Health MEMORANDUM TO: Bill Drueding, Zoning Officer FROM: Leslie Lamont, Planner RE: Paterson Stream Margin Exemption DATE: August 11, 1989 SU14KARY: The applicant is proposing to remodel their single family home at 1104 Waters Avenue. The development is located within 100 feet of the High Water line thus requiring Stream Margin Review. FINDINGS: The proposal is to enlarge the entrance by 53.15 square feet and upper level by 82.15 square feet on the west side of the building which is the far side away from the river. This addition is necessary for foundation work. A 230 square foot garage is also proposed on the west side of the building which will necessitate a driveway from the existing parking space. Some trees will be removed and the applicant is planning tree replacements along the new driveway. As indicated on the site plan, Parks have approved the tree removals. On the river side of the residence, the applicant proposed to enclose a portion of the existing balcony on both levels. The enclosure would be 66.4 square feet on each floor with an 18" extension off of the balcony in order to wash the outside of the windows. Pursuant to Section 7 -504 B. the expansion, remodeling or reconstruction of an existing development shall be exempt from stream margin review if: 1. The development does not add more than 10% to the floor area of the existing structure, or increase the amount of building area exempt from floor are calculation by more than 25 %. RESPONSE: The proposed addition adds a total of 267.1 square feet which is only a 7% increase to the structure this does not include the 230 square foot garage. 2. The development does not require the removal of any tree for which a permit would be required or the applicant receives a permit. RESPONSE: The applicant desires to remove several small Aspen trees and 2 small cottonwoods but will replace some trees along the new driveway. According to the site plan Bill Ness has reviewed and signed off on the removal and replacement plan. 3. The development is located such that no portion of the expansion, remodeling or construction will be any closer to the high water line than is the existing development. RESPONSE: The river side addition will enclose an existing deck area. The 18" extension is intended only for cleaning purposes. 4. The development does not fall outside of an approved building envelope. RESPONSE: Only the 18" extension falls outside the envelope but does not impact the special flood hazard area. on Waters Avenue does increase the building envelope The additi but willohave no effect on the special flood hazard area. A variance from the front yard setback shall be required to build the garage. 5. The expansion, remodeling or reconstruction will cause no increase to the amount of ground coverage of structure within the special flood hazard area. RESPONSE: The additions to the residence will not increase the ground coverage of the structure within the special flood hazard area. RECOMMENDATION: Staff recommends that the Interim Planning Director approve the Stream Margin Exemption for the Paterson residence at 1104 Waters Avenue with the condition that this approval shall not encumber the Board of Adjustment review for a setback variance. The submitted materials are sufficient for review. 2. With recent Stream Margin Review applications, we have been asking applicants for fisherman easements, which may be within the stream to the high water line or alongside the stream to five feet from the high water line. I do not know of any written fisherman easement that we could have filled in and recorded. Generally they are conveyed on plats. Perhaps you could obtatin one from attorney's office for the applicant to convey such an easement. cc: Bob Gish memo-89.92 • t z ATTACHMENT 2 0 July 24, 1989 Re: Paterson residence 11 O 4 WAT tZ S #5 A1;Pwtl Co, We are requesting stream margin exemption because the major remodeling will occur on the west side of the building, away from the stream. This will consist of enlarging the entrance 53.15 square feet and the upper level 82.15 square feet. This rebuilding is necessary be because of inadequate foundations under the f front porch area. The )#dlst side of the building has been settling for several years. The proposed garage will be on the west side with 230 square feet.and will be tucked in- conspicuously against the solar room. This will necessitate a small driveway from our existing parking space, and the removal- ..,.of some trees which are growing in and around the stream. We have checked with the City ? Parks Department and their approval is attached. We are planning tree teplacements along the n new driveway. On the river side we wish to enclose part of the existing east balconies on both 6loors. This would consist of 66.4 square feet on each floor with an 18" extention to the balcony so that we are able to wash the new floor to ceiling fixed glazing. There will be no other construction oft the east side (river side). The reason for extending the rooms by enclosing part of the balconies is that the house is, at present, closed off from the dramatic view of the Roaring Fork River. We would like to have this view incorporated by building floor to ceiling glazing at the edge of our balconies. These adjustments would give ms the opportunity to enjoy the warm morning winter smn as well as a view of the river.
