Dear Fred;
As per our phone conversation in which you requested
an opinion on damage done to trees on the Kastelic
propertyVon the Roaring Fork River near the ,Cooper
Street Bridge, ' I have gone to the area in question •
and present this as my report to you for your use.
On the property in question I found two clumps of
"trees " bent over toward the river, both clumps •
bent almost horizontal to the ground. Boyh of the clumps
were at the end of a recently bulldozed '.'road" .
Mr. Kastelic explained to me that the "road" was
excavation from his sewer line digging of last year.
He . also said that both of the clumps were bent over
last year when backfilling his sew:r excavation had
been .started.This appears to me to be true as the growth
on the bent trees was vertical and bent branches were
horizontal.Also the weed growth at the ground near the
base of one clump indicated that this was an old condition,,
at least from the beginning of the growing season.
Inspection of the Kastelic property from the easternmost
boundary and arourt the bend of the river to the
• northern boundaryshows orderly,naturally 'grown area
down to the river edge with many native trees , shrubs
and grassy areas interspersed with some transplanted
vegetation. The only area which showed any disturbance
was the bulldozed "road" down to the river bank and the
bent over '.'trees " . In contrast to this property the
properties across the river from the Ka telic property
shows less concern for growth and vegeon care. Both
Town House Cond_ominmums and Chateau Roaring Fork appeAR
to intrude and "pollute" the stream Margin (natural stream
margin) to a much greater gegree than Mr. Kastelics
' two bent over clumps of trees .

P.s . I would be glad to come to discuss this and some
other questions I have regarding stream margin and
building violations along the Roaring Fork which appear
to have occurred in the aforementioned area. '

Re: Stream margin regulation
Gentlemen:
We are requesting your approval of the location of the
improvements as shown on the attached plot plan.
You will note that the closest distance between the deck and
the river is about 50 feet, which is about as far from the
river as is possible on the 150-foot depth of the site. The
site slopes toward the river and is covered with aspen, choke-
cherry, and some serviceberry bushes as well as a number of
large rocks . It is our intention to use this natural land-
scaping and therefore to limit the excavation as much as
possible to avoid scarring the area.
If there are questions which are not answered on the plot plan,
