BEFORE THE CITY OF ASPEN BOARD OF ADJUS'l'MENT
TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE
VARIANCE DESCRIBED BELOW:
Pursuant to the Official Code of Aspen of June 25, 1962, as
amended, a public hearing will be held in the Council Room, City
Hall, Aspen, Colorado, (or at such other place as the meeting may
be then adjourned) to consider an application filed with the said
Board of Adjustment requesting authority for variance from the
provisions of the Zoning Ordinance, Chapter 24, Official Code of
Aspen. All persons affected by the proposed variance are invited
to appear and state their views, protests or objections. If you
cannot appear personally at such meeting, then you are urged to
state your views by letter, particularly if you have objection to
such variance, as the Board of Adjustment will give serious
consideration to the opinions of surrounding property owners and
others affected in deciding whether to grant or deny the request
for variance.

DESCRIPTION OF PROPOSED EXCEPTION
SHOWING JUSTIFICATIONS
This is a corner lot bordered on two sides by intersecting
streets, with frontage to the east and south on North 3rd street
and Pearl Court, respectively. This lot is zoned R-6 (Residen-
tial). A deck is located on the west second story of Applicant's
house. Applicant desires to construct a four foot (4') exterior
stairway from the second story deck to ground level. This
stairway will serve as a fire excape from the second floor
bedroom. Appropriate windows allowing egress from the second
floor bedroom will be installed permitting occupants in the
bedroom the ability to exit through the windows to the stairway.
Applicant desires to place the stairway in the west side
yard. This will result in a four foot (4') wide encroachment
into the ten foot (10') west rear yard setback. Applicant relies
on the authority of Section 24-37 (f) (1) of the Aspen zoning code
which allows for fire escapes to project up to four feet (4')
into required yards.

AGREEMENT REGARDING BUILDING PERMIT
WHEREAS,
Marcia Gray
(hereinafter
"owner") applied for a building permit for single family residence at
701 North 3rd
on June 20, 1980 (remodel)

WHEREAS, the following items have been determined to be existing
or potential problems with the application:
~he loft is not to be occupied as anything except storage
and,
WHEREAS, the owner is willing to make certain assurances and
agreements relating to these problems and on the basis of such assurances
the County is willing to issue a building permit;
NOW, THEREFORE, it is agreed as follows:
1. The owner agrees to do the following:
(a) that the loft area will not be used for living
or habitable area
(b) that the loft will be used for storage only.
2. In the event the owner fails to perform any of the above the
County may revoke any permits which may have been granted to the owner.
3. This agreement is binding upon the heirs, successors in title,
and assigns of the parties.
