The applicant is requesting an Insubstantial SPA Amendment, pursuant to Land Use Code Section 26.440.090.A, and an Exemption to Stream Margin Review, pursuant to Land Use Code Section 26.43 5.040.13.1. SUMMARY: The Applicant has requested an Insubstantial SPA Amendment and an Exemption to Stream Margin in order to construct a pump house and a restroom facility. The restroom is proposed to be centrally located in the Park and out of the Stream Margin area. The pump house is proposed to be located near the river, within the Stream Margin Area. Both are subject to an SPA Amendment, but only the pump house is subject to Stream Margin Review. The Parks Department reviewed the location and plans'with City Council prior to moving forward with this land use application and the building permit. City Council reviewed and gave the Parks Department direction to move forward with the proposed location and design. The restroom building is located so as to not disturb the trail alignment, water ponds, or existing field. It will include separate men's and women's facilities connected by a breezeway. The toilets will be composting toilets. The restroom will measure 17 feet 11 inches from finished floor to the peak of the roof on the restroom facilities. The footprint is 739 square feet. The pump house is being built into the ground near the river. Essentially, only the east elevation will be seen. The structure measures 13 feet 4 inches from finished floor to the top of the parapet. The footprint is 224 square feet. STAFF EVALUATION: Staff finds that the request meets the requirements of an Insubstantial SPA Amendment and an Exemption to Stream Margin. The proposal locates the two structures to minimize impact on the park activities, while placing them in locations to serve their functions. The pump house is located to ensure gravity can assist the irrigation function. The restroom building is centrally located to serve users of the park without impacting the existing trail or field facilities. These facilities represent a minimal increase in ground coverage. Because of these challenges I will support a variance to our stream margin requirements. However, as a recommendation, I am still suggesting that you try everything to locate the pump house outside of the 15 foot stream margin buffer area. The purpose is to provide the minimal amount of protection to the river. Trish Aragon, P.E. City Engineer 130 S. The program requirements of the restroom building and pump house space dictated that we had to split the building programs early this year in order to fit the restroom structure with the existing field, trail alignment, and water quality pond alignment needs. We have proposed the pump house location as submitted for the following reasons: The pump equipment we're utilizing for the park irrigation has to be lower than the intake point (to eliminate cavitation or priming issues with the pump system). The intake point will be at the bottom of Pond 5 (cleanest water), and we need to establish an 8' minimum water depth above the intake point. The regular pond elevation of Pond 5 (7865.0) very much dictates the location of the pump house. i The pump house footpi,.it has been minimized to 224 sq. feeL but still needed to be sited in a location that had long term vehicular access for maintenance needs of the pump and fertigation system (future replacement). This operations requirement meant that we had to site the structure near/adjacent to one of the trails in the park. The pump system needed to be sited in a relatively central location relative to the east and west sides of the park to equalize the irrigation distribution network as much as possible. We are maximizing the basin areas for Pond 5, Pond 6 and the connecting water bodies for the Mill Street water quality goals. We don't have the ideal capacity on the west side of the park for the Mill Street system, which is why we're going to be maximizing the potential water quality benefit of Pond 6, meaning the park area west-northwest of Pond 5 will be basically utilized for water quality needs, or the re-aligned trail. The pump house is obviously a very utilitarian use/need for the park. That utilitarian/need at the park will generate a fair bit of noise when the pump system is running. As a result, the building structure has been designed to mitigate sound, which is why it is proposed to be built into the land form on the north-northwest side of the Theatre Aspen back-of-house area. We are also trying to ensure that the location of the pump house and pump system operation does not adversely affect the theatre operations. Our thinking is that this `bunker' style structure reduces the amount of mass visible and projecting above the current finish grades in addition to the sound mitigating qualities of the structure. Because the structure is designed as a `bunker' style structure set into the land form, a green roof has been designed to further mitigate the impact of the structure from both a water quality perspective and aesthetic perspective. Cost—everything we're doing at Rio Grande is a balance between obtaining great built results and working within available budget. By siting the pump house where we have proposed, it is relatively close to our 3-phase power supply transformer, minimizing cost for longer power runs (a factor given the power requirement of the pump system). By building the building as a `bunker,' money is saved by eliminating one and about 1/3 of two other exterior fenestrated walls. Most of the currently existing tree masses are intended to remain, which created a constraint for some of the other locations we evaluated, given the excavation required for all of