SUMMARY:
The applicant requests an Insubstantial PUD Amendment to amend the shape building envelope
of Lot 8 to include improvements that were made outside of the existing building envelope. The
size of the newly configured envelope does not change.
STAFF EVALUATION:
The proposed change to amend the envelope meets the review criteria for an Insubstantial PUD
Amendment (Exhibit A). The change proposed is minimal, does not alter the lot size, and
incorporates existing improvements that were made outside of the building envelope into the
newly configured building envelope to meet the requirements of the Moore Family PUD and the
Land Use Code. The approved plat is recorded with the Pitkin County Clerk and Recorder at
reception number 596529.
DECISION:
The Community Development Director finds the Administrative Application for an
Insubstantial PUD Amendment as noted above and on Exhibit A to be consistent with the
review criteria (Exhibit A) and thereby, APPROVES the request.

Section 26.445.100 Amendment of PUD development order
A. PUD Insubstantial Amendments.
An insubstantial amendment to an approved development order for a final development
plan may be authorized by the Community Development Director. The following shall
not be considered an insubstantial amendment:
1. A change in the use or character of the development.
There is no change in the use or character of the building.
2. An increase by greater than three percent (3%) in the overall coverage of structures on
the land.
The there is no increase in coverage.
3. Any amendment that substantially increases trip generation rates of the proposed
development or the demand for public facilities.
Trip generation and demand for public services will not be impacted by this amendment.
4. A reduction by greater than three percent (3%) of the approved open space.
There is no change to the open space.
5. A reduction by greater than one percent (I%) of the off-street parking and loading space.
There is no change in the parking/loading space.
6. A reduction in required pavement widths or rights-of-way for streets and easements.
There is no change in the ROW'S widths, streets or easements.
7. An increase of greater than two percent (2%) in the approved gross leasable floor area of
commercial buildings.
There is no gross leasable floor area.
8. An increase by greater than one percent (1%) in the approved residential density of the
development.
There is no increase in residential density.
9. Any change which is inconsistent with a condition or representation of the project's
original approval or which requires granting a variation from the project's approved use
or dimensional requirements.
The change is consistent with the approved use and does not require a dimensional
variation. The change incorporates existing improvements that were made outside of the
building envelope into the newly configured building envelope to meet the requirements
of the Moore Family PUD and the Land Use Code.

Overall,this is a very well detailed plat. But,there are a few engineering requirements missing from the plat. Please see
below:
1) Error of closure shall be 1/15,000.
2) Survey shall be tied to two (2) COA monuments. GPS control monumentation dated 12/2/2009.

3) One foot contours with datum of elevations.
4) Identify Natural hazards if they exist. (Areas that constitute natural hazard areas including but not
limited to snow slide, avalanche, mudslide, and rockslide, as identified by the City on the
2001 Surface Drainage Master Plan and the 2009 Percent Slope Map. Differentiate areas
with slopes from 30%to 40%and areas with slopes greater than 40%. Areas with slopes
from 30%to 40%and areas with slopes greater than 40%will require a slope stability
study performed by the Colorado Geological Survey (800-945-0451).)

DESCRIPTION: The prospective Applicant would like to reorient the building
envelope on the property located at 864 Moore Drive to include
some improvements that were made outside of the building
envelope. The newly configured envelope does not increase or
decrease the approved square footage of the existing envelope. It
is strongly suggested that the draft PUD plat amendment include
different types of hatching to indicate the existing and the proposed
building envelopes. This qualifies as an insubstantial amendment
that is processed administratively.
The lot is part of a Planned Unit Development (PUD) and PUD
Amendment approval is required to modify the PUD. Approval to
apply for the amendment shall be provided by the president of the
Homeowners Association.

the owner's right to apply for the Development Application.
4. Completed Land Use Application.
5. Signed fee agreement.
6. Pre-application Conference Summary.
7. An 8 1/2" x 11" vicinity map locating the subject parcel within the City of Aspen.
8. A site improvement survey that includes all existing natural and man-made site
features, including trees, and separate hatching to indicate the existing and
proposed building envelopes.
9. A written description of the proposal and a written explanation of how the
proposed development
complies with the review standards relevant to the development application.
10. All other materials required pursuant to the specific submittal requirements.
11. Applications shall be provided in paper format (number of copies noted above)
as well as the text only on a CD.

Section 8 - Written Description and Explanation of How the
Amendment Complies with Review Standards
Sec. 26.445.100. Amendment of PUD
The proposed minor revisions to the building envelope at 864 Moore Drive reorients
the existing building envelope on the property to include some improvements that were
made outside of the building envelope. The newly configured envelope does not
increase or decrease the approved square footage of the existing envelope. As a
result the proposed insubstantial amendment:
1. Does not change the use or character of the development.
2. Does not increase the overall coverage of structures on the land.
3. Does not increase trip generation rates of the proposed development or the
demand for public facilities.
4. Does not reduce the approved open space.
5. Does not reduce the off-street parking and loading space.
6. Does not reduce required pavement widths or rights-of-way for streets and
easements.
7. Does not increase the approved gross leasable floor area of commercial
buildings.
8. Does not increase the approved residential density of the development.
9. Is consistent with the project's original approval, the approved use, and
dimensional requirements.
