Cooper Avenue, ASPEN,COLORADO. WHEREAS, Larry Ledinqham/Norma Dolle have made application, dated September 19, 1995 to the Board of Adjustment for a variance from the dimensional requirements of Chapter 24 of the Aspen Municipal Code; and WHEREAS, this matter came on for hearing before the Board of Adjustment on this date and after full deliberations and consideration of the evidence and testimony presented. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF I /) / ADJUSTMENT OF THE CITY OF ASPEN, COLORADO: Section 1. Findings of Fact. The Board of Adjustment makes the following findings of fact: 1. A development application for a variance was initiated by: Larry Ledinqham/Norma Dolle on: September 19, 1995 for property with a street address of: 124 E. Cooper Avenue and legal description of: Block 69, Easterly 1/2 Blk P and all of B1k 0, Aspen, Colorado 2. Notice of the proposed variance has been provided to surrounding property owners in accordance with Section 24-6-205(E) (4)b) of the Aspen Municipal Code. HEARING DATE \() - 1.2-'lC::: , ' SNOW QUEEN WooE 9/ 25/95 Clarification and extension of previouslv l!ranted setback variance. My Mother and I have owned and run the Snow Queen Lodge since 1973. I have been living in lodge rooms on the premises for 22 years. Three years ago, we decided to build an apartment on the back of the lodge. The purpose of this deed restricted apartment was a decent place for me to live. We first came before this board on May 27,1993, with tentative plans, to request a side yard setback. Since construction began, there have been many problems and delays. Due to a lack of confidence, we discontinued our relationship with our original builder. Our new contractor, Jeff Feen, made us aware of the incompetence of several previous tradesmen on the job. We have had to correct numerous structural and floor plan construction problems. We have gone back to the building department and P&Z to amend several inconsistencies and are now back on track This brin2S us to our reauest for an extension of the orilrinal variance: 1 We originally asked for a setback of 1.4 feet from the property line, ( an encroachment of3 feet 6 inches into the 5 foot setback), for 36 feet in length and were granted 33 feet In actuality 14 feet 2 inches of that was an existing wall since 1917. My apartment will extend 25 feet beyond the existing lodge. Of that, 17 feet 2 inches was approved in our first meeting with the board, Since then, I have decided to enclose my deck, (P&Z approved). We are asking to extend the variance to 25 feet, ( additional 7 feet 10 inches), to match the exterior wall of my enclosed deck ~. The dimensions of the corner we would like to enclose are 3 feet 6 inches by the 7 feet 10 inches of extended variance. This 28 square feet, (increased FAR), has been approved by P&Z. J This apartment is oflirnited space. By combining the 28 square feet with the enclosed deck we can create a more efficient floor plan and a much more reasonable use for the kitchen! living area. The existing interior 90 degree corner creates a practical difficulty from which we are seeking relief :! Our alley is full of houses and apartments that do not seem to contorm to any rhyme or reason. Our rear lot setback has been approved by P&Z. We have structurally cantilevered the deck so as not to affect parking. We have even added one parking space. The rear exterior wall line of the second floor is still inside the rear wall line of the lodge next door. 2. The fire egress window in the basement is directly below the comer we want to enclose. This enclosure would give us a roof over this exterior window well alleviating a snow build- up problem. It would allow safe egress year round. !i. Enclosing this 28 square ft. corner to match the side wall and new exterior rear wall of the second floor will look more architecturally correct and asthetically pleasing.
