(The second floor addition does not encroach on the 5 foot side yard setback area). I cannot guarantee but I am sure these Plans were studied by the City; Of Aspens , Engineering Department prior to approving the plans that allowed this construction (Sloped Roof) and second floor . 1. Flat roof snow weight amounts to 75 lbs.l sq.ft. 2. Sloped roof will eventually shed excessive snow to prevent snow weight build up, 3. A sloped roof with a Heat tape should add 0 (Zero) lbs. "'" per square foot FAILURE FOR YOU TO APPROVE mE CONSTRUCTION AS IT PRESENTLY STANDS~ALTER 1HER~~'MUfWM"~d'U STRUCTURAL AND ENGINEERING PROBLEMS TIIA T WILL CAUSE A SEVERE FINANCIAL BURDEN AS WELL AS A MAJOR HARDSHIP IN A PROJECT THAT HAS ALREADY BEEN VERY DIFFICULT TO BRING INTO BUILDING CODE C~<; C. ASTIlETIC VALUE. The Elevation in question is next to Mrs. Paepcke's garden. one of the prettiest corners in the West End District. My house as presently constructed with the sloped roof is in keeping with approved Victorian designs in this city. Not allowing this roof to remain will result in an ugly structure which would make the second floor stand out like a.. "Sore Thumb" and not blend in with the rust floor~. Thus making an ascetically unpleasing background for Mrs. Paepcke's garden. Certainly it would make some visitors, tourists, wonder !\ ~i . ~~"': . .." ... . '? why the city allowed such construction, ('Ibis House is on the Walking Experience Route). D. As the Board Of Adjustments is concerned with conformance to the building codes and I admit that I do not know all the laws and rules but I do feel that this sloped roof has been built over a flat roof in an area that was granted a Variance in previous years. This sloped roof does not add one inch to this previously approved Variance Area. In other words the eves of this roof do not extend any further than what was allowed for the original old flat roof construction. E. NEIGHBORHOOD PEACE ~ I____ 'IlM!HlEEN ACHIEVED with the addition of a Heat Tape to this area. Nl'n Plltpcke, who as I stated helped obtain the Variance for this addition many years ago, has over the years became concerned with snow falling on her flOweI1liFirst from.; the flat roof as snow was shoveled off to reduce the roof load., Then later as the snow fell of the sloped roof.: AREA T TAPE PLACED ON THE EXISTING SLOPED ROOF WIIJ.. CORRECT BO'llI OF THESE PROBLEM1l BY PREVENTING ANY SNOW FROOM FALLING ON MRS. PAEPCKE'S PROPERTY. (A Heat Tape on a flat roof will be of no value and returns the snow problem to the previous situation.). PLEASE NOTE;" Mrs. Paepcke is in very poor healtb presently. I am sure she would have written me a letter had she been feeling better. I, as important as this is to me, did not feel I should concern her regarding this matter. I also consulted with her attorney, Mr. Jim Moran.. who agreed with my decision. Mr. Moran, also mentioned that he was sure the problem was all resolved regarding Mrs. Paepcke. He further mentioned that during the law suit between Artes-Roy vs Mrs Paepcke that he attempted to have this same slop[ed roof removed and he was informed by the City that it was an approved structure and that it couldn't be removed. III. My understanding of, Mr. Bill Drueding's concern IS that this existing variance cannot be found in the city files. I have also attempted to find the missing variance but I too have been unsuccessful. However I do have the written testimony of Mrs . Paepcke that she actually went to the City Hall with Mrs Patsy Forbes to obtain this now missing variance. 1 point out,and I know that you are aware, that when Mrs. Paepcke and Mrs. Forbes obtained this Variance, Aspen was a "Small Town". Mrs. Paepcke has done much for this city. As long as she agreed to this side yard variance--the Variance was granted.. Further, and I believe it is common ~. that. UlCOrd keeping was not as accurate as it is now aacI,- over the years througb misfiling etc. this approved Variance is lost somewhere in the cities archives,. Mr. Drueding's concern than is if the Variance can not be found then possibly the added room and flat roof were built illegally--but are allowed through the "Grandfather Provision" of the building code. How- ever any new addition to this area, ie. a sloping roof would not be al- lowed. I can understand, Mr Drueding's, position, but with Mrs. Paepcke's statement that she helped obtain the Variance, should I be punished because the city of Aspen's filing system of years