LOCATION: Northwest corner of Bleeker Eight Street; Lots A, B, C, Block 12. SIZE: 9,027 square feet. ZONING: RMF· APPLICANT'S REQUEST: The Klein family is requesting an exemption from the requirements of the mandatory PU[-1 provisions of Section 24-8.13 of t he Code · The Kleins would I ik e to demolish the existing duplex on the site and replace it with a new duplex which will be 3,900 square feet in size. SITE DESCRIPTION: The site is flat, served by all public utili- ties and has access via Bleeker and Fight Streets, in addition to the alley in the middle of Block 12. The site is bordered by the Aspen Villas to the west and north a single_family house to the south and the Bavarian Inn to the east· PLANNING OFFICE COMMENTS The primary purposes of requiring PUD review is when a site has unique characteristics such as steep slopes or when a developer is seeking to utilize innovative site planning techniques which call for variations from area and bulk requirements. In the case of the Klein property, the PUD provisions of the Code are not applicable· The site is flat and the applicants are not seeking any variations from the area and bulk requi rements. We have considered the possibility that the construction of a duplex on this site may interfere with potential State Highway 82 re-alignments· The site is beyond the boundaries of any of the noise impact areas for new alignments which have been considered. The existing structure on the site has bean evaluated by the Historical Preservation Committee and has been found to have no historic or architectural significance. On Tuesday, February 24, 1987 the City Council approved a resolution deleting the Klein duplex from the list Of structures subject to the demolition moratorium. RECOMMENDATION Based upon our comments above, it is recommended that the P&Z grant the Klein family an exemption from the mandatory PUD section of the Code (24-8.13) for the purposes of constructing a new duplex on lots ABC, Block 12, City of Aspen. The property is presently zoned RMF with a mandatory PUD overlay. The property is at the corner of Eighth and Bleeker Streets and consists of 9,027 square feet. There is an existing duplex structure on the property. The property is owned by myself and my wife, Marsha, and it is our intention to remove the existing structure and replace it with a new duplex structure. Attached with this application is a site plan showing the foot print of the proposed new structure, driveways and parking. The proposed new duplex is compatible with the existing use of the land, the neighborhood and all mandatory PUD requirements. The site is flat, served by all public utilities and has access along Bleeker Street, Eighth Street and the alley running through the middle of Block 12. The Aspen Villas are located across the street from the property and the Bavarian Inn lies on the adjoining lots to the east. Under RMF Zoning, the property is capable of supporting several additional dwelling units, however, it is our desire to preserve as much open space as possible on the lot and live there ourselves. Therefore, only a duplex is proposed as the density for this parcel. When I discussed this application with you on January 30, 1987, you indicated that a possible area of concern is the location of a future Highway 82 alignment entering the City. At the present time, it is unknown what alignment the State Highway Department will be reviewing in its EIS study. However, the previously suggested alternative alignments which were voted on in the August, 1986 election, avoided the property although they were in the vicinity of the Aspen Villas complex. The property lies outside of any area indicated as an impact zone for either of the previous alignments. Therefore, there should be no - . Alan Richman February 3, 1987 Page 2 adverse impact by a relocation of the Highway, assuming it is relocated in either of the alignments previously suggested. The proposed new duplex structure will not require any variances from any City codes and will fully comply with all building and other zoning requirements. A demolition permit request has been submitted to the Historic Preservation Committee in order to exempt this property from the present moratorium. The Historic Preservation Committee will hear this application on February 10. At a neighborhood meeting on the Historic Preservation legislation presently pending in the City, the HPC determined that this structure was not suitable for placement on the "Designation List". Therefore, I do not anticipate any problem in obtaining an exemption from the moratorium for the removal of this structure. Enclosed is my check in the amount of $270.00 for the agreed upon filing fee. We are moving forward with the preparation of detailed construction drawings in orde~ to obtain a building permit and are working with our lenders in order to attempt to break ground by April 15, 1987. Therefore, I would greatly appreciate your scheduling of this request as soon as possible so that the Planning Commission can act on it in a timely manner. Thank you very much for your cooperation. Klein HSK/nwt MEMORANDUM DATE: February 24, 1987 TO: GLENN HORN, PLANNING DEPARTMENT FR: FRED GANNETT, ATTORNEY'S OFFICE RE: KLEIN EXEMPTION FROM MANDATORY PUD Assuming that Mr. Klein intends to satisfy the concerns enumerated in Section 24-8.13(a) (1-8), I do not foresee any legal obstacles in the creation of a duplex at the corner of Eighth and Bleeker. Subsection (b) of the aforementioned section seems to encourage the clustering of buildings and row houses, so long as zoning permits. I interpret this to include duplexes, and believe the above described location is appropriately zoned for such structures.
