SUMMARY: The Applicant received approval in 2012 for three (3) Residential Design Standard Variances related to the relocation of a L'Auberge Cabin on the property (Reception# 592857). The variances were for Secondary Mass, Entry Door, and Covered Porch. The cabin is approximately 320 square feet, and the applicant was interested in placing it on their Lot in the same manner it existed on Main Street. The building did not have a porch element, the entry door was accessed off the side of the cabin rather than the front, and the cabin did not have a secondary mass. The Applicant has prepared to submit for a building permit, and has found the need to create a stronger foundation than was originally anticipated. This has also led the Applicant to add a small porch with a street facing entry door onto the cabin. The added entry door now meets the residential design standards. The porch does not meet the size requirements in the code, and is therefore requesting a variance from the following code section: "A covered entry porch of fifty (50) or more square feet, with a minimum depth of six (6) feet, shall be part of the front facade. Entry porches and canopies shall not be more than one (1) story in height. " (Section 26.410.040.D.1.b, Entry Porch) STAFF EVALUATION: Staff supports the proposed variance for Lot 2 of the Hume Lot Split. The cabin is a relatively small structure of 320 square feet, and adding a 50 square foot porch will overwhelm the structure. The Applicant is meeting the intent of the standard, which is to create entry porches and front doors in an effort to create a pedestrian friendly neighborhood. Staff finds that the variance is appropriate based on the_neighborhood context. This is a relatively small, one-story building that will contribute to the pedestrian nature and scale of the neighborhood. The added porch element of approximately 26 square feet meets the intent of the design standard. Staff finds the standard to grant an administrative variance is met. DECISION: The Community Development Director finds the Residential Design Standard Variance as noted above and on Exhibit `A' to be consistent with the review criteria (Exhibit B) and thereby, APPROVES the variance as specified below. The Hume Lot Split is located along Lake Avenue [see vicinity map shown on proposed site plan]. The Pitkin County Parcel ID #for Lot 2 is 273512128002. To the best of our knowledge a street address has not been assigned. The application is being submitted by EFH Holdings, LP, the owner of Lot 2 [hereinafter, "the applicant"]. Proof of the ownership of the property is proved in the form of a Warranty Deed to the property [see Exhibit 1]. The applicant has designated Ellen Hunt as its representative for this application [see the letter attached hereto as Exhibit#2]. The applicant is proposing to relocate onto Lot 2 one of the small, original cabins that was recently removed from the Auberge Inn. However, in order to do so, the applicant must first comply with the City's residential design standards as specified in Section 26.410.040 of the Land Use Code. The applicant has reviewed the applicable residential design standards with the staff and has determined that the cabin can comply with most of the design standards. Approval was received for the three Residential Design Standard Variances for Lot 2 of the Hume Lot Split, Aspen, CO, from secondary mass, front door and covered porch standards. Since that approval, the applicant has discovered that the original pitch of the roof and low plate height of the cabin will cause a snow hazard. A covered porch and entry area are necessary to eliminate this risk. The new design will now include a covered porch. With the proposed change, the property will no longer require the variance for an entry door, but will require a variance from the porch standard (26.410.040.D.1.b). because it is not large enough. This application can be processed administratively. Please note that a portion of this lot is located with the Hallam Lake Bluff Review area. Any development proposed in this area will require a Hallam Lake Bluff Review by the Planning and Zoning Commission. Based on the pre-application meeting, staff believes the cabin is proposed to be relocated outside of the Hallam Lake Bluff area. Confirmation of this is required as part of the application.
