NOTICE OF PUBLIC HEARING CASE #90-8 HENRY PEDERSON & CAROL SOFFER BEFORE THE CITY OF ASPEN BOARD OF ADJUSTMENT TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE VARIANCE DESCRIBED BELOW: Pursuant to the Official Code of Aspen of June 25, 1962, as amended, a public hearing will be held in the Council Room, City Hall, Aspen, Colorado, (or at such other place as the meeting may be then adjourned) to consider an application filed with the said Board of Adjustment requesting authority for variance from the provisions of the Zoning Ordinance, Chapter 24, Official Code of Aspen. There will be no additional bulk or mass added to the structure by this interior alteration. The parking in the garage will still meet minimu~ code requ irements. This dilemma has been likened to a "c<J,tch 22", as per Joseph Heller. The potential buyers propose to use the existing dupl<::!x fot' one household. This is a desirable change in a residential neighborhOod, especiallY a:1 historic neighborhOod such as t.he vJes~" End which is se traff ic sensitive. There will be decreased ~raffic by virtue of the property being noW used as a single-owner occupied dupley. This is more in keeping with the charactor of this neighborhood, Though the existing non-conforming size is slightly increased, there are many Co~rJnunicative advantages for the neighborhood; EG: less parking of au~OS around triangle park, less traffic than is now caused by short term rentals of both halves of the duplex and ard.itectural cnanges Which will enhance the existing neighborhood such as a shingle roof instead of metal. The historic charactor 0: the duple>: will become more true and integral though it is not a landmark house. Though this request is not a hardship, it seems so logical and fair to grant it. The additional 150 square feet will be used to widen a narrow, non-conforming hallway (3 feet) to a ccnforminq, more generous 5 feet, The pcopcsed buyers would take some square feet f1.'om two a.dj acent bedrooms. The bedrooms are so narrowed by this addition to the hall that any more bedroom reduction would render the bedroom claustrophoic.
