NOTICE OF PUBLIC HEARING Case No. 84-18 BEFORE THE CITY OF ASPEN BOARD OF ADJUSTMENT TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE VARIANCE DESCRIBED BELOW: Pursuant to the Official Code of Aspen of June 25, 1962, as amended, a public hearing will be held in the Council Room, City Hall, Aspen, Colorado, (or at such other place as the meeting may be then adjourned) to consider an application filed with the said Board of Adjustment requesting authority for variance from the provisions of the Zoning Ordinance, Chapter 24, Official Code of Aspen. All persons affected by the proposed variance are invited to appear and state their views, protests or Objections. If you cannot appear personally at such meeting, then you are urged to state your views by letter, particularly if you have objection to such variance, as the Board of Adjustment will give serious consideration to the opinions of surrounding property owners and others affected in deciding whether to grant or deny the request for variance. Hallam Dear Board Members: The City Engineering Department has made a physical inspection of the above-referenced premises in connection with the property owners' variance application under your present consideration and has the following comments and observations: 1. The Engineering Department is interested in encouraging off-street parking facilities and would commend the Barnhardts' proposal as being responsive thereto; and 2. The garage proposed by the Barnhardts would, in fact, create less of an obstruction to the alley function than the existing fence on the property line and, to that extent, is favorably mitigative of the current existing condition. The Engineering Department also feels that the con- struction of the proposed garage would conduce to the installa- tion of a trash storage area off the alley adjacent to the garage entrance and would encourage the applicants' consideration of the installation of such facilities. Galena Street Aspen, CO 81611 Re: Lots K and L, Block 35, City and Townsite of Aspen Dear Board Members: We represent Irvin and Carmen Barnhart, the owners of the above-referenced property who, by this request, seek your consideration of a rear and front yard setback variance to enable them to construct an attached garage at the rear of the property and entrance foyer. The Barnharts purchased the property a little over a month ago. The property, which is located at the corner of West Hallam and North Fourth Streets is zoned R-6. The applicable setbacks for principal buildings are, of course, ten feet for the front yard and 15 for the rear yard. At present, the property is improved with a single-family woodframe home with a wooden exterior, which is predominantly single-story with a split level portion on the rear of the North Fourth Street side. The proposed garage would be located where currently there is a redwood deck. The wooden fence, approximately 6 feet high, that presently is in place along the property line, would be removed. The garage would be 26 feet in width by 23 feet in depth, which would result in a rear yard setback of 7~ feet. The alley at the rear of the property would, needless to say, tend to mitigate the effects of a shortened rear yard setback. Indeed, the homes abutting the other side of the alley all seem to enjoy outbuildings constructed considerably closer to the respective property lines - yet a sense of congestion is not present, The other immediate two homes on the West Hallam side of Block 35, both of which enjoy garages, appear to be much larger in building mass (footprint and height) than the Barnhart home and, in these circumstances, the erection of the proposed garage would be substantially in keeping with these other homes and not visually disruptive. ,I{-/~ c - - ,-,",~ '__,J' ~ '-" OATES, HUGHES & KNEZEVICH, P. Aspen Board of Adjustment July 26, 1984 Page 2 The Barnharts also wish to vary the applicable front yard setback some six inches to permit the construction of a 6 by 10 foot entrance foyer, which will serve as both a mud room and air lock so that blasts of cold air will not intrude into the house each time the front door is opened during the wintertime. As such, the foyer should serve as an energy conservation fea- ture. The foyer would extend slightly beyond the existing concrete porch, which serves the front door. It would be well within the line of sight marked by the fencing and trees on the adjoining properties and, again, would not appear to be visually disruptive. We believe the variances here sought to be consistent with overall objectives of zoning and land use codes fostering, as they do, both offstreet parking goals and energy conservation. Moreover, installation of the garage and foyer would not be at all incompatible with existing uses in the block, especially on the southerly side where newer and larger home exist. Garage facilities are an important property right, yet due to the configuration of the Barnhart home and its single-story orien- tation (as contrasted from the adjoining two-story homes, which have garage facilities) there does not appear to be any other way to construct a garage without the variance here sought.
