The Planning and Zoning Commission approved a stream margin review February 11, 1992 . The applicant seeks to amend the 1992 approval for the purposes of enclosing a deck, and constructing .a terrace, rip-rap retaining wall and hot tub closer to the river than was indicated on the approved plans. APPLICANT: Edwin Phelps and Linda McFarlin LOCATION: 163 Park Avenue, Aspen ZONING: R-6 APPLICANT'S REQUEST: Amend the 1992 Stream Margin approval to replace concrete stairs, landings and raised wood deck with flagstone. Construct a low retaining wall planted with native wild flowers and shrubs, terrace, stairs and hot tub west of the ditch. The applicant represents that no disturbance of vegetation or development will occur west of the building envelope. REFERRAL COMMENTS: The Engineering Department has reviewed the application and made a site inspection and has the following comments: 1. We are concerned that the riparian vegetation is not being preserved as required, however a registered surveyor must set stakes and flagging for the building envelope in the original approvals prior to issuance of further permits. We recommend against permitting any improvements to be located closer to the river than already approved. 2 . Prior to the issuance of further permits, a statement must be provided from the irrigation ditch company that accepts the work performed on their ditch. STAFF COMMENTS: The applicant proposes to replace the concrete patio and stairs with flagstone and move the terrace, stairs and hot tub closer to the edge of the river then was previously approved. wow . • Pursuant to Section 7-504 B. the expansion, remodeling or reconstruction of an existing development shall be exempt from stream margin review if the development: a. does not add more than 10% to the floor area or increase the amount of building area exempt from floor area calculations by more than 25%; RESPONSE: The amended plan does not add more than 10% to the floor area. b. does not require the removal of any tree; RESPONSE: According to the application approximately 8 more trees will be either removed or relocated than was originally approved. Prior to the issuance of any, building permits, tree removal permits shall be obtained for the removal or relocation of any trees 6" in caliper or over. c. is located such that no portion of the expansion, remodeling or reconstruction will be any closer to the high water line than is the existing development; RESPONSE: The amended plans will push improvements closer to the river then was originally approved. The hot tub, stairs and flagstone terrace with a rip-rap retaining wall will be approximately 8 feet closer to the river. Although the amended plan identifies a 20 foot set back from the high water line and a ,note that no vegetation shall be disturbed west of the building envelope, the proposed hot tub, rip-rap retaining wall, flagstone stairs and terrace were not identified on the original plans. The encroachment of these improvements down the bank and closer to the high water line may seriously impact the natural vegetation and riparian zone of this section of the river. This expansion onto the steep slope and removal of natural vegetation. between the culvert and the setback line is inconsistent with the Roaring Fork Greenway Plan. d. does not fall outside of an approved building envelope; and RESPONSE: Development does not fall outside of the approved building envelop however, the hot tub, wall and stair improvements were not indicated on the plans that were approved in the 1992 stream margin review. Removal of natural vegetation along the river for man made improvements does not meet the standards of a stream margin exemption. e. is located completely outside of the Special Flood Hazard Area and more than one hundred feet from the high water line of the Roaring Fork River or the expansion, remodeling or 2 • reconstruction will not cause an increase to the amount of ground coverage of structures within the Special Flood Hazard Area. RESPONSE: Although the amended development plans are within 100 feet of the high water line, plans indicate that the flagstone will enable proper drainage. There will be no increase of structures in the special flood hazard area. RECOMMENDATION: Staff recommends approval of the replacement of the concrete with flagstone and enclosure of the deck area that was recently approved by the Board of Adjustment and any work do be done east of the culverted ditch only with the following conditions: 1. 'Prior to the removal or relocation of any trees 6" in caliper or greater, tree removal permits shall be obtained from the Parks Department. 2. Construction procedures employed must be such that no runoff from rain or snowmelt shall be permitted to drain into the river from the disturbed earth. In no way shall any construction debris or equipment, fill, or landscaping impact the river. 3 . Prior to the issuance of a Certificate of Occupancy, the applicant is required to plant any regraded area inside the building envelope with species keeping with the Roaring Fork Greenway Plan as well as existing plants in the area. No disturbance shall be permitted between the building envelope (the western boundary being the culverted ditch) and the high water line. 4 . All representations that have been made in the application and during the presentation shall be adhered to. 5. The Planning and Engineering staff shall monitor the redevelopment of this site to ensure that erosion measures are in place during construction and that no vegetation is removed below the culverted ditch. 