HomeMy WebLinkAboutordinance.council.050-01 ORDINANCE NO. 50 (Series of 2001) AN ORDINANCE AMENDING THE 2001 AFFORDABLE HOUSING GUIDELINES AS RECOMMENDED BY THE ASPEN/PITKIN COUNTY HOUSING AUTHORITY WHEREAS, pursuant to the Municipal Code of the City of Aspen, as men&d, the Housing Income, Eligibility Guidelines and Housing Price Guidelines are to be established by the City Council; and WItEREAS, pursuant to prior resolutions and ordinances of the City, the City Council established Employed Housing Income-Eligibility Guidelines and Housing Price Guidelines for prior years; and WHEREAS, the 2001 Affordable HouSing Guidelines ("Guidelines) were approved by the City Council on October 26, 2001; and WHEREAS, the City Council desires to amend said Guidelines, and by v/rtue of the enactment of this Ordinance to supersede and amend all prior resolutions and ordinances of the City pertaining to housing guidelines, but only to the extent inconsistent with the provisions of this Ordinance and with Ordinance 38 (Series 2001) already adopted and approved. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: That the City Council of the City of Aspen hereby amends the 2001 Affordable Housing Guidelines as follows: 1. Under Part III, Section 4, Maintaining eligibili(v for Ownership of Affordable Housing, the last sentence shall be added regarding a Requalification Affidavit, therefore, the paragraph shall read: There is not a requalification requirement to meet Income, Asset and Minimum Occupancy for persons who have purchased and own an affordable housing unit. The individual must remain a qualified employee or retiree, continue to occupy the unit as their primary residence, and not own any other residential property within the Roaring Fork Valley, as defined in these Guidelines, and as they are amended fi.om time to time. APCHA will be sending letters to each owner within the next two years to provide documentation as to being a qualified employee in Pitkin County, using the unit as the primary residence, and not owning any other residential property in the Roaring Fork Valley. After the initial two-year qualification period, APCHA will revaluate the requalification process. However, APCHA will require all owners to complete and sign a Requalification Affidavit on a yearly basis. 2. Under Part X, Definitions, the definition for Consumer Price Index will add the base rate of the Consumer Price Index used, therefore, the definition will mad as follows: Consumer Price Index (CPI) - The Consumer Price Index that is used for purposes of the Guidelines and for purposes of the Deed Restriction is the Consumer Price Index - U.S. City Average and Regions, Urban Vt/age Earners and Clerical }Vorkers (CPI-W), All Items (1967~100). Updated information is received on a monthly basis from the U.S. Department of Labor, Bureau of Labor Statistics. 3. Under Part X, Definitions, the definition for Roaring Fork River Drainage/Roaring Fork Valley will be added as stated below: Roaring Fork River Drainage/Roaring Fork Valley - The Roaring Fork River Drainage and/or Roaring Fork Valley, as used herein, includes the Roaring Fork River Valley and the valleys with tributary streams or rivers, including the Frying Pan River, the Crystal River, Snowmass Creek, Capital Creek, Maroon Creek and Castle Creek. A public hearing on this Ordinance shall be held on the 14th day of January, 2002, in City Council Chambers, City Hall, Aspen, Colorado.
