Margin Review as follows: 1. (Debbie please fill in from standards) RESPONSE: The lowest point of the closet addition is at least 8 feet above the flood elevation. It is supported on 2 small columns which will have no effect on the base flood elevation. An elevation certificate and a letter from Schmueser Gordon Meyer, Inc., consulting engineers, are attached. 2. RESPONSE: No designated trail crosses the subject parcel. The Rio Grande Trail, a paved, maintained trail is directly across the Roaring Fork River. 3. RESPONSE: The Roaring Fork Greenway Plan makes no specific recommendations which affect this parcel. No construction will be closer to the river than the existing house. However a fisherman's easement is recommended in support of the Greenway Plan. 4. RESPONSE: No vegetation will be removed from the stream bank and no slope or grade changes will be made to the stream bank. Construction activities and minimal grading will be at least 35 feet from the stream bank. The proposal will have no effect on erosion or sedimentation of the bank. Although the applicant is not required to obtain a tree removal permit for removing the 5" caliper birch tree, we encourage the applicant to attempt to relocate the tree rather than replace it. Section 7 -507 (C) (2) (d) of the Aspen Land Use regulations, recently amended by ordinance 6, requires a description of proposed construction techniques to be submitted with the application. When submitting her application the applicant did not have a chance to comply with these recent code amendments. However the proposed addition is small and setback from the river bank on a flat portion of the site, therefore sedimentation and erosion is not a concern. 5. RESPONSE: See standard 4. This proposal will have no effect on pollution or on natural changes of the river. 6. RESPONSE: No notice is required since this proposal will not alter or relocate a water course. 7. RESPONSE: No guarantee is required since this proposal will not alter or relocate a water course. 8. 2 RESPONSE: No further Federal or State permits are required. RECOMMENDATION: The Planning Office recommends that the Planning and Zoning Commission approve the Stream Margin Review subject to the following conditions: 1. The high water line be drawn and labeled on the submitted plan subject to approval by the Engineering Department. 2. The 5" caliper birch tree be relocated. 3. The applicant shall dedicate a fisherman's easement in the Roaring Fork River and for a width of 5 feet along the west side of the river. 111 pzsmith 3 th ... .'... .2 I I • k0 0 / t ? .
