Prj 1 II CITY OF ASPEN aspen ,coior acdo, 81x11 box v TO: City of Aspen Building Inspector FROM: Aspen Planning & Zoning Commission SUBJECT: The _Tre_ House DATE: March 15, 1974 On 3/5/74 the Aspen P & Z heard a conceptual presentation under Ordinance review for the above captioned project. The application was denied for the following reasons : 1. Inadequate traffic capacity and circulation pattern of Ute Ave. 2. Because of difficult topography, adequate on site parking cannot be provided for the number of units proposed without excessive cutting into the mountain and alteration of the terrain. 3. Public transportation is not available or planned for the area and the unimproved state of Ute Ave. would not allow for the amount of on street parking generated by the number of units proposed. 4. Access for fire protection is inadequate for the number of units proposed. 5. Water for fire protection is inadequate because the city' s water transmission and distribution system is currently unable • page 2 The Tree House to provide desirable flows and pressures in the southerly and easterly portions of the system during the peak consumption periods in the summer; flows for domestic water use are uncertain. 6. G 1 i Zoning March z ogu r Me i�q Aspen Planning a?_crc , _ Ms. Baer stated that they had. Johnson made a motion to approve the preliminary and 3rd final presentation under Ordinance rtl9 for the 3" Generation Building conditioned on a solution to the run-off retention and build-up problem, trash removal and that they are willing to sign the contract for parking. Motion seconded by Jenkins. All in favor, with the exception of Landry and Vagneur who abstained. ' Motion carried. Tree House - _,, Charlie Weaver was present representing the project. T ��°'" Conceptual Ms. Baer explained that the subcommittee recommended conceptual approval of this project. Reminded the Commission that it had come to them previously and was tabled, Commission had a site inspection of the property. It was then withdrawn at the request of the applicant, and is now coming back for conceptual review. Ms. Baer stated that the only condition the subcommit- .. tee recommended was that those leases be covenanted for no less than a year. Further, reminded the Com- mission that this project would be subject to subdi- vision conditions where the site constraints are con- siderable. Stated that the topography is a considera- tion. • Vagneur questioned where the waterline is located. MS.. Baer stated that the waterline is located in the I street, but do not know whether or not the pressure is adequate at this time. Stated this must be tested. Johnson questioned if there was anything beyond this project on the waterline. • Landry stated that there was a fire hydrant beyond it. Schiffer questioned if the applicant has described how the intended development complies with the use recommendations of the Land Use Plan. MS. Baer stated that the applicant is proposing this project be for permanent residents in the mixed-resi- dential area. Johnson request the applicant address himself to how it applies to the proposed rezoning. Ms . Baer stated that the applicant has 18 , 000 square feet approximately. Stated that the proposed zoning would be R-15 , so would have duplex density. V'agneur stated that she felt that that sort of density there where there is a zoning proposal is not correct. Can not go along with it when other projects have been refused in that same area. Landry stated that she agreed with Vagneur. Stated that when the CSU stucaenLs dic7 RECORD ui-: {iJ Lea v ;s Regular Meeting Aspen Planning & Zoning March 5 , 1974 their Resource Inventory and showed the 30° grade in the area above this , felt this area was subject to snowslide. Weaver stated that 3 years ago had discussed with Benedict and Larkin the possibility of buying their piece of adjoining property. Stated that on the plat of the subdivision it is stated that certain lots , not these, requirement that an avalanche expert certify that the area be avalanche-free. Stated that Benedict had hired an avalanche expert and the expert reviewed Benedict ' s property. The expert said that it was definitely in an avalanche area, but that was only half of the property. Stated that the property ad- jacent to his own was not included in the avalanche area. Stated that therefore, his property would pre- sumably be avalanche-free. Weaver submitted brochures to the new members of the Commission showing the type of buildings he proposed to build, adding that they are ideally suited for a sloping lot. Jenkins stated that he was concerned with the density , and whether or not the slope was subject to snowslides Stated that at the density which Weaver is proposing , not even close to what the Commission has expressed as what they feel right for that area. Johnson agreed that the density was a concern. Felt it is much greater than what the Commission has come up with for that area. Stated that the parking was a further concern and felt it would create a problem. Stated that Ute Avenue was another concern as far as traffic. • Schiffer stated that he agreed with the concerns the members had expressed, that there is a problem with the density and felt that under Ordinance #19 , the Commission must address themselves to the density subject to modification as determined by the physical . conditions of the development, i.e. slope, access , • drainage , terrain features and the impact resulting from the development. Felt it