6. Prior to issuance of a building permit, a registered surveyor must set stakes and flagging for the building envelope in the original approvals. Staff recommends denial of placement of the hot tub, stairs, terrace, and rip-rap below existing ditch culvert because of concerns with erosion and damage to the natural vegetation. Applicant has received a building permit for a 3,106 s. f. single family dwelling unit, including site work comprised of wood decks, concrete stairs, walks and driveway. Applicant now wishes to provide an additional 127 s.f. of floor area by removing proposed decks and building enclosed living space. Additionally, development of a terrace, to be located east and west of of the irrigation ditch(re: enclosed plan) is planned. Compliance with review standards are further discussed in response to attachment 4. • • Phelps/McFarlin Stream Margin Exemption Approval Response to attachment 3 Wednesday, April 21, 1993 1. Applicant intends to eliminate all concrete surfaces west of the crest of the existing slope. The exposed aggregate concrete stairs, landings and raised wood deck which were previously approved will be replaced by setting flagstone on compacted native fill (sand) which will provide excellent drainage and prevent run off from the flat surfaces. Low retaining walls will be constructed of river stone cobbles from the excavation. This riprap will be planted with native wild flowers and shrubs. These retaining walls will not present a barrier to natural drainage. Stairs will be constructed of flagstone treads and stone risers to conform to natural grade as much as possible. The hot tub shown on the approved drawings will be moved to the west of the corrugated metal pipe (irrigation — ditch) and set partially below grade. Existing trees to be removed are shown on the enclosed plan. Applicant will replace all trees which are removed. Many of the Aspen trees marked for removal are unhealthy; suffering from Cytospora Canker. Applicant ;, will relocate the 3 Spruce trees as shown on the site plan. c .kThere are no trails on or near the parcel. Applicant will grant the requested fisherman's easement (applied for). As stated in the previous approval no disturbance of vegetation or development will occur west of the building envelope between the building setback line and the river. Additionally the applicant will stake the building envelope prior to construction. Precautions will be implemented per the approved plan to ensure that no erosion or sedimentation of the stream bank occurs (re: site plan). The course of the river will not be altered in any way. All regraded areas will be replanted with indigenous vegetation. Recommendations of the Roaring Fork Greenway Plan will be implemented to the greatest extent possible. No construction will occur in the public rights-of-way without a permit and landscaping will be limited to those areas not designated for pedestrian or vehicular improvements. 2. The proposed development adds 5.5% t o the floor area of the -•• •ved structure. Building area exempt from floor area calculations increases b 13.6° 2. Applicant will secure a tree removal permit per Section 13-76 for trees over six inch caliper to be removed. This includes 2 additional trees not previously approved for removal. Trees removed will be replaced. Only those trees necessary for construction will be removed. 3. The approved development is located such that it will be 6 feet farther from the high water line than what was approved (29' vs. 23'). 4. The proposed development falls within the approved building envelope (building setbacks). _. ( . p . .. 1- I.'.•-' . • • . 11111111111 • . •-• II 1111710w, . . . • , , Off" . .. . . . . • - . • • -,4 . : '.- r'7c • '410._ _ . --... ..._...... a . ._.) \ 1 . o RESOLUTION OF THE ASPEN PLANNING AND ZONING COMMISSION GRANTING STREAM MARGIN APPROVAL FOR THE DEVELOPMENT OF A SINGLE FAMILY HOME AT 163 SOUTH PARK AVENUE, ASPEN COLORADO Resolution No. 92- 7 WHEREAS, the Aspen Planning and Zoning Commission held a meeting February 11, 1992 ; and WHEREAS, the Commission reviewed an application for a stream margin review for the demolition and reconstruction of a single family home at 163 South Park Avenue, Aspen Colorado; and WHEREAS, pursuant to Section 24-7-504 development within 100 feet from the high water line of the Roaring Fork River and its tributary streams, or within the one hundred ear flood lain is Y floodplain to undergo Stream Margin Review; and WHEREAS, the Planning staff reviewed the application and recommended approval with conditions; and WHEREAS, the Commission reviewed the application; and NOW, THEREFORE, BE IT RESOLVED by the Commission that it does hereby grant stream margin approval for 163 South Park Avenue with the following conditions: 1. Prior to the issuance of any permits: a. The applicant must make a statement on the permit set of drawings, indicating there will be no disturbance of vegetation between the building envelope and the river. A construction site drainage plan and procedure must be submitted for engineering department approval. The construction , ' procedures employed must be such that no runoff from rain or snowmelt be permitted to drain to the river from contact with '1A disturbed earth. The construction procedure used shall in no way �� impact the stream. O �/ / Resolution No. 92- Page 2 The applicant is requested to grant a fisherman' s easement for t e river for a width of five feet along the bank adjacent to the property and five feet into the water. 2 . Prior to the issuance of a Certificate of Occupancy the applicant is required to plant any regraded area inside the building envelope with species keeping with the Roaring Fork Greenway Plan as well as existing plants in the area. 3 . Given the continuous problems of unapproved work and development in the public rights-of-way the applicant shall consult City Engineering for design considerations of development within public rights-of-way and shall obtain permits for any work or development within public rights-of-way from City Streets Department. 4 . All representations that have been made in the application and during the presentation shall be adhered to. t APPROVED by the Commission at its regular meeting on May 5, 1992 .
