North Street: Setback variance DATE: August 3, 2006 SUMMARY: Theodore and Isabella Dalenson, owners of the property at 637 W. North Street Unit A, are requesting a setback variance for an extant building that encroaches into the rear yard setback. The building currently sits approximately 14 or 15 inches into the alleyway, and the applicant is requesting a variance of 18 inches from the five foot rear yard setback required for an accessory building within the R-6 Zone District, per section 26.710.040 (D)(5). The city approved permit plans for the new construction on the property, which did not illustrate an encroachment into the rear yard setback. The applicant assumes responsibility for the mistake and legal proof is provided that the encroachment was an unintentional error by the surveyor. Subsequent to approval by the BOA, the applicant would be required to apply and gain approval for an Encroachment License through the City Engineer. ApPLICANT: Theodore and Isabella Dalenson, represented by Jody Edwards, 201 North Mill St., #203 Aspen, CO 81611. LOCATION: 637 W. North Street. ZONING: R-6. REVIEW PROCEDURE: Variances may be approved by the City of Aspen Board of Adjustments, pursuant to Land Use Code Section 26.314.020, utilizing Standards Applicable to Variances, 26.314.040. STAFF COMMENTS: The encroachment into the alley did not receive approval. Granting a variance for unapproved construction after completion is not consistent with the purposes, goals, objectives and policies of the Aspen Area Community Plan. -- Exhibit A Review Criteria & Staff Findings Variance from Dimensional Requirements (Rear Yard Setback) Moderate Density Residential (R-1SB) 26.710.070(0)6 Minimum rear yard setback: Residential dwellings: Ten (10) Accessory buildings and all other buildings: Five (5) 26.314.040 Standards applicable to variances. A. In order to authorize a variance from the dimensional requirements of Title 26, the appropriate decision making body shall make a finding that the following three (3) CITcurnstancesexi&: I. The grant of variance will be generally consistent with the purposes, goals, objectives, and policies of the Aspen Area Community Plan and this Title; Staff Findinl!:: The Aspen Area Community Plan relies on zoning regulations to maintain the character of the built environment. The statement of "philosophy" under the Chapter, titled "Design Quality" states: "Zoning, our primary means of shaping the built envITonment, must encourage appropriate and lively design." Zoning dimensional standards, such as setbacks, height, and size, also help to establish a pattern of development that is appropriate for certain neighborhoods by reinforcing the public realm and streetscape. This variance would result in the portion of a garage within the rear setback. Alleyways are inherent to the dynamic character of Aspen; therefore staff fmds the proposal is not consistent with the purposes, goals, objectives, and policies of the Aspen Area Community Plan. Stafffmds that this circumstance [26.314.040(1)] does not exist. 2. The grant of variance is the minimum variance that will make possible the reasonable use of the parcel, building or structure; Staff Findinl!:: Staff fmds that the "reasonable use of this parcel" can be achieved without a variance. Bringing the garage into compliance will not impact the ability to utilize the garage as a legal parking space 3. Literal interpretation and enforcement of the terms and provisions of this Title would deprive the applicant of rights commonly enjoyed by other parcels in the same zone district, and would cause the applicant unnecessary hardship or practical difficulty. We reviewed the variance request with them and their architect Scott Lindenau of Studio B Architects and have no grievance towards what they are requesting. In fact, before the project was constructed, there was an unsightly utility pole that served both their property and ours that was located partially in the alley. With the construction of this project, it was relocated further down the alley away from sight and has made the alleyway safer and less obstructed. They have managed to preserve many trees on the site and the minor encroachment into the alley setback does not in any way negatively impact services in the alley, snow plowing nor our property. Based on scaling the distance of the encroachment on the Plat, I believe the encroachment is 14 or 15 inches into the setback.
