ASPEN B CON~~CIAL 1L /fJ..L", .G-MA_~_' PROPERTIES ~.. ~/p'.-f;A EXHIBIT "A" Applicant desires to install awnings/valances on the top floor of the Aspen Grove Building. The name of each store would be neatly printed on the front of the awnings/valances in front of each respective store. The Historic Preservation Commission (HPC) has granted approval for the installation of the awnings; however, the Building Inspector maintains that the lettering on the awnings/valances would violate the sign regulations of the Municipal Code, Section 24-5.10. Mr. Drueding has taken the position that the sign regulations prohibit signs on any store which does not have street frontage. This application is: tion ing (1)); (a) for you to review the decision and determina- made by the Building Inspector that the proposed letter- is in violation of the sign regulations (Section 2-21 or in the alternative; (b) for you to vary or modify the application of the zoning laws with respect to the applicability of the sign regulations to the building in question sInce there are practical difficulties and unnecessary hardships in the way of carrying ot the strict letter of the laws. (Section 2-21(3)). The justifications for the request are as follows: A. We believe that the decision and determination of the Building Inspector that the sign regulations prohibit signs on any store which does not have street frontage is wrong. No such specific prohibition can be found anywhere in the Municipal Code. Rather, it is Mr. Drueding's interpreta- tion of Section 24-5.10(2) which creates that prohibition. That Section provides that: "(2) The aggregate sign area permitted along any one street shall not exceed one square foot of sign area for each three (3) feet of lot line frontage occupied by or projected from the building within which the principal use is conducted. Uses fronting on an alley shall compute their sign area allowance by considering the alley as the lot line frontage. In no case shall the aggregate sign area for anyone use on anyone frontage exceed twenty (20) square feeL" street. If yon find, however, that the decision and deter- mination of the -Building Inspector is correct we ask you to vary or modify the application of the sign regulations in this case based upon the following: 1. The special conditions and circumstances do not result from actions of the applicant. The sign regulations are archaic. They were created at a time when all retail commercial space was on street level. and they were specifically designed for signs on the malls. They are presently being rewritten to make them more fair, equitable, and practical and to specifically allow signs in a case such as that herein presented. 2. The special or extraordinary circumstances applicable to the subject property are that the retail shops on the second floor cannot compete with respect to their advertising with the shops on the ground floor in the same vicinity and zone. Since, just by reason of the fact that they happen to be on the second floor, they are precluded from having any signs. Clearly, such a fortuitous disparity violates the purpose and intent of the sign ordinance and creates a substantial injust ice. 3. The granting of a variance is essential to the enjoyment of a substantial property right enjoyed by other properties in the same vicinity and zone, but denied the subject property because of the special conditions or extraordinary circumstances. The following other buildings or stores in the same vicinity and zone have the right to advertise by having the names of their retail shops on awnings similar to those proposed or on the store fronts: Mill Street Plaza Building Brand Building Aspen Block Building Epicure Building Wheeler Opera House Building Tom Thumb Building Ajax Mountain Building - 2- Mogul Shops Ute City Banque Building Andres Building Aspen Leaf Building Mother Lode Pour La France 4. The granting of the variance will not adversely affect the general purpose of the comprehensive general plan. I disagree with your determination based primarily upon the following factors: 1. By definition, in order to be considered a "sign" it must be" visible from the public right of way and designed to conveyor direct a message to the public " (Section 24-5.1(A)) Most, if not all, of the proposed letter- ing would not be visible from the closest public right of way. Rather the signs would be intended for display in the courtyard or actually on the upper level. 2. Section 24-5.10(A)(2) contains the maximum sizes for signs and sign area and provides that: "the aggregate sign area permitted along ~ one street shall not exceed one square foot of sign area "1O"r each three feet of lot line frontage occupied by or projected from the building within which the principal use is conducted." They are presently being rewritten to make them more fair, equitable, and practical and to specifically allow signs in a case such as that herein presented. 2. The granting of a variance is essential to the enjoyment of a substantial property right enjoyed by other properties in the same vicinity and zone, but denied the subject property because of the special conditions or extraordinary circumstances.
