BUILOING OEPARTMENT FILE GOLD - CUSTOMER'S COPY flf'~ Applicants are the owners of "Gracey 'S" , a second-hand clothing store situate on Lot L, Block 73, City and Townsite of Aspen. We hold leases on the Gracey's building and also on Lot M which building formerly housed Terese David's. We applied for a building permit to connect the two buildings with a four foot walkway per the attached plans. The permit was rejected based on Section 24-l3.4(a) of the Municipal Code which forbids the expansion of a non-conforming use. Accordingly, the undersigned hereby request a variance for the construction of the walkway based on the following: l. There are special circumstances and conditions which do not result from the actions of the applicants. The two buildings in question are historically designated Victorian houses situate approximately four feet apart. The building on Lot M consists of space used for retail in front and a residential apartment in the rear. Due to the configuration of the building and location of plumbing, wiring and the like, it will be extremely difficult to utilize the commercial space without the walkway. It will also be extremely difficult for the owner to rent such a small space wi thout the walkway which would connect with the adj acent building. The walkway would be constructed in such a manner as to shore up both structures without altering the valuable historical architectural nature of the buildings. Finally, the walkway will increase the safety of the buildings and provide better access for our customers, many of whom are elderly, as they will have to spend less time negotiating the icy walks in winter. 2. Special circumstances apply to the buildings which do not apply similarly to other properties in the zone. As stated previously, the current use of the property is non-conforming and has been for many years. Unlike most other businesses, i.e.; Explore Book Store, the furniture store, Aspen Floral, etc., the two buildings do not even have Conditional Use Status. As indicated before, maintenance of the historical mixed commercial/residential use of the property is extremely difficult, if not impossible, without the connecting walkway. 3. The granting of the variance is essential to the enjoyment of a substantial property right enjoyed by other properties in the same vicinity. Applicants believe that the proposed walkway is necessary to the successful and safe maintenance of the historical uses of the properties involved If-; (mixed-commercial residential) . It will also be very difficult to rent the commercial portion of the Terese David building other than in conjunction wi th the Gracey I s structure. While our commercial use is non-conforming, it certainly has no more impact than the other permitted and conditional uses in the office zone. In addition, the walkway will be constructed in such a manner as to shore up and strengthen the structural integrity of the buildings thus preserving their historical nature. 4. Granting of the variance will not affect the general purposes of the comprehensive plan. It should be noted that granting the variance would in no way result in any change of use of the properties involved, and the actual commercial floor space will not be increased. Granting of the variance will make the continued operation of the buildings as they have been in the past, feasible. In addition, the structural integrity of the building will be improved and the historical architecture preserved. 5. Summary. The applicants will, as noted above, have severe practical difficulties and unnecessary hardships in operating the building in the way they have been in the past (retail clothing) as a result of the mixed commercial residential use of the Terese David building. Petitioner would, in all likelihood have to look for other space if the variance were not granted.
