S'l'AFF. ,- DATE PERMIT DENIED 2/13/89 OFFICIAL n~'l'fo' nr ~ PPJ.Trll'!'Tnn HEARING DATE BOARD OF ADJUSTMENT DEVELOPMENT APPLICATION This Application is pursuant to the Aspen Land Use Code, Article 10, which provides for the granting of a variance which is a deviation from the terms of the zoning chapter which is not contrary to the public interest, when owing to special circumstances or conditions, the literal enforcement of the provisions of the zoning chapter would result in a practical difficulty for the Applicant. This Application is seeking a minimal variance from the dimensional requirements relating to property setbacks. I. sidevard Setback. As shown on the attached site Plan, the variance application deals with the north sideyard. Although the minimum sideyard setback for this property should be ten feet (10') the existing building is non-conforming as to setback. The existing wall (corner) projects two feet (2') into the setback, leaving an eight foot (8') sideyard setback. The unusual roof overhang currently projects fifteen (15) to sixteen (16) inches over the property line into the adjacent lot. There is an existing deck which is under three feet (3') tall, and projects within one inch (1") of the subject property line. The Applicant is proposing to fill in underneath the existing roof overhang approximately 45 square feet into the required setback area. This is the only practical location for the proposed expansion, because of the unusual roof design and configuration of the house on the lot. Pursuant to recommendations from the previous Board of Adjustment hearing, the Applicant is concurrently seeking a lot line adjustment between the subject property and the adjacent duplex lot, also owned by Applicant, to minimize the setback variance as much as possible (the requested variance in only five [5] feet). The planning staff has recommended approval of the lot line adjustment as a consent agenda item upon receipt of Board of Adjustment approval. (See attached pre-application summary.) II. Variance Standards. The Board of Adjustment should find that the following circumstances exist in order to grant this variance request: A. Grant of this setback variance will be generally consistent with the purposes, goals, objectives and policies of the Aspen Area Comprehensive Plan, and Chapter 24 of the Aspen Municipal Code. The proposed expansion will allow a more effective use of this property for the Applicant, who wishes to house her elderly mother and a live-in nurse. The Applicant is a long-time local resident who has been sensitive to the visual impact of her expansion upon surrounding property. The Applicant owns the property immediately adjacent to the subject property to the north, and is remodeling the existing duplex - 1 - there for long-term resident housing. The design for the remodel has been sensitive to, and taken into account, the non-conformance of the existing property and the proposed expansion so that the setback between the expanded corner of the house and the adjacent duplex will be between twenty-three feet (23') and thirty-two feet (32') from point to point. Therefore, the spirit and intent of the zoning dimensions, requiring ten foot (10') sideyard setbacks have been met. B. The request is to allow the Applicant to move the wall seven feet and eleven inches (7'11") further out under the already existing roof overhang. The deck on the north side of the house will be eliminated so there will be no additional projections. This is the minimum variance to make possible the Applicant's reasonable use of her property since, as you can see from the site Plan and elevation, there is no other direction in which to expand the property because of the unusual roof design. Furthermore, this expansion design creates the least amount of additional bulk and mass to the property and remains well within the allowable FAR. As stated above, only eighty-five (85) square feet falls within the setback variance area. C. Literal interpretation and enforcement of the terms of this chapter would deprive the Applicant of rights commonly enjoyed by other parcels in the same zone district. As shown on the site Plan of the Applicant's property, the lot is an unusual configuration, and the house is placed on the lot in such a manner as to make an addition in any other configuration i.mpractical. III. PRACTICAL DIFFICULTY The Applicant i.s seeking this minimum sideyard setback variance because of a practical difficulty which has been created on her lot by various reasons. First of all, the house is situated and configured on the lot in such a way to make expansion and remodel very difficult. Architects and planners have worked on this project for over two years to come up with a viable and architecturally sound remodel which is esthetically pleasing for the neighborhood. As you will be able to see from the architect's presentation at the hearing, the addition which is being placed into the setback variance area has been minimized as much as possible and yet is extremely necessary to make the design work practically and architecturally. At the last hearing, some reference was made to a quiet title action which has been instigated on the southwesterly portion of the Schiff property. The result of the quiet title action is inconsequential to the Board of Adjustment's decision It is important to note that if the quiet title action is successful and the Applicant loses the disputed parcel, Ms. Schiff's southwesterly property line will be relocated, disallowing further further expansion of the house in that - 2 - direction. Furthermore, if the Applicant loses the quiet title parcel, tis variance request becomes moot because Applicant's property would then require only a five foot sideyard setback. As you know, this litigation could last for several years and the applicant should not have to wait for the outcome to determine whether additional expansion can be made in that direction or whether the subject sideyard setback would be effected. There are other issues relating to the property which were created by a previous owner by trading land and creating an odd shaped lot. The Applicant purchased the house with the intent of remodeling it at some point and does not wish, at this time, to demolish the 22 year old structure, instead wishes to work with the existing structure to create a feasible remodel. Many of the problems, i.e., the move in of her elderly, invalid, mother and the quiet title action have surfaced since Ms. Schiff purchased the property in 1986. One major practical difficulty which the house suffers is the inability to house a handicapped person, which the remodel is seeking to correct. It is important to note that the Building Department is requesting that the Applicant remove a spiral staircase that is actually a structural component for the house. One resolution is to bring a stairwell from the landing over to the northwesterly portion of the house. In order to do that, the addition on the northwesterly side of the house is required. This setback variance will help allow the stairwell to be located as required by the Building Department. Furthermore, the variance will allow the Applicant to install much needed insulation in the walls. The Applicant requests consideration of this setback variance to allow a minimum setback variance. The concurrent lot line adjustment has reduced the necessary variance request from 10 feet to 5 feet. IV. Application Contents: 1. We would like the Board of Adjustment to consider the following facts: 1. The Aspegrens and Ms. Schiff are presently in a quiet title dispute over a portion of the Schiff property consisting of approximately 648.5 square feet. A copy of the lis pendens is enclosed with this objection. 2. The Aspegrens have filed the lawsuit seeking quiet title of the portion of the property described as the "overlap" on the map of Aspen survey Engineer's Inc., dated October 29, 1987, that was submitted at the Board of Adjustment hearing on March 23, 1989. 3. We have penciled in with slash marks the disputed area on a copy of the site plan proposed by Ms. Schiff. This illustrates that the property does not comply with the rear yard setback in the event Ms. Schiff loses the quiet title action. 4. The disputed parcel was conveyed first to the Aspegrens predecessor in title and then subsequently to the Schiff predecessor in title. Accordingly, Ms. Schiff has to establish that she has acquired ownership of the disputed parcel by adverse possession. Wben Ms. Schiff purchased the property approximately three or four years ago, she tore down the fence that separated the Aspegren and Schiff properties, moved the fence over to its present location on what she contends to be her property line. Under these circumstances, it is our opinion that she will not be successful in establishing adverse possession because she has to show exclusive use and control for at least seven (7) years, plus the payment of taxes. 5. We believe this variance request is improper because it is not requesting a variance for the rear yard setback. We believe that this is an attempt by Ms. Schiff to build the maximum amount - -- Board of Adjustment June 15, 1989 Page 2 of floor area on the property that is permitted before she loses any claim that she has to the disputed parcel. It is our understanding that Ms. Schiff is not requesting a rear yard setback variance, so the request should be denied. If you have any questions, please feel free to give me a call.
