The Forest Service is initiating National Environmental Policy Act (NEPA) analysis on the
following proposal: Kopp Forest Road Easement.
Scoping is conducted at the beginning of a NEPA environmental analysis. It is a procedure by
which the Forest Service identifies important issues and determines the extent of analysis
necessary for an informed decision on a proposed action. A scoping statement is attached. The
statement identifies the proposed project and what we currently know of the situation. I want to
emphasize that this is just the first step in the analysis and no decisions have been made. All
interested parties are encouraged to advise the Forest Service of issues that you believe should be
examined.
I would appreciate receiving your comments on this proposal before June 26. 2001. Comments
should be sent to: USDA Forest Service, Attn. Allan Grimshaw, 806 West Hallam St., Aspen,
CO 81611.

SCOPING STATEMENT
Proiect Name: Kopp Road Easement.
The Proposal
Mr. Robert L. Kopp owns several patented mining claim parcels that are located nort~?f~n.adoand that
are accessed via Forest Development Roads # 130 (Larkspur Road), # 508 (Kobey Fark Road), & # 526
(Yackel Road). Mr. Kopp has requested a Forest Road Easement so that he may prove that he has legal
access to his parcels.
Unless closed bY1UnYrdet-otregulation, use of an eXisting F6restDevelopirierit Roa.d doesno( require a
use authorization (that is, a permit or an easement). However, we may issue a Forest Road Easement to a
qualifying landowner. Use of the road under an easement must comply with all Federal and State laws
governing road use and Forest Supervisor Orders that apply to a specific road.
The Forest Service must approve any road maintenance that is proposed for a Forest Development Road.
Many skiers and snowmobiles use the above referenced roads in winter. The Forest Service probably
would never authorize the removal of snow from these roads.

The Decision
The decision to be made is whether or not to issue a Forest Road Easement to Mr. Kopp.
NEP A Documentation & Decision Document
The analysis for this proposal may qualify for categorical exclusion from documentation in an
Environmental Impact Statement or an Environmental Assessment under Chief of the Forest Service
category 31.2 # 3. That category is: Approval. modification. or continuation of minor special uses of
National Forest System lands that require less than five contiguous acres of land (ref. Forest Service
Handbook 1909.15, Ch. 30, at 31.2). If documentation of the NEPA analysis may be categorically
excluded under this category, a Project File must be prepared and the decision would be made in a
Decision Memo.
The analysis may need to be documented in an Environmental Assessment (EA). In that case, the more
lengthy EA process would be followed and the decision would be documented in a Decision Notice.