the pipe and power line connections. I hope I've answered your question sufficiently; if not let me know and we can discuss further. The provision of an appropriate public restroom building at Rio Grande Park is necessary given the public use of the park spaces. The proposed public restroom has been sited in a park-central location. The restroom's proposed central location provides restroom access for all of the active, passive, trail and theatre users in the park. The proposed park-central location also allows the small footprint of the building e setting"of rgnrt d , effectively, the scale of the ma building. The build ng' mallootP nt and s m le gabled form reharmo iou s in scale to the nearby theatre tent structure and land forms within the park. The building design was presented to City Council on March 28, 2012, where Council approved the proposed central location of the restroom building but requested further design detail relative to the building, specific to size and scale. On April 16, 2012, Council reviewed alternate restroom building designs m work a session and provided_a unammous approval for theiuitdmg design r option presented in this land use /SPA Amendm , , .-rA ,. ..._.- application and provided approvalforutilization of composting toilets. During the March 28, 2012 wor mm session, Council also approved development' of a non-potable irrigation system infrastructure, including a proposed irrigation pump house building. The restroom is envisioned to be a highly sustainable building that will integrate design features intended to reduce the overall impact of the building's use on the greater environment. Notable design features include compostable toilets, photovoltaics, grey water discharge gardens, and reuse of river cobble in exterior gabion wall cladding. The pump house building is required to house an irrigation pump system necessary to remove Rio Grande Park from potable water use for park irrigation purposes. The structure has been sited within an area of the park that allows gravity to assist in the function of the irrigation pump system and allows the opportunity to build the structure into an existing slope. The `bunker' type design allows the visual and audible impacts of the pump house building to be minimized from various perspectives. The overall footprint of the structure has been reduced to be most efficient and still meet the operational needs of the pump system. Both the proposed public restroom building and non-potable irrigation pump house building at Rio Grande Park are purposeful structures intended to have an understated but quality design presence within the greater naturalistic environment of Rio Grande Park. Rio Grande Park Restroom Building—Park Setting Sketches (2) Following is an explanation of how the proposed development complies with the review standards relevant to the development application: Sec. 26.435.040.B.3 ESA-Stream Margin Review Standards B. Exemptions. The Community Development Director may exempt the following types of development within the stream margin review area: 1. Construction of pedestrian or automobile bridges, public trails, or structures for irrigation, drainage, flood control or water diversion, bank stabilization, provided plans and specifications are submitted to the City engineer demonstrating that the structure is engineered to prevent blockage of drainage channels during peak flows and the Community Development Director determines the proposed structure complies,to the extent practical, with the stream margin review standards. Response: The proposed irrigation pump house structure's purpose is for housing an irrigation pump system necessary to irrigate all of the green space and playing field area within Rio Grande Park, aka `structure for irrigation, 'as referenced above. The pump system and associated pump house structure are necessary to eliminate the use of potable water for irrigation purposes at Rio Grande Park. 3.c The development is located such that no portion of the expansion, remodeling or reconstruction will be any closer to the high water line than is the existing development; Response: The proposed restroom building is further away from the high water line than the existing nearby theatre tent structure (development). The proposed restroom building location ranges between 264'to 317'from the 100 year flood plain/high water line along the Roaring Fork River. 3.e The expansion, remodeling or reconstruction will cause no increase to the amount of ground coverage of structures within the 100-year flood plain. Response: The proposed restroom building development is outside of the 100 year flood plain area and as such does not increase the base flood elevation. See attached flood plain map. Page 2 of 4 See. 26.440.090.A Amendment to Development Order A. Insubstantial SPA Amendment. An insubstantial amendment to an approved development order for a final development plan may be authorized by the Community Development Director. The following shall not be considered an insubstantial amendment: 1. A change in the use or character of the development. Response: The proposed restroom building and proposed irrigation pump house building do not change the use or character of Rio Grande Park. Irrigation of the park currently occurs with potable water and irrigation times are scheduled to minimize conflict with park use. The proposed non potable irrigation pump system and structure will enable irrigation water to be applied more efficiently, thereby reducing the potential conflict between park irrigation and park use. Portable, temporary restroom facilities are currently present at Rio Grande Park, but are generally insufficient for the levels offacility use resulting from the public. 