MAILED , " '" TO: City of Aspen Board of Zoning Adjustment FROM: Elsa Mitchell Property Owner DATE: June 30, 1988 SUBJECT: 1169 East Hopkins Removel Request Variance for 5' Side Setback (in lieu of 10' - R15) I respectfully request a varience for my property for a side setback of 5'. My property is zoned R-15. The zoning regulations for side setback was changed on May 25, 1988, from 5' to 10'. My design con- sultant, John Randall Wedum, met with Mr. Bill Drueding of the Aspen Building Department on in February, 1988, for a design review of codes and regulations, presenting site plans, floor plans and eleva- tions. Neither Mr. Drueding or my designer was aware of the pending setback change. The plans for an addition for my home were submit- ted for a building permit on June 24, 1988, and the permit was denied on June 28, 1988, due to the seback nonconformance. My designer planned the addition to conform with the 5' side setback as required up to May 25, 1988. If a variance is not granted, the change of setback distance will cause me considerable hardship and difficulty. I believe the addition as designed is a great improve- ment upon the existing house and garage, and is more in conformance with the intent of the zoning than the existing conditions. Mitiqating Factors 1. My designer, Randy Wedum, met with an official of the Aspen Building Department prior to commencing with preparation of construction documents. He was not informed of the pending change to the R-15 side setback. The change to the side setback 1'5' to 10') was the only change to the R-15 zoning regulations, as well as any other zone district except for the R-6 zone district. ~:? 2. My designer was aware of zoning changes to the R-6 zoning regu- lations. But due to lack of significant publicity surrounding the R-15 side setback change, we were not aware of the change until applying for a building permit. 3. My existing garage is 2' from the side property line. The new addition/garage as currently designed is 5' from the side set- back. This change significantly improves upon the side setback. My neighbor to the east, Mead Metcalf, is the only adjacent neighbor directly affected, and he is in favor of the granting of an easement for side setback (see attached letter). The area of the parcel adjacent to my west border is vacant and contains two ponds running along the river. This area is in the hundred year flood plain. For these reasons, it is not buildable. The parcel appears to be built to full density at the far north end of the property and would visually not be affected by this setback variance. (J '" - 1 - .-------< "'... " <;: 4. The R-15 side setback has been 5' for years. I have unfortun- ately been caught in the transition of side setback regulations. My designer and I have taken efforts to research the codes and laws, but the codes changed during the preparation of final plans after our research of codes was complete. Hardships 1. If the Board of Adjustment does not grant the variance as requested, a major redesign of the proposed addition will be required. Such a redesign will be expensive, and I believe an unnecessary hardship for me. Also, we have scheduled the construction with our contractor. If we cannot proceed as planned, we may lose our contractor and this may mean the project will not proceed this year. 2. Should the redesign provide for retaining the existing garage and its 2' setback, my neighbor will be forced to suffer with a structure too close to his property. It is the intent of the zoing ordinance to provide adequate light and appropriate den- sity to residents. It is my goal to move the garage 5' from the property line, thus providing my neighbor more "elbow room" in keeping with the intent and spirit of the zoning ordinance. 3. The quick change from a 5' to 10' side setback effectively deprives me from the same setback and use of my property that others with R-15 zoning having long enjoyed. In conclusion: (A) The granting of a variance will be consistent with the objectives of the Aspen area plan; (B) The granting of a side setback variance for 5' is the minimum that will make possible the reasonable use of the parcel and building; (C) Literal interpretation and enforcement of new 10' side setback would deprive me of rights commonly enjoyed by other parcels in the same Zone District, and would cause me unnecessary hardship and practical difficulty; (D) There are special conditions and circumstances that are unique to this parcel and building, which are not applicable to other parcels, structures or buildings in the same Zone District and which do not result from the actions by me.
