Davis Property (1095 Ute Avenue) 8040 Greenline Review Exemption. Parcel I.D.No. 2729-292-01-058. DATE: December 12, 1997 SUMMARY: The applicant is requesting an 8040 Greenline Review exemption to construct an underground storage and laundry room addition to the existing building on the site. Community Development staff recommends approval of the R.E. Davis 8040 Greenline Review exemption with conditions. APPLICANT: I.G. Davis(owner),represented by Roger Kerr and Associates. LOCATION: The property in question is located at 1095 Ute Avenue, which is on the south side of Ute Avenue. ZONING: Moderate-Density Residential (R-15/PUD). CURRENT LAND USE: Single-family Residential in a duplex(2 units). BACKGROUND: The applicant is requesting approval to construct an underground storage and laundry room addition to an existing duplex. As the site is within 150' of the 8040' topographic contour, the addition is subject to an 8040 Greenline review. As the addition would be completely below grade, no new floor area would be added. The proposal has been reviewed against the Residential Design Standards of Section 26.58.040 and found to comply with said requirements. STAFF COMMENTS: Section 26.68.030, 8040'Greenline Review Because development is proposed within one hundred fifty (150) feet of the 8040 greenline, the proposal is subject to review under Section 26.68.030 of the Land Use Code. Section 26.68.030(B), Exemption, states that"the expansion, remodeling or reconstruction of an existing development shall be exempt from 8040 greenline review if the following standards are met: 1. The development does not add more than ten (10) percent to the • floor area of the existing structure or increase the amount of square footage of areas of the structure which are exempt from floor area calculations by more than twenty-five (25)percent; and RESPONSE: The existing structure has a floor area of 4,807 square feet, and the allowable floor area for the property is 5,121 square feet less a 25% reduction for slopes in excess of 30%. The proposed addition would not add any (0%) floor area, as calculated by the City, to the existing structure. Relative to increasing the amount of square footage of areas of the structure which are 1 exempt from floor area calculations,the proposed addition would contain 600 square feet(12.5% of the existing floor area). Therefore, the proposed addition complies with standard number 1 for an 8040 greenline exemption. 2. The development does not require the removal of any tree for which a permit would be required pursuant to Section 15.04.450 or the applicant receives a permit pursuant to said section; and RESPONSE: The proposed addition would require removal of trees for which a permit would be required; however, the applicant has applied for and obtained the necessary permit from the Parks Department. The signed, approved permit is attached to the 8040 greenline exemption application attached as Exhibit"A". 3. The development is located such that it is not affected by any geologic hazard and will not result in increased erosion and sedimentation. RESPONSE: Due to the addition's proposed location behind the existing building and deck, it would not be affected by any geologic hazard, nor would it result in any increased erosion or sedimentation. Existing drainage patterns will be maintained. The structure of the addition will be designed and certified by a licensed structural engineer, and the construction will be supervised by said engineer and the architect. REFERRAL COMMENTS FROM ENGINEERING: The application was reviewed by Chuck Roth and Nick Adeh of the City's Engineering Department, who offered the following comments (also see Exhibit`B"): • The application did not include an improvement survey. It appears from the site plan that there may be an illegally wide driveway/curb cut which would have to be remedied prior to the issuance of any further building permits. It should be a condition of approval that an improvement survey be required as part of the building permit application, and that said improvement survey indicate the approved building envelope and a driveway with a complying width. • With the building permit application, the applicant will need to confirm that the current and proposed levels of improvements were/will be constructed within the approved building envelope, including the proposed extent of excavation. • The building permit submittal/application must include provisions for retaining drainage on- site during construction and avoiding sediment transport onto public rights-of-way. The subject site does not have a designated building envelope; therefore,the language contained in the Engineering memorandum (Exhibit `B") is being interpreted to refer to the areas of the site that fall within the required front, rear, and side setbacks. The language contained in the recommended conditions of approval (below)reflect this interpretation. RECOMMENDATION: Staff recommends approval of the R:E Davis 8040 greenline review exemption with the following conditions: 1. An improvement survey shall be required as part of the building permit application, and said improvement survey shall indicate the required setbacks as well as a driveway with a width that complies with City standards. 2 • • 2. With the building permit application, the applicant will need to confirm that the current and proposed levels of improvements were/will be constructed within the required setbacks, including the proposed extent of excavation. 3. The building permit submittal/application shall inc_lude provisions for retaining drainage on-site during construction and avoiding sediment transport onto public rights-of-way. 4. In the event required, the applicant must receive approval from: • The City Engineer for design of improvements, including landscaping, within public rights-of-way; • The Parks Department for vegetation species, tree removal, and/or public trail disturbances; • The Streets Department for mailboxes and street cuts; and, • The Community Development Department to obtain permits for any work or development, including landscaping, within the public rights-of-way. 5. The structure of the addition will be designed and certified by a licensed structural engineer, and the construction will be supervised by said engineer as well as the architect. 6. The building permit application shall include plans which verify to the satisfaction of the City Zoning Officer the existing amount of floor area in the structure as well as the exact amount of floor area proposed with the additions. The maximum allowable amount of floor area for the subject property shall not be exceeded. 