2. An increase by greater than three percent(3%) in the overall coverage of structures on the land. Response: The overall area of the park is 563,904 square feet. The current overall coverage of structures on the park currently is 7,000 square feet (1.2% coverage area), created by the theatre tent and lobby structure. The proposed restroom and pump house buildings will add 963 square feet of structure coverage which is a 0.2% increase in overall coverage of structures on Rio Grande Park, resulting in a total of 1.4% total coverage area. 3. Any amendment that substantially increases trip generation rates of the proposed development of the demand for public facilities. Response: The proposed restroom building and proposed irrigation pump house building will not substantially increase trip generation rates to Rio Grande Park. The restroom building will address the current need for a public restroom facility. The irrigation pump house building will not be accessible by the public and therefore will not affect an increase of trip generation rates into Rio Grande Park. 4. A reduction by greater than three percent(3%) of the approved open space. Response: The park area is 563,904 square feet. Tr sed restroom footprint is_ 739 square feet and the proposed irrigation pump house footprint is 224.square„f „ "The additional building area from the restroom and pump house buildings equates to 0.002% coverage of the park area, which does not exceed a reduction of greater than 3% of the approved open space/park area. Page 3 of 4 5. A reduction by greater than one percent(1%) of the off-street parking and loading space. Response: The proposed restroom building and proposed irrigation pump house building will exist within Rio Grande Park and will have no impact to off-street parking or loading spaces since parking or loading spaces do not exist within the park. 6. A reduction in required pavement widths or rights-of-way for streets and easements. Response: Both the restroom and pump house building are not located adjacent to streets and do not have any impact or cause any reduction to street pavement widths or rights-of-way. 7. An increase of greater than two percent(2%) in the approved gross leasable floor area of commercial buildings. Response: No leasable commercial buildings are located within Rio Grande Park. Both the restroom and pump house building have no impact to any commercial building leasable floor area. 8. An increase by greater than one percent(1%) in the approved residential density of the development. Response: No residential structures are located within Rio Grande Park. Both the restroom and pump house building have no impact to any residential density. 9. Any change which is inconsistent with a condition or representation of the project's original approval or which requires granting of a further variation from the project's approved use or dimensional requirements. Response: No uses outside of women's and men's public bathrooms for an effective restroom building and containment of a non potable irrigation pump system for the pump house are being proposed or contemplated. Galena St. Aspen, CO 81611 Dear Mr. Bendon: I was asked by Scott Chism of the City Parks Department to provide an opinion regarding the ownership of property upon which the City proposes to construct a restroom building and pump house. I have reviewed the documents associated with the acquisition and ownership of the subject property. I am an attorney licensed to practice law in the State of Colorado. City of Aspen intends to place a restroom building on property located at 460 Rio Grande Place and a pump house at 480 Rio Grande Place. The parcels upon which the restroom building and pump house will sit were acquired by the City of Aspen pursuant to three separate transactions and are now all part of the Rio Grande Park. The transactions are as follows: 1. Deed from James R. Trueman to the City of Aspen, recorded on September 17, 1973, in Book 279 at page 745; and 2. Deed from Fitzgerald, et al., to City of Aspen, recorded on December 29, 1978, in Book 361 at page 70. 3. Deed from County of Pitkin to City of Aspen, recorded on September 1, 1982, in Book 432 at page 114; and In conclusion, it is my opinion that the property upon which the City intends to construct a restroom building and pump house on the Rio Grande Park is owned by the City of Aspen, there are no mortgages, judgments, liens, easements, contracts and agreements affecting the parcel, and the City of Aspen has the right to proceed with the development of this parcel. The Park is part of an SPA, and any development requires an SPA Amendment. Both structures qualify for an Insubstantial Amendment, which is reviewed administratively. The applicant should including information on the size, height, and purpose of the structures as part of the application, In addition, the Roaring Fork River cuts through the park. The pump house is proposed to be located in the stream margin review area. However, the pump house qualifies for an exemption from the section as a "structure for irrigation, drainage, flood control..." Review by the City Engineer indicating that the structure is engineered to "prevent blockage of drainage channels during peak flows" is required. This is included as a referral, below. It is unclear if the proposed location of the restrooms are located within the stream margin review area. The applicant must provide this documentation as part of the application. If the restroom is located in the stream margin review area, it is subject to a full stream margin review, pursuant to section 26.435.040.C. This is an administrative review.
