RE: Insubstantial Amendment to Appr ed PUD--Lot 7, Silverlode, Williams Ranch Subdivision CC: Sara Thomas, Vicki Monge, Nick Adeh Attached is an application requesting an insubstantial Amendment to an approved PUD for Lot 7, Silverlode Subdivision (Williams Ranch). The applicant is requesting that their building envelope be revised in order to shift it northward (uphill) 15' to avoid placing the driveway on a fill slope. In its present location, the building envelope causes the driveway to be constructed on top of backfill that supports the boulders and may cause those boulders to slump. Under Section 26.84.080, "An insubstantial amendment to an approved development order for a final development plan may be authorized by the Community Development Director." The code then goes on to describe those items that are NOT considered an insubstantial amendment. This proposal does not fall into any of those criteria, therefore it is eligible for an insubstantial amendment through you. David Panico, representing the owner, has indicated that a similar request was approved by you for adjacent Lot 6. In reviewing the case file for the adjacent Lot 6, it does not appear that any conditions were placed on that approval. However, I would recommend that as a condition of approval the applicant be required to submit a plat amendment which shows the modification to the building envelope. Because several other lots in this block are also coming through with insubstantial requests, perhaps one plat amendment addressing all of the modifications would be appropriate. This should be recorded prior to final CO. Staff recommends that the Community Development Director approve this insubstantial amendment to the PUD, with the following condition: 1. That the applicant be required to submit a plat amendment which shows the modification to the building envelope. Because several other lots in this block are also coming through with insubstantial requests, one plat amendment addressing all of the modifications could be filed. This should be recorded prior to final CO.