pat has misplaced the approved variance? IV. ONE ADDITIONAL COMMENT. This house-previously known as, Artes-Roy House, was a real problem to the City Of Aspen. A multi-million dollar law suit and counter suit were involved. I bought the house and I have remedied all the problems that concerned the City Of Aspen. In most cases I did more than what the city required of me. For instance: The city required me to electrically rewire the new addition. I rewired the whole house, the new and old portions, etc. I have cooperated with the City in every phase of the correction work. I even allowed a key witness for the city, Gary Lyman, to video tape the mechanical building infractions as they were uncovered thus making a very strong case for the city and may have helped in Artes-Roy dropping his law suit against the city. Thus saving the City of Aspen hours of legal fees, court costs,and many thousands of dollars. Through all this repair I have not asked for one favor from the city--I'm sorry that I have to ask now but the financial burden to correct this problem would be very difficult for me. V.~' . A Variance does ex~t. A sloped roof was built above an old existing structure AFTER Aspen Building Department approved plans and engineered drawings allowing this sloped roof. Further I will improve this roof by the addition of a Heat Tape to protect my neighbors properties as well as for my own protection and safety by keeping the snow load off this roof. 1- I therefore respectfully ask this Board of Adjustment to allow the roof to remain as presently constructed and approve my application. BOARD OF ADJUSTMENTS! ASPEN I am in posession of a letter from, Mrs. Paepcke, where she states, "When Mrs. Patsy Forbes, bought the property (126 W. Francis) she said she needed more room to house the nursey school she contemplated. I allowed her to extend the living room (presently the dining room) wall to within 3 feet of my fence. The building code required 5 feet from house to fence. '"'" NO. 001 / RE: PETITION OF KINGSBURY PITCHER ) REQUESTING SETBACK VARIANCE. ) ORDER The Board of Adjustment for the City of Aspen convened August 28, 1956, at the City Hall, to consider the Petition of Kingsbury Pitcher requesting approval of the Board to extend within three (3) feet of the adjoining lot line on the west side of the property described herein. The Board FINDS: 1. That due notice was given as required by Ordinsnce No.6 (Series of 1956), 2. That Kingsbury Pitcher is the owner of: East one-half of Lot L and all of Lot M, Block 55, City and Townsite of Aspen, CoudJ of Pitkin, State of Colorado, said property lies in the Tourist Zone. 3. That Mr. Pitcher started construction prior to the effective date of Ordinance No. 6 (Series of 195~ and that the structure is less than five (5) feet fran the west sideline of his property, 4. That exceptional conditions exist and unnecessary hard- ship would result due to the construction heretofore. Elizabeth Paepcke and me not appearing before you personally at the public hearing on the above cited matter. Mrs . Paepcke is physically indisposed, and I am out of the country. Mrs . Paepcke has lived at 414 N. 1st street since 1953 , and as owned the lot at the corner of 1st and W. Francis since that time. I lived in Mrs. Paepcke ' s house for the ten years from 1975-1985, and have frequently been at the house since that time. Therefore , like Mrs. Paepcke , I am very familiar with the Manclark property and the variance request before you today. While Mrs . Paepcke does not wish to be unreasonable in opposing the variance request, she feels that the intrusion of the roof line into the setback puts her adjacent property at risk from the impact of snow runoff damaging her landscaping. Additionally, Mrs . Paepcke and I both feel that variances to side-yard set backs set an untenable precedence , that the City should not be establishing. In support of Mrs . Paepcke ' s request for denial of the variance , I feel that the City, in setting up the HPC during my administration and in attempting to rigorously preserve the character of the West End, has always found itself under siege from landowners who felt that could violate the code and then plead hardship before the Board of Adjustment. While , the Manclarks did not create the intrusion, they unfortunately have to deal with the problem. However, I feel strongly that it is in the City' s and Mrs . Paepcke ' s best interest that the request for the variance be denied.
