Chris: The Owners of the Maroon Creek Club, Maroon Creek Club LLC, are requesting a
Community Development Director approval for transferring square footage from the golf course
ancillary structures to the clubhouse for additional expansion. I have reviewed all of the previous
approvals and permits for various items associated with the commercial FAR for the project. It
appears that there are no provisions that would hinder any leftover space being utilized at the
clubhouse. In summary, this is what we have;
Total Approved 1,200 sf
Comfort station- used (312 sI)
Starter shack- used (100 sf)
Remaining 788 sf
Please review with the Community Development Director and let me know if this is feasible and
whether it can be done as an administrative action as a minor amendment to a development
permit.

REQUEST: The applicant, the Maroon Creek Club, is proposing to reallocate the 1,200 sq.ft.
of space dedicated to the golf course halfway house/snack bar into three structures that will not
exceed 1,200 sq.ft.
DISCUSSION: The applicant has learned from the golf course consultants that more than one
"rest" facility is needed for an 18-hole golf course. Therefore, the applicant is requesting to
amend Resolution 93-104 condition 4(d) which granted 1,200 sq.ft. for a halfway house/snack
bar. The detailed submission maps identify this structure to be located near the 11th tee box
on J any Chair Road.

Ball Shack is proposed to be located at the tee box area of the driving range.
The new location of these structures will not impact 1041 or Scenic Overlay areas. The
berming required along Highway 82, in conjunction with existing site landforms, will screen
these structures from public view. Extensive landscaping of the golf course will also contribute
to screening these structures from Highway 82.
RECOMMENDATION: Staff recommends that the County Planning Director approve the
applicant's request.

project. BOCC Resolution No. 93-104 (Book 721, Page 246) , condition no. 4.(d),
granted an allocation of no more than 1200 square feet for a halfway house/snack bar
based on a general location near the existing hay storage/pole structure on Lazy Chair
Denver Road. The Applicant is requesting an administrative approval by the Planning Director
Phoenix for the following re-allocation of this square footage;

conjunction with existing landforms on the site, screen these locations from view.

vehicles, do not require additional parking or employee generation beyond those
previously represented in the original and modified land use applications.

Maroon Creek Club, LLC, represented by Design Workshop, has applied for an
insubstantial amendment to an approved PUD for the Golf Course parcel of the
Maroon Creek Club Subdivision. This request is to relocate the "half-way house"
from its approved location near the Maroon Creek Townhomes to a location adjacent
to an existing structure near Tiehack Road, as shown in the application drawings.
The "half-way house" is a 700 square foot structure with bathrooms and a snack bar.
The structure was originally approved near the 9th hole on the eastern boundary of
the Maroon Creek Property. The applicant proposed, and was approved for, a new
location near the Townhomes.
The applicant has obtained a series of insubstantial amendments since approval and
has apparently proposed alternative street names without recording these changes on
a revised plat. For emergency response and utility agencies it is important to
document the changes by amending the final plat. Staff suggests the Community
Development Director require, as a condition of approving this "half-way house,"the
developer to amend the plat to reflect approved changes including street names. This
should be done at the conclusion of any other alterations to the approval but within a
reasonable time period.
Staff has reviewed this proposed amendment and recommends administrative
approval by the Director, with conditions.

1. A change in the use or character of the development.
Staff Finding:
With this proposed amendment, the use and intensity remains the same as
approved by the County. Staff does not believe the amended building envelope
changes the character of the development in a way which necessitates review by
the Commission and Council.
2. An increase by greater than three (3)percent in the overall coverage of structures on
the land.
Staff Finding;
There will be no change in land coverage with this amendment.
3. Any amendment that substantially increases trip generation rates of the proposed
development, or the demand for public facilities.
Staff Finding:

2. APPLICANT understands and agrees that City of Aspen.Ordinance No. 4.3 (Series of 1996)
establishes a fee structure for land use applications and the payment of all processing fees is a
condition precedent to a determination of application completeness.
3. APPLICANT and CITY agree *hat because of the size. nature or scope of the proposed
project, it is not possible at this time to ascertain the full extent of the costs invoived in processing
the apoication. APPLICANT and CITY further amee that it is in the interest of the rases to allow

City of Aspen Development Application Fee-Policy
•
The City of Aspen,pursuant to Ordinance 43 (Series of 1996),has established a fee strucm for the
processing of land'use applications. A flat fee or deposit is collected for land use applications based
on the type of application submitted. Referral fees for other City deparnYteats:evrieWing the
application will also be collected when necessary. One check including the deposit for Planning
and referral agency fees must be submitted with each land use application_made payable to the
Amen/Firkin Community Development D-tamt lent. Applications will not be accented for
processing without the required application fee.
A flat fee is collected by Planning for Staff Approvals which normally raise a m nimai and
predictable amount of staff time to process. The fee is not refundable.
A deposit is collected by Planning when more extensive staff review is required. as hours are likely
to var'i substantially from one application to another. Actual stair time spent'.viii be charged_
against the deposit. After the deposit has been expended, the applicant will be billed monthly based
on actual staff hours. Current billings must be paid within 30 days or processing of the application
will be suspended. If an a,-~ciicant has previously failed to pay anoiication fees as retuire:i. no new
. or additional applications will be accepted for processing until the outstanding fees are paid. In no
case will Building Permits be issued until all costs associated with case processing have been paid
After the final action on the project. any retaining balance from the deposit will be refunded to the
applicant
Applications which require a deposit must include an Agreement'or Pay ent Of Deyelopm e t
Application Pees. The Agreement establishes the applicant as being responsible for payment of all
costs associated with processing the application. The Agreement must be sued by the party
responsible for payment and submitted with the application in order for it to be accepted.