7. All material representations made by the applicant in this application shall be adhered to and shall be considered conditions of approval, unless otherwise amended by an entity having authority to do so. Dear Bob : This is a revision to the request for exemption from 8040 Greenline Review for a proposed underground storage and laundry room addition to the existing building. The revised submission eliminates any increase in F.A.R. by decreasing the size of storage room and moving it back into the hillside far enough to allow the addition to be completely below existing and finish grades. This will allow the proposed addition per Ordinace #30, Sec. 2 (d) Subgrade areas. Enclosed are plans of the proposed addition. The expansion conforms to all three conditions of "Review Standards for Exemption from 8040 Greenline Review" as described below. 1. "Development does not add more than ten percent (10%) to the floor area of the existing structure or increase the total amount of square footage of areas of the structure which are exempt from floor area calculations by more than twenty-five percent (25%)." The existing structure has a Floor Area Ratio of 4,807 square feet. The proposed addition has a floor area of 600 square feet (12.5 % of existing floor area). The increase in area exempt is 600 square feet (12.5% of floor area). Per your departments request a tree removal agreement has been executed with the Parks Department and has been copied to you as part of prior correspondence. 3. The addition will not affect any geologic hazard or result in increased erosion and sedimentation due to it's location nestled behind the existing building and deck. Existing drainage patterns will be maintained. The structure of the addition will be designed and certified by a licensed structural engineer. Davis 8040 Greenline Review Exemption Request I have reviewed the above referenced application, and I have the following comments: 1. Improvement Survey - The application did not include an improvement survey. It appears from the site plan that there may be an illegally wide driveway/curb cut which would have to be remedied prior to issuance of any,further building permits. It should be a condition of approval that an improvement survey be required for the building permit and that the approved building envelope and a complying width driveway be shown on the survey. 2. Approved Building Envelope-Following up on the previous comment, please confirm that the current and proposed levels of improvements were constructed within the approved building • envelope, including the proposed extent of excavation. 3. Site Drainage The building permit drawings must include provisions for retaining drainage on site during construction and avoid sediment transport onto public rights-of-way. 4. Construction Techniques - I called the architect and asked how he planned for construction. It is a typical concern of 8040 greenline review not to approve large cut slopes and scarring of native vegetation. The architect stated that they will be over-excavating about 3 feet beyond the wall with about a 10° slope. If the proposal meets with the original land use proposals, then the exemption may be appropriate to grant. If the proposed extent of excavation exceeds the approved building envelope, there are other construction techniques available that do not require over-excavating and laid back slopes. 1 • • 5. Work in the Public Right-of-way - Given the continuous problems of unapproved work and development in public rights-of-way adjacent to private property, we advise the applicant as follows: The applicant must receive approval from city engineering (920-5080)for design of improvements, including landscaping, within public rights-of-way, parks department (920-5120) for vegetation species and for public trail disturbance, and streets department (920-5130) for mailboxes , street and alley cuts, and shall obtain permits for any work or development, including landscaping, within public rights-of-way from the city community development department. Davis is requesting approval to extend an existing deck by 10 feet to the east based on previous 8040 Greenline Exemption Approvals. APPLICANT: I.G. Davis (owner), represented by Roger Kerr and Associates. LOCATION: The property in question is located at 1095 Ute Avenue. ZONING: Moderate-Density Residential (R15-PUD) CURRENT LAND USE: Single-family Residential in a duplex (2 units). BACKGROUND: The applicant is requesting approval to convert 216 square feet of existing roof-deck into roof and to extend their deck by 216 square feet. The applicant is doing this in order keep their FAR constant while increasing the square footage of the deck. The property in question had prior approval for 8040 Greenline Review exemption. STAFF COMMENTS: In the planning staff memo for the previous 8040 Greenline Review exemption, staff found that the structure was in compliance with the following exemption standards: 1. The development does not add more than ten (10)percent to the floor area of the existing structure or increase the amount of square,footage of areas of the structure which are exempt from floor area calculations by more than twenty-five (25)percent; and RESPONSE: The proposed addition to the deck would not add to the amount of exempt floor area because the proposal would take away the same amount of exempt floor area in converting the roof-deck to roof. Therefore, the proposed addition continues to meet the requirement for standard number 1 of the property's previous approval for an 8040 Greenline Review Exemption. 2. The Development does not require the removal of any tree for which a permit would be required pursuant to section 15.04.450 or the applicant receives a permit pursuant to said section; and w • RESPONSE: A signed, approved tree permit was included in the previous approval for an 8040 Greenline Exemption. As a condition of approval a new tree removal permit should be obtained from the Parks Department if any trees will be disturbed in the deck addition. 3. The development is located such that it is not affected by any geological hazard and will not result in increased erosion and sedimentation. RESPONSE: As part of the previous approval for an 8040 Greenline Review Exemption for an addition of a new storage room on this property, it was found that the previous addition would not be affected by any Geologic Hazard. Therefore, there should be no Geologic Hazards associated with extending the deck which is on the same side of the house as the previous addition that was approved in 1997. RECOMMENDATION: Staff recommends that the addition to the deck is within The conditions of the previous approval for an 8040 Greenline Review Exemption for an addition of a storage room that was approved in 1997.
