HomeMy WebLinkAboutresolution.council.086-01 RESOLUTION NO. 86 (Series of 2001) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO, SUBMITTING TO THE ELECTORATE OF THE CITY OF ASPEN CERTAIN QUESTIONS AT THE NOVEMBER 6, 2001, MUNICIPAL ELECTION, AND SETTING SUCH BALLOT TITLES AND QUESTIONS. WHEREAS, the City Council is authorized pursuant to Section 5.7 of the Aspen City Charter to, on its own motion, submit questions to a vote of the electorate; and WHEREAS, the City Council desires to seek voter approval to amend the City Charter of the City of Aspen to (1) identify certain Specially Designated Spaces owned by the City of Aspen, and (b) to clarify the qualifications for the offices of council member and mayor; and WHEREAS, Section 13.10 of the Aspen City Charter authorizes the amendment of the Aspen City Charter at any time in the manner provided by the Colorado Constitution; and WHEREAS, Article X, Section 9, of the Colorado constitution vests in the registered voters of the City of Aspen the power to adopt, amend or repeal their Home Rule Charter. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO, THAT: Section 1. The following question, amending the City Charter of the City of Aspen to identify certain Specially Designated Spaces owned by the City of Aspen and requiring the unanimous approval of the City Cotmcil to change their currently authorized uses~ shall be placed on the ballot at the City's special election to be held on November 6, 2001: ' CITY OF ASPEN BALLOT QUESTION No. - .... AMENDMENT TO HOME RULE CHARTER- CREATING SPECIALLY DESIGNATED SPACES. Shall Article XIII of the City of Aspen Home Rule Charter be amended by the addition of a new Section 13.13 to read as follows? Section 13.13 Specially Designated Spaces. (a) Specially Designated Spaces. The following City-owned properties are hereby identified as Specially Designated Spaces: (i) The Ute Cemetery. (ii) The John Denver Sanctuary at the Rio Grande Park, (b) Uses of Specially Designated Spaces. Notwithstanding any provision of the Municipal Code to the contrary, changes in the authorized uses of Specially Designated Spaces shall be by resolution approved by the unanimous vote of all council members. Section 2. The following question, amending the City Charter of~e City of Aspen to clarify the requisite qualifications for council members and mayor, shall be placed on the ballot'at the City's special election to be held on November 6, 2001: CITY OF ASPEN BALLOT QUESTION No. - .... AMENDMENT TO HOME CHARTER- QUALII=ICATIONS OF COUNCIL MEMBERS AND MAYOR. Shall Section 3.5 of the City of Aspen Home Rule Charter be amended to read as follows? Section 3.5 Qualifications. Each councilman and the mayor when nominated and elected shall be an elector of the City, a citizen of the United States for at least one year, and shall have resided in the City of Aspen for at least one year, No councilman or the mayor shall be a salaried employee of the City during his term of office, perform personal services for the City for which he is compensated other than as provided in Section 3.6. The council shall be the judge of election and qualifications of its own members. Section 3. The following question, amending the City Charter of the City of Aspen to change the durational residency qualification for board and commission members fi.om two years to one, shall be placed on the ballot at the City's special election to be held on November 6, 2001: CITY OF ASPEN BALLOT QUESTION No. - .... AMENDMENT TO HOME RULE CHARTER- CHANGING DURATIONAL RESIDENCY QUALIFICATION FOR BOARD AND COMMISSION MEMBERS FROM TWO YEARS TO ONE. Shall Section 8.2 of the Cily of Aspen Home Rule Charter be amended to read as follows? Section 8.2 Composition of boards and commissions. No member of the city council, the mayor, any city employee, nor any appointed city official shall serve on any permanent board or commission heretofore established or hereafter established by council during his or her tenure as councilman, mayor, city employee or appointed official. Every member of a permanent board or commission established by this Charter and appointed by council shall be a resident of the City of Aspen for at least one (1) year and shall be a qualified elector, with the exception of the board of appeals and examiners which shall be composed of members who are either residents of the City of Aspen or of Pitkin County for at least two (2) years. Terms of appointment to such boards and commissions shall not exceed four (4) years. There shall be no limitation on the number of terms a member may serve on any permanent board or commission.
