The applicant is requesting an extended Temporary Use Permit, pursuant to Land Use Code Chapter 26.450, Temporary and Seasonal Uses. SUMMARY: The Applicant has requested a Temporary Use Permit to erect a cellular tower that would serve area AT&T customers from January 17th — 30th The intent is to provide additional service for the temporary increase in population during the duration of the X-Games event. The temporary trailer and tower (Cell on Wheels, aka COW) will be located in the parking lot of the Maroon Creek Club. The COW will measure 14'5" in height. The top of the telescopic mast will measure 60' in height, with two antennas mounted on a telescopic mast at approximately 51' and 57', respectively. Temporary chain link fencing will be erected around the COW, comprising an area approximately 20'x45'. A sled mounted auxiliary fuel tank with spill containment and a portable generator will be located inside the temporary fencing. The COW will be located on the Maroon Creek Club rear parking lot, occupying approximately three parking spaces. This temporary facility will be in operation 24 hours a day during the requested days of use, save for January 30th, when the COW will be disassembled and removed from the property. STAFF EVALUATION: Pursuant to Chapter 26.450, Temporary and Seasonal Uses, of the City of Aspen Land Use Code, the request has been examined in terms of Section 26.450.030, Criteria applicable to all temporary uses. Staff finds that the request of the tower is acceptable due to the limited use of the golf course parking lot during the winter season, and its minimal impact on the operation of the golf course and visual impacts on the surrounding area. The proposed use will have no significant impact on traffic, municipal services, or noise levels. The proposed temporary use will have no foreseeable negative impacts on the general public health, safety or welfare, and will provide additional services to the general public. pg. 1 The applicant has provided verification from the property owner granting permission to operate, and a determination of no hazard to air navigation from the Federal Aviation Administration. The operation may begin on the approved date. DECISION: The Community Development Director finds the request for a temporary cellular tower and accompanying trailer to be erected at 10 Club Circle as noted above and APPLin Exhibit `A' is consistent with the review criteria (Exhibit A) and thereby, ES the exemption as specified below. Criteria applicable to all temporary uses. When considering a development application for a temporary use or an insubstantial temporary use, the Community Development Director or City Council shall consider, among other pertinent factors, the following criteria as they or any of them, relate thereto: A. The location, size, design, operating characteristics and visual impacts of the proposed use. AT&T proposes to locate their Cell on Wheels (COW) unit on Lot 51 of the Maroon Creek Subdivision, 10 Club Circle, in Aspen, Colorado. The COW will be located in the Maroon Creek Club parking lot. The proposed temporary use is on the Maroon Creek Club golf course, adjacent to nearby multi-family residences. However, the COW unit will not interfere with the residences, or the ability of users to interact with the golf course lands. E. The purposes and intent of the zone district in which the temporary use is proposed. The zone district where the temporary use is proposed is known as Public (PUB), with Specially Planned Area (SPA) and Planned Unit Development (PUD) overlays. The purpose of the Public zone district is to provide for the development of governmental, quasi-governmental and nonprofit facilities for cultural, educational, civic and other nonprofit purposes. The intent of this specific area is to be used for public recreational purposes G. How the proposed temporary use will enhance or diminish the general public health, safety or welfare. There is no foreseeable diminution of general public health, safety or welfare associated with this temporary use. Based on initial review,there does not appear to be any concern with the installation of this 60 foot structure assuming the FAA Notice of Proposed Construction process is adhered to. The tower is approximately 120 feet higher than the current end of runway but a significant distance from the airfield. As has been customary with the Winter X-Games,we expect more structures of similar height will be installed in this vicinity. If you have any questions feel free to give me a call. TYPE OF APPLICATION: Temporary Use DESCRIPTION: Pinnacle Consulting, in conjunction with the AT&T and the Maroon Creek Club, are proposing to temporarily locate a trailer and tower in the parking lot of the Maroon Creek Club.The trailer and tower would be in place from January 17th 2012 until January30th 2011. Currently the there are two cellular towers which serve the AT&T customers in the Aspen Area. The proposed temporary trailer and tower would serve the AT&T customers for the duration of the X-Games. The added demand for both voice and data service is due to the increase in population during the games. The proposed schedule would be as follows: set up January 17, 2012, duration of the event January 26 unit January 29th and breakdown January 30th,2012. If approved the proposed trailer and tower would also require a building permit and an electrical permit. Items required for the building permit include but are not limited to: site plan, survey, HOA approval, and structural information. The size of the trailer is 30'x 30. The tower requires stabilization wires and the proposed height of the tower is 60'. The electricity will be provided by a generator. Contact information will be posted on the outside of the trailer in case of emergency. Temporary uses may be granted by the Community Development Director for seven (7) days, with the ability to request one 7 day extension. Staff recommends that the applicant request an extension as part of the temporary use application since it is already anticipated that the set up,operation,and breakdown is approximately 13 days.