would have the same type of constraints as Ute Village Condominiums . Feel the density is too much for that site. Bartel stated that the recommendation of the Commissio for this area is on the City Council agenda as an or- dinance to amend #19 . Stated that Mayor Standley has also placed on the Council agenda the zoning of the total Ute Avenue area for the next regular meeting of the Council. Weaver questioned what would be acceptable to the Com- mission for that site. • Johnson stated, and it was the concensus of the Com- mission, that R-15 would be acceptable for that area. Weaver pointed out that the house itself only takes up 800 square feet. Jenkins stated that he felt that if the Co: ,mis:,i-on T;as going to attach a certain use to a specific >' oject , would have to have some means of enforcing :_t. Ques- tioned how that could be done. Concensus of the Commission was that the site plan would he shown at the preliminary stage. The Tree House ✓ Due to the fact that the applicant was not present, consideration of the Tree House project was tabled . until such time as the applicant could arrange to be placed on the agenda. Aspen Center Bartel reviewed. the major points of the agreement. Stated that after a full series of meetings last sum- mer, in November of 1973 , the Commission set out that they would allow 52 , 800 square feet of retail space in the first phase of the Aspen Center project, with no committments in square footage to the other phases . Bartel stated that included in that are lists of uses from which the uses that would locate in the Center should come. Further, set out several things that were not to occur. Bartel stated that the Commission had excepted from the 52 , 000 square feet any square footage of the Post Office. Also excepted any square footage for housing. Bartel futher stated that the agreement made no corn- . mittments as far as requirements for subdivision are concerned and other Ordinance #19 review provisions . Stated that what was before the Commission at this meeting is the conceptual stage of the Ordinance #19 review for the first phase of the project. Richard Schottland was present and submitted a model of the proposed first phase of the project. Stated that in reference to the entire site now, this model represented 7% of the density under the existing zon- ing. Schottland pointed out the location of the 13 low cost housing units . Further pointed out that he has made an offer to the City whereby they would agree to rent a one bedroom apartment for $150 . 00 , two bedroom apar- tment for $225 . 00 , and a three bedroom that would be rented for $260 . 00 . Stated that those prices would remain at that level unless their taxes were increased or cost of operation increased. Schottland stated that if they were to get the rentals down lower and the City wanted to not have any taxes applicable to those units , could reduce the rentals by $16 . 00 per unit. Schottland stated that at their next presentation , would have an economic impact statement which they have just completed. Stated that the Commis- sion could either act: tonight or hold a special meeting on the 8th of January. Vidal stated that they had not really made the decision to not extend. Understood that they had 30 days. to make that decision.Questoned the Commission on what activites the Commisson would go tnrough to help the project C;at further down the road as to making a deciston . Vidal stated that he assumed if the Commission disapproved the project, they would supply the reasons for disapproval and what other data would have been required. Schiffer stated he would prefer to approve the project subject to the condition that it is in compliance with the recommendations as far as the economic impact study is concerned. Jenkins stated that he would rather not vote on it until all the information is in. Stated that the subcommittee would have some very concrete information before the 10th. Concensus of the Commission was to hold a special meeting on the 8th of January to consider this -project. - - - Tree House 4/ Charlie Weaver was present representing the project. Ms. Baer stated that this project has been seen by the • subcommittee. Stated that the project was modular, pedes- tal houses to be constructed on Ute Avenue (Lot 2 Hoag Subdivision) . Stated that this was a request for 6 dwel- ling units on less on 18 , 482 square feet. Each unit has approximately 800 square feet. Ms . Baer further pointed out that the subcommittee had recommended this project with the rental restrictions. Stated that the project would also have to go through subdivision. Weaver submitted a model of the project. Stated that these particular houses lend themselves to a slope. Had located six open areas in the trees , so would be minimal tree removal. Does not want to restrict himself to long term rental , but had agreed to covenant it to the rental restrictions of the Commission. Further sated he would like the Commission to inspect the site area. Weaver pointed out that the terrain lends itself to of- fering privacy for the individual houses. By raising or lowering the pedestals , can further maneuver the privacy of each house. Weaver stated that there were two similar houses which he would. lihe the Comision to see in order to visualize how this project would. come together . Our project emphasizes an environmental blend of houses and trees , assuring the preservation of 99% of all natural growth; the structures will rest on narrow pedestals .
