COLORADO REQUEST FOR VARIANCE Our home situate on Lots II. 12 and 13, Block 98. Hallam's Addition. City and Townsite of Aspen. which is a non-conforming lot of record and is a trapezoidal shape. requires a variance due to siting of the existing dwelling and the change in setbacks over the years. The standard setbacks in the City Code are designed for typical City lots. 30 x 100 feet. Our Hallam Addition lots are 25 x 68 on the West side (6th St.) and 25 x 77.87 feet on the East side. The present Code setbacks bisect the existing dwelling. passing through the existing family room (which will become an Affordable Dwelling Unit). living room and proposed extension of the living room, as well as the second floor addition. When the house was constructed in 1957, by the present owners. it met all setbacks. Empty lots and one-story dwellings were in the neighborhood. Since that time. all new units have been two-stories and a second story has been added to many of the one-story originals. We are asking to add a small addition and a second story. The increase in setback requirements is a hardship for the owners. who have resided therein for 38 years and now wish to update and expand the dwelling as well as add an Affordable Dwelling Unit to provide housing for one of our employed children. Since this is a comer lot, which is a non-conforming lot of record. we are requesting variances allowing projections into the setbacks as follows: FRONT YARD SETBACK (North Street): Tapering from 9 feet at the new addition on the West (6th Street) side to 19 feet at the new porch on the existing entry, to allow the addition of a living room. ADU and porches. WEST (SIXTH STREET) SIDE: 1.8 feet. REAR YARD SETBACK (ALLEY): 3.5 feet to allow the extension of an existing storage shed into a garage accessed off the alley. EAST SIDE: The storage unit shown on the plans will be removed to bring the sideyard setback into compliance. As shown on the enclosed City map, none of the homes in the 600 block on North Street and the 700 block on North Street, some of which we believe were remodeled or built since 1988. meet this 25-foot front yard setback.
