RE: Davis 8040 Greenline Exemption Amendment
The applicant, I.G. Davis Jr. , received an 8040 Greenline Exemption
on July 2 , 1992, for the approval for a 438 square foot living
addition, a 175 square foot new deck and conversion of a single
family home to a duplex.
The applicant currently seeks to amend the July 1992 , 8040
Greenline Exemption. The applicant proposes to add an additional
178 square feet of deck onto the east side of the newly approved
deck addition.
The addition of 178 square feet of ' deck area, plus recently
approved deck area and existing deck area results in a total of 578
square feet of deck area. The total square footage of deck area
equals 14 .4% of the total floor area of the 5, 121 square foot
residence. Therefore the deck addition is still exempt from floor
area calculations because it,is below 15% of the residential floor
area as allowed by the Land Use Code.
Although the amended deck addition is an extension of the approved
building envelope, the deck's location will not be affected by any
geologic hazards, particularly avalanche. This side of the
residence is heavily wooded and is not in an identified avalanche
chute.
The new addition has been configured in a manner so as to preserve
existing vegetation.
RECOMMENDATION: Staff recommends approval of the amendment to the
8040 Greenline Exemption with the following conditions:
1. Material representations made in the application packet and on
the attached map shall be adhered to and considered conditions of
approval unless amended by other conditions.
2 . There shall be no removal of trees as a result of the proposed
addition.

RE: Davis 8040 Greenline Exemption

REQUEST: The applicant is requesting an 8040 greenline exemption
to add approximately 438 square feet to an existing 4, 683 square
foot residence on Lot 2 of the Hoag Subdivision. The applicant is
also requesting to convert the existing single family residence
into a duplex.
APPLICANT: I.G. Davis, Jr.
APPLICANT'S REPRESENTATIVE: Roger Kerr and Associates.
ZONING: The 18, 366 square foot lot is zoned R-15 PUD.
REFERRAL COMMENTS: Comments from City Engineer Chuck Roth are
attached to this memo.
STAFF COMMENTS: The applicant is proposing the 438 square foot
addition to be located on an existing deck. The applicant is also
proposing to add approximately 175 square feet of new deck to be
cantilevered over existing grade. The applicant is also requesting
• to convert the existing single family unit into a duplex.
The conversion of the single family unit into a duplex is permitted
by right in the R-15 zone district. The applicant must provide one
off-street parking space per bedroom.
Development proposed pursuant to Section 7-503 (B) , 8040 Greenline
Review Exemptions, of the Aspen Land Use Code may be approved by
the Planning Director if the following standards are met:
1. The development does not add more than ten (10) percent
to the floor area of the existing structure or increase
the total amount of square footage of areas of the
structure which are exempt from floor area calculations
by more than twenty-five (25) percent; and
Response: . The addition is 438 square feet of an existing 4, 683
square foot structure. None of the proposed square footage is
exempt from floor area calculations. There is an increase of 9.4%
of the existing floor area.
The addition of a 175 square foot deck, results in a total deck
area of 400 square feet. Deck area represents 7 . 8% of the total
floor area of the 5, 121 square foot residence. This deck is exempt

from floor area calculations, as it is less than 15% of the
residential floor area.
1 2 . The development does not require the removal of any trees
for which a permit would be required pursuant to section
13-76 or the applicant receives a permit pursuant to said
section; and
Response: The proposed building extensions will not require any
trees to be removed.
3. The development is located such that it is not affected
by any geologic hazards and will not result in increased
erosion and sedimentation.
Response: The proposed expansion will not affect any geologic
hazard, as part of the expansion is on an existing deck and a
portion of it is cantilevered about 5 feet above existing grade.
These improvements will not effect erosion or sedimentation
conditions on the parcel.
RECOMMENDATION: Staff recommends that the Planning Director
approve the Davis 8040 Greenline Exemption for the proposed
addition and deck extension subject to the following conditions:.
1. There shall be no removal of trees as a result of the
proposed addition.
2 . The applicant shall consult City Engineering (920-5080)
for design considerations of development within public
rights-of-way and shall obtain permits for any work or
development within public rights-of-way from city Streets
Department (920-5130) .
3 . The applicant shall indicate on the site plan that there
is one off-street parking space per bedroom for both
units to the satisfaction of the .City Engineer, prior to
issuance of a building permit.
4 . Material representations made in the application packet
shall be adhered to and considered conditions of approval
unless amended by other conditions.

Exemption pursuant to Section 7-503

Re: Davis 8040 Greenline Review Exemption
Having reviewed the above referenced application, the engineering department has the
following comments:
1. This property has curb cuts that are larger than permitted by Section 19-101 of the
municipal code. The maximum allowable curb cut width is 18 feet in the zone district in
which the property is located. The Ute Avenue Improvement District recognized the curb
cuts in the construction plans, but the applicant must be advised that the driveway curb
cuts do not meet code. It is suggested that the City not approve any plans which reinforce
the curb cut issue. That is, the two parking spaces must be indicated in front of the
garage and not accessing off Ute Avenue. If Ute Avenue is improved in the future, the
18 foot wide curb cut may be implemented and enforced at that time.
2. Given the continuous problems of unapproved work and development in public rights-
of-way, we would advise the applicant as follows:
The applicant shall consult city engineering (920-5080) for design
considerations of development,within public rights-of-way and shall obtain
permits for any work or development within public rights-of-way from city
streets department (920-5130).

Dear Leslie:
Enclosed herewith is a development application for exemption
from 8040 Greenline Review for a proposed 438 square foot addition
to the existing building. Also as part of the application. the use is
proposed to be converted to a Duplex from it's current Single Family
Residence use.
The expansion conforms to all three conditions of "Attachment
4" (Review Standards for Exemption from 8040 Greenline Review) as
described below.
1. "Development does not add more than ten percent ( 10%) to
the floor area of the existing structure or increase the total amount
of square footage of areas of the structure which are exempt from
floor area calculations by more than twenty-five percent (25%)." The
existing structure is 4,678 square feet. The proposed addition is 438
square feet (9.4% of existing floor area). There is no increase in
square footage that is exempt from floor area calculations. The
addition is on the existing Deck location and reduces the existing deck
by 382 square foot. A new extension of deck adds back 175 square
feet of deck. Total Deck is 400 square feet, which is 7.8% of total
floor area of 5, 112 square feet.
2. The Development does not require removal of any tree for
which a permit would be required pursuant to section 13-76 or the
applicant receives a permit pursuant to said section." The existing
addition is built over existing roof deck and will not require any
excavation or foundation work to accomplish. The minor closet and
deck extensions will be cantilevered over existing grade and not
interfere with existing trees.

3. "The Development is located such that it is not affected by

sedimentation." The addition will not affect any geologic hazard or
result in increased erosion and sedimentation due to its construction
on top of the existing structure. The minor closet extension and deck
extensions will be cantilevered over the existing grade and not
interfere with existing grade or drainage.
There is no change in the number of Bedrooms or parking
required due to this proposal. Plans are included illustrating the
existing structure and what it will look like when completed. The
addition is designed to integrate and blend with the existing
interesting mountain architecture and enhance the uniqueness of its
design